8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter Z, Chapter 157, Local Government | |
10 | 10 | Code, is amended by adding Section 157.907 to read as follows: | |
11 | 11 | Sec. 157.907. COUNTY LIABILITY FOR CRIMINAL PROSECUTION. | |
12 | 12 | (a) The commissioner's court of a county shall indemnify a person | |
13 | 13 | for reasonable attorney's fees incurred in defense of a criminal | |
14 | 14 | prosecution against the person if: | |
15 | 15 | (1) the person is: | |
16 | 16 | (A) an elected official of the county; | |
17 | 17 | (B) an appointed official of the county; or | |
18 | 18 | (C) an employee of an elected or appointed | |
19 | 19 | official of the county; | |
20 | 20 | (2) the commissioner's court determines that the | |
21 | 21 | conduct for which the person is criminally prosecuted was an act or | |
22 | 22 | omission by the person in the course and scope of the person's | |
23 | 23 | office, employment, or contractual performance for or service on | |
24 | 24 | behalf of the county; and | |
25 | 25 | (3) the person is found not guilty after a trial or | |
26 | 26 | appeal, or the complaint, information, or indictment is dismissed | |
27 | 27 | without a plea of guilty or nolo contendere being entered. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2021. |
