8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 28.0258, Education Code, is amended by |
---|
10 | 10 | | amending Subsection (a) and adding Subsection (a-1) and (h-1) to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (a) This section applies only to an 11th or 12th grade |
---|
13 | 13 | | student who has failed to comply with the end-of-course assessment |
---|
14 | 14 | | instrument performance requirements under Section 39.025 for not |
---|
15 | 15 | | more than two courses. |
---|
16 | 16 | | (a-1) This section applies to all 12th grade students for |
---|
17 | 17 | | the 2020-2021, 2021-2022, and 2022-2023 school years without the |
---|
18 | 18 | | performance requirements under Subsection (a). This subsection |
---|
19 | 19 | | expires September 1, 2023. |
---|
20 | 20 | | (h-1) For the 2020-2021, 2021-2022, and 2022-2023 school |
---|
21 | 21 | | years, an individual graduation committee may determine that a |
---|
22 | 22 | | student is qualified to graduate without considering performance on |
---|
23 | 23 | | any end-of-course assessment instruments administered under |
---|
24 | 24 | | Section 39.023, Education Code. This subsection expires September |
---|
25 | 25 | | 1, 2023. |
---|
26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2021. |
