55 AN ACT
66 relating to individual graduation committee qualification
77 requirements for certain students.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 28.0258, Education Code, is amended by
1010 amending Subsection (a) and adding Subsection (a-1) and (h-1) to
1111 read as follows:
1212 (a) This section applies only to an 11th or 12th grade
1313 student who has failed to comply with the end-of-course assessment
1414 instrument performance requirements under Section 39.025 for not
1515 more than two courses.
1616 (a-1) This section applies to all 12th grade students for
1717 the 2020-2021, 2021-2022, and 2022-2023 school years without the
1818 performance requirements under Subsection (a). This subsection
1919 expires September 1, 2023.
2020 (h-1) For the 2020-2021, 2021-2022, and 2022-2023 school
2121 years, an individual graduation committee may determine that a
2222 student is qualified to graduate without considering performance on
2323 any end-of-course assessment instruments administered under
2424 Section 39.023, Education Code. This subsection expires September
2525 1, 2023.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2021.
