| 7 | 7 | | relating to education employees uniform group health coverage. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 48.275(c), Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (c) Notwithstanding any other provision of this code, a |
|---|
| 12 | 12 | | school district or participating charter school may use the sum of |
|---|
| 13 | 13 | | the following amounts of funds only to pay contributions under a |
|---|
| 14 | 14 | | group health coverage plan for district or school employees: |
|---|
| 15 | 15 | | (1) the amount determined by multiplying the amount |
|---|
| 16 | 16 | | of $1,800 [$900] or the amount specified in the General |
|---|
| 17 | 17 | | Appropriations Act for that year for purposes of the state |
|---|
| 18 | 18 | | contribution under Section 1579.251, Insurance Code, by the number |
|---|
| 19 | 19 | | of district or school employees who participate in a group health |
|---|
| 20 | 20 | | coverage plan provided by or through the district or school; and |
|---|
| 21 | 21 | | (2) the difference between the amount necessary for |
|---|
| 22 | 22 | | the district or school to comply with Section 1581.052, Insurance |
|---|
| 23 | 23 | | Code, for the school year and the amount the district or school is |
|---|
| 24 | 24 | | required to use to provide health coverage under Section 1581.051, |
|---|
| 25 | 25 | | Insurance Code, for that year. |
|---|
| 26 | 26 | | SECTION 2. Section 1579.251, Insurance Code, is amended to |
|---|
| 27 | 27 | | read as follows: |
|---|
| 28 | 28 | | Sec. 1579.251. STATE ASSISTANCE. (a) The state shall |
|---|
| 29 | 29 | | assist employees of participating school districts and charter |
|---|
| 30 | 30 | | schools in the purchase of group health coverage under this chapter |
|---|
| 31 | 31 | | by providing for each covered employee the amount of $1,800 [$900] |
|---|
| 32 | 32 | | each state fiscal year or a greater amount as provided by the |
|---|
| 33 | 33 | | General Appropriations Act. The state contribution shall be |
|---|
| 34 | 34 | | distributed through the school finance formulas under Chapters 48 |
|---|
| 35 | 35 | | and 49, Education Code, and used by school districts and charter |
|---|
| 36 | 36 | | schools as provided by Section 48.275, Education Code. |
|---|
| 37 | 37 | | (b) The state shall assist employees of participating |
|---|
| 38 | 38 | | regional education service centers and educational districts |
|---|
| 39 | 39 | | described by Section 1579.002(5)(B) in the purchase of group health |
|---|
| 40 | 40 | | coverage under this chapter by providing to the employing service |
|---|
| 41 | 41 | | center or educational district, for each covered employee, the |
|---|
| 42 | 42 | | amount of $1,800 [$900] each state fiscal year or a greater amount |
|---|
| 43 | 43 | | as provided by the General Appropriations Act. |
|---|
| 44 | 44 | | SECTION 3. Section 1581.052(a), Insurance Code, is amended |
|---|
| 45 | 45 | | to read as follows: |
|---|
| 46 | 46 | | (a) A school district, other educational district, |
|---|
| 47 | 47 | | participating charter school, or regional education service center |
|---|
| 48 | 48 | | shall, for each fiscal year, use to provide health coverage an |
|---|
| 49 | 49 | | amount equal to the number of participating employees of the |
|---|
| 50 | 50 | | district, school, or service center multiplied by $2,400 [$1,800]. |
|---|
| 51 | 51 | | SECTION 4. This Act applies beginning with the 2021-2022 |
|---|
| 52 | 52 | | school year. |
|---|
| 53 | 53 | | SECTION 5. This Act takes effect September 1, 2021. |
|---|
