55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to information on and requirements for certain courses and
88 educational programs offered in public schools, including courses
99 offered through the state virtual school network.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 26.0031(c-1), Education Code, is amended
1212 to read as follows:
1313 (c-1) A school district or open-enrollment charter school
1414 may decline to pay the cost for a student of more than three
1515 yearlong electronic courses, or the equivalent, during any school
1616 year. This subsection does not:
1717 (1) limit the ability of the student to enroll in
1818 additional electronic courses at the student's cost; or
1919 (2) apply to a student enrolled in:
2020 (A) a full-time online program that was operating
2121 on January 1, 2013; or
2222 (B) a district or school that has fewer than
2323 1,600 students in average daily attendance for the current school
2424 year.
2525 SECTION 2. Section 28.002, Education Code, is amended by
2626 adding Subsection (c-4) to read as follows:
2727 (c-4) The State Board of Education shall by rule require
2828 each district to make available to each eighth grade student in the
2929 district an Algebra I course. Notwithstanding Section 7.056(e),
3030 the commissioner may grant a district a temporary waiver from the
3131 requirements of this subsection if necessary, as determined by the
3232 commissioner.
3333 SECTION 3. Subchapter A, Chapter 28, Education Code, is
3434 amended by adding Section 28.0161 to read as follows:
3535 Sec. 28.0161. NOTIFICATION REGARDING COURSE PATHWAYS AND
3636 CAREER CHOICES. Each school year, a school district shall provide
3737 to each district student entering grades 6 through 10 and the
3838 student's parent or guardian information regarding:
3939 (1) the courses offered as part of the foundation
4040 curriculum adopted under Section 28.002(a)(1) and available at the
4141 campus attended by the student and at any high school campus that
4242 the student is expected to attend; and
4343 (2) potential career choices and the curriculum
4444 requirements and courses needed to pursue those careers.
4545 SECTION 4. Subchapter B, Chapter 28, Education Code, is
4646 amended by adding Section 28.028 to read as follows:
4747 Sec. 28.028. POSTING OF ADVANCED COURSEWORK INFORMATION.
4848 (a) Not later than September 1 of each year, the agency shall post
4949 information to the agency's Internet website on the number of
5050 students who, during the previous school year, were enrolled in or
5151 accepted into:
5252 (1) an educational program for gifted and talented
5353 students under Subchapter D, Chapter 29;
5454 (2) an Algebra I course as an eighth grade student;
5555 (3) an Algebra II or precalculus course or other
5656 advanced mathematics course;
5757 (4) an advanced placement course;
5858 (5) an international baccalaureate course; or
5959 (6) an OnRamps dual enrollment course or other dual
6060 credit course.
6161 (b) The information shall include the percentage of
6262 students who received a passing score in the course or who remained
6363 in the program, as applicable, and must be aggregated by campus,
6464 district, and grade level and disaggregated by student race, sex,
6565 ethnicity, grade level, and socioeconomic status.
6666 (c) In posting information under this section, the agency
6767 must comply with all state and federal privacy laws applicable to
6868 student information.
6969 SECTION 5. Section 30A.153(a-1), Education Code, is amended
7070 to read as follows:
7171 (a-1) For purposes of Subsection (a), a school district or
7272 open-enrollment charter school is limited to the funding described
7373 by that subsection for a student's enrollment in not more than three
7474 electronic courses during any school year, unless:
7575 (1) the student is enrolled in a full-time online
7676 program that was operating on January 1, 2013; or
7777 (2) the district or school has fewer than 1,600
7878 students in average daily attendance for the current school year.
7979 SECTION 6. Not later than January 1, 2022, the State Board
8080 of Education shall adopt rules necessary to implement the
8181 requirements of Section 28.002(c-4), Education Code, as added by
8282 this Act.
8383 SECTION 7. This Act applies beginning with the 2021-2022
8484 school year.
8585 SECTION 8. This Act takes effect immediately if it receives
8686 a vote of two-thirds of all the members elected to each house, as
8787 provided by Section 39, Article III, Texas Constitution. If this
8888 Act does not receive the vote necessary for immediate effect, this
8989 Act takes effect September 1, 2021.
