| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter D, Chapter 38, Utilities Code, is |
|---|
| 10 | 10 | | amended by adding Sections 38.0721 and 38.0722 to read as follows: |
|---|
| 11 | 11 | | Sec. 38.0721. EXCLUSION OF WATER FACILITIES FROM ROLLING |
|---|
| 12 | 12 | | BLACKOUT. The commission by rule shall require each electric |
|---|
| 13 | 13 | | utility, municipally owned utility, and electric cooperative to |
|---|
| 14 | 14 | | exclude any circuits that provide power to a facility necessary to |
|---|
| 15 | 15 | | provide water to wholesale customers from participation in the |
|---|
| 16 | 16 | | utility's or cooperative's attempt to shed load in response to a |
|---|
| 17 | 17 | | rolling blackout initiated by an independent organization |
|---|
| 18 | 18 | | certified under Section 39.151 or another reliability council or |
|---|
| 19 | 19 | | power pool in which the utility or cooperative operates. |
|---|
| 20 | 20 | | Sec. 38.0722. WATER TREATMENT GRANTS. (a) The commission |
|---|
| 21 | 21 | | shall establish a program to provide grants of state money |
|---|
| 22 | 22 | | appropriated for that purpose to facilities necessary to provide |
|---|
| 23 | 23 | | water to wholesale customers for the purpose of purchasing of |
|---|
| 24 | 24 | | generators to provide a backup power supply for water treatment |
|---|
| 25 | 25 | | during a power outage. |
|---|
| 26 | 26 | | (b) The commission by rule shall adopt criteria for |
|---|
| 27 | 27 | | determining which facilities should receive grants under this |
|---|
| 28 | 28 | | section. The criteria must prioritize facilities in: |
|---|
| 29 | 29 | | (1) areas with a high frequency or duration of power |
|---|
| 30 | 30 | | outages relative to other areas of the state; and |
|---|
| 31 | 31 | | (2) economically distressed areas, as defined by |
|---|
| 32 | 32 | | Section 15.001, Water Code. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2021. |
