55 AN ACT
66 relating to the indemification of certain county officials or
77 employees for attorney's fees.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter Z, Chapter 157, Local Government
1010 Code, is amended by adding Section 157.907 to read as follows:
1111 Sec. 157.907. COUNTY LIABILITY FOR CRIMINAL PROSECUTION.
1212 (a) The commissioner's court of a county shall indemnify a person
1313 for reasonable attorney's fees incurred in defense of a criminal
1414 prosecution against the person if:
1515 (1) the person is:
1616 (A) an elected official of the county;
1717 (B) an appointed official of the county; or
1818 (C) an employee of an elected or appointed
1919 official of the county;
2020 (2) the commissioner's court determines that the
2121 conduct for which the person is criminally prosecuted was an act or
2222 omission by the person in the course and scope of the person's
2323 office, employment, or contractual performance for or service on
2424 behalf of the county; and
2525 (3) the person is found not guilty after a trial or
2626 appeal, or the complaint, information, or indictment is dismissed
2727 without a plea of guilty or nolo contendere being entered.
2828 SECTION 2. This Act takes effect September 1, 2021.
