5- relating to filing fees for certain candidates considered for
6- nomination by convention.
7+ relating to filing fees for certain candidates for office in
8+ primary elections.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 141.041, Election Code, is transferred
911 to Subchapter B, Chapter 181, Election Code, redesignated as
1012 Section 181.0311, Election Code, and amended to read as follows:
1113 Sec. 181.0311 [141.041]. FILING FEE OR PETITION REQUIRED
1214 [TO APPEAR ON BALLOT FOR GENERAL ELECTION FOR STATE AND COUNTY
1315 OFFICERS]. (a) In addition to any other requirements, [to be
1416 eligible] to be considered for nomination by convention [placed on
1517 the ballot for the general election for state and county officers],
1618 a candidate [who is nominated by convention under Chapter 181 or
1719 182] must:
1820 (1) pay a filing fee to the secretary of state for a
1921 statewide or district office or the county judge for a county or
2022 precinct office; or
2123 (2) submit to the secretary of state for a statewide or
2224 district office or the county judge for a county or precinct office
2325 a petition in lieu of a filing fee that satisfies the requirements
2426 prescribed by Subsection (e) and Section 141.062.
2527 (b) The amount of the filing fee is the amount prescribed by
2628 Section 172.024 for a candidate for nomination for the same office
2729 in a general primary election.
2830 (c) A filing fee received by the secretary of state shall be
2931 deposited in the state treasury to the credit of the general revenue
3032 fund.
3133 (d) A filing fee received by the county judge shall be
3234 deposited in the county treasury to the credit of the county general
3335 fund.
3436 (e) The minimum number of signatures that must appear on the
3537 petition authorized by Subsection (a) is the number prescribed by
3638 Section 172.025 to appear on a petition of a candidate for
3739 nomination for the same office in a general primary election.
3840 (f) The secretary of state shall adopt rules as necessary to
3941 implement this section.
4042 SECTION 2. This Act takes effect September 1, 2021.
