66 AN ACT
77 relating to the establishment of the Mental Illness and
88 Intellectual or Developmental Disability Advisory Council.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 7, Health and Safety Code, is
1111 amended by adding Chapter 535 to read as follows:
1212 CHAPTER 535. MENTAL ILLNESS AND INTELLECTUAL OR DEVELOPMENTAL
1313 DISABILITY ADVISORY COUNCIL
1414 Sec. 535.001. DEFINITION. In this chapter, "advisory
1515 council" means the Mental Illness and Intellectual or Developmental
1616 Disability Advisory Council established under this chapter.
1717 Sec. 535.002. ESTABLISHMENT OF ADVISORY COUNCIL. The
1818 Mental Illness and Intellectual or Developmental Disability
1919 Advisory Council is established to advise the commission and the
2020 legislature on best practices in providing care to individuals with
2121 co-occurring mental illness and intellectual or developmental
2222 disabilities.
2323 Sec. 535.003. APPOINTMENT OF ADVISORY COUNCIL MEMBERS. The
2424 advisory council is composed of the following members:
2525 (1) one member appointed by the commissioner of
2626 education;
2727 (2) one member appointed by the executive director of
2828 the Texas Department of Criminal Justice;
2929 (3) one member of the Governor's Committee on People
3030 with Disabilities appointed by the governor;
3131 (4) any other individual considered necessary by the
3232 governor, appointed by the governor; and
3333 (5) the following members appointed by the executive
3434 commissioner:
3535 (A) one member representing an advocacy
3636 organization in this state supporting individuals with
3737 intellectual or developmental disabilities;
3838 (B) one member representing an advocacy
3939 organization in this state supporting individuals experiencing
4040 mental illness;
4141 (C) one member representing an advocacy
4242 organization in this state supporting individuals involved in the
4343 criminal justice system;
4444 (D) one member representing a local mental health
4545 authority;
4646 (E) one member representing a local intellectual
4747 and developmental disability authority;
4848 (F) one parent or family member of a person with
4949 co-occurring mental illness and intellectual or developmental
5050 disabilities;
5151 (G) one member who is a person with an
5252 intellectual or developmental disability who has personally
5353 experienced mental illness;
5454 (H) one member who is a licensed health care
5555 provider with experience treating individuals with co-occurring
5656 mental illness and intellectual or developmental disabilities;
5757 (I) one member who is a licensed social worker,
5858 as defined by Section 505.002, Occupations Code;
5959 (J) one member who is a teacher certified in
6060 special education under Subchapter B, Chapter 21, Education Code;
6161 (K) one member who is a representative of a
6262 public institution of higher education in this state that is a
6363 member of one of the University Centers for Excellence in
6464 Developmental Disabilities Education, Research, and Service; and
6565 (L) one member who has experience researching the
6666 mental health needs of individuals with an intellectual or
6767 developmental disability.
6868 Sec. 535.004. TERMS; VACANCY. (a) The advisory council
6969 shall select a presiding officer from among the advisory council
7070 members.
7171 (b) Members of the advisory council shall serve two-year
7272 terms.
7373 (c) A vacancy on the advisory council shall be filled in the
7474 same manner as the original appointment.
7575 (d) A member appointed to fill a vacancy holds the office
7676 for the unexpired portion of the term.
7777 (e) Each member may be reappointed to serve on the advisory
7878 council by the appropriate appointing authority as provided by
7979 Section 535.003.
8080 Sec. 535.005. MEETINGS; QUORUM. (a) The advisory council
8181 shall meet at times and locations as determined by the presiding
8282 officer or by a majority of the members of the advisory council.
8383 (b) A majority of the members of the advisory council
8484 constitute a quorum.
8585 Sec. 535.006. ADMINISTRATIVE SUPPORT. The commission shall
8686 provide administrative support to the advisory council.
8787 Sec. 535.007. ANNUAL REPORT. Not later than December 1 of
8888 each year, the advisory council shall prepare and submit to the
8989 governor, lieutenant governor, legislature, commission, and other
9090 relevant state agencies or stakeholders a written report that
9191 includes recommendations on ensuring that comprehensive and
9292 integrated mental health and intellectual or developmental
9393 disability services in this state are available and provided using
9494 a person-centered approach in institutional, public, and private
9595 settings.
9696 SECTION 2. As soon as practicable after the effective date
9797 of this Act, the governor, the commissioner of education, the
9898 executive commissioner of the Health and Human Services Commission,
9999 and the executive director of the Texas Department of Criminal
100100 Justice shall appoint members to the Mental Illness and
101101 Intellectual or Developmental Disability Advisory Council, as
102102 required by Chapter 535, Health and Safety Code, as added by this
103103 Act.
104104 SECTION 3. This Act takes effect September 1, 2021.
