77 relating to electricity supplied to certain water facilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter D, Chapter 38, Utilities Code, is
1010 amended by adding Sections 38.0721 and 38.0722 to read as follows:
1111 Sec. 38.0721. EXCLUSION OF WATER FACILITIES FROM ROLLING
1212 BLACKOUT. The commission by rule shall require each electric
1313 utility, municipally owned utility, and electric cooperative to
1414 exclude any circuits that provide power to a facility necessary to
1515 provide water to wholesale customers from participation in the
1616 utility's or cooperative's attempt to shed load in response to a
1717 rolling blackout initiated by an independent organization
1818 certified under Section 39.151 or another reliability council or
1919 power pool in which the utility or cooperative operates.
2020 Sec. 38.0722. WATER TREATMENT GRANTS. (a) The commission
2121 shall establish a program to provide grants of state money
2222 appropriated for that purpose to facilities necessary to provide
2323 water to wholesale customers for the purpose of purchasing of
2424 generators to provide a backup power supply for water treatment
2525 during a power outage.
2626 (b) The commission by rule shall adopt criteria for
2727 determining which facilities should receive grants under this
2828 section. The criteria must prioritize facilities in:
2929 (1) areas with a high frequency or duration of power
3030 outages relative to other areas of the state; and
3131 (2) economically distressed areas, as defined by
3232 Section 15.001, Water Code.
3333 SECTION 2. This Act takes effect September 1, 2021.
