88 that excludes coverage for preexisting conditions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 8, Insurance Code, is amended
1111 by adding Chapter 1223 to read as follows:
1212 CHAPTER 1223. PREEXISTING CONDITION COVERAGE EXCLUSIONS
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 1223.0001. APPLICABILITY OF CHAPTER. This chapter
1515 applies to an individual or group accident and health insurance
1616 policy that excludes coverage for preexisting conditions,
1717 including:
1818 (1) an individual accident and health insurance policy
1919 governed by Chapter 1201;
2020 (2) a group accident and health insurance policy
2121 governed by Chapter 1251; or
2222 (3) a short-term limited-duration insurance policy
2323 governed by Chapter 1509.
2424 Sec. 1223.0002. RULES. The commissioner may adopt rules
2525 necessary to implement this chapter.
2626 SUBCHAPTER B. REQUIREMENTS AND EFFECTS OF PREEXISTING CONDITION
2727 EXCLUSIONS
2828 Sec. 1223.0101. HEALTH INFORMATION DISCLOSURE REQUIRED.
2929 (a) An insurance policy governed by this chapter may not exclude
3030 coverage for a preexisting condition unless the application or
3131 enrollment form for the policy requires disclosure of prior
3232 illness, disease, or physical conditions or of prior medical care
3333 and treatment.
3434 (b) An insurer may not require a disclosure of the health
3535 information of an applicant's or enrollee's family member in an
3636 application or enrollment form for an insurance policy governed by
3737 this chapter unless the family member is also seeking coverage
3838 under the policy.
3939 Sec. 1223.0102. TERMINATION REQUIREMENTS. (a) An insurer
4040 may not terminate an insurance policy governed by this chapter
4141 before the expiration date except for:
4242 (1) failure to pay the premium or other applicable
4343 charges for coverage;
4444 (2) material failure to abide by rules, policies, or
4545 procedures of the plan;
4646 (3) fraud or misrepresentation affecting coverage;
4747 (4) a request from the policyholder to cancel
4848 coverage; and
4949 (5) a cause for termination the commissioner
5050 determines is not objectionable.
5151 (b) If an insurer terminates an insurance policy governed by
5252 this chapter before the policy expiration date, the insurer must
5353 send written notice to the insured that includes:
5454 (1) the specific reason the policy was terminated; and
5555 (2) notice that the insured may file a complaint with
5656 the department if the insured believes that the policy was
5757 inappropriately terminated.
5858 SECTION 2. Not later than January 1, 2022, the commissioner
5959 of insurance shall adopt rules necessary to implement Chapter 1223,
6060 Insurance Code, as added by this Act.
6161 SECTION 3. Chapter 1223, Insurance Code, as added by this
6262 Act, applies only to an insurance policy delivered, issued for
6363 delivery, or renewed on or after January 1, 2022.
6464 SECTION 4. This Act takes effect September 1, 2021.
