| 7 | 7 | | relating to the computation of unemployment compensation benefits |

| 8 | 8 | | for an individual who is totally unemployed in a benefit period. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Sections 207.002(a), (b), and (c-1), Labor Code, |
|---|
| 11 | 11 | | are amended to read as follows: |
|---|
| 12 | 12 | | (a) An eligible individual who is totally unemployed in a |
|---|
| 13 | 13 | | benefit period is entitled to benefits for the benefit period at the |
|---|
| 14 | 14 | | rate of 2/43 [1/25] of the wages received by the individual from |
|---|
| 15 | 15 | | employment by employers during that quarter in the individual's |
|---|
| 16 | 16 | | base period in which wages were highest. For purposes of this |
|---|
| 17 | 17 | | subsection, the wages received by the individual from employment by |
|---|
| 18 | 18 | | employers during the individual's base period include wages ordered |
|---|
| 19 | 19 | | to be paid to the individual by a final order of the commission |
|---|
| 20 | 20 | | under Chapter 61 that: |
|---|
| 21 | 21 | | (1) were due to be paid to the individual by an |
|---|
| 22 | 22 | | employer during the individual's base period; and |
|---|
| 23 | 23 | | (2) will be credited to the date or dates on which the |
|---|
| 24 | 24 | | payment of those wages was due. |
|---|
| 25 | 25 | | (b) The maximum weekly benefit amount is 60 [47.6] percent |
|---|
| 26 | 26 | | of the average weekly wage in covered employment in this state. The |
|---|
| 27 | 27 | | minimum weekly benefit amount is 15 [7.6] percent of the average |
|---|
| 28 | 28 | | weekly wage in covered employment in this state. |
|---|
| 29 | 29 | | (c-1) An increase in the maximum weekly benefit amount may |
|---|
| 30 | 30 | | not exceed $14 in any year. An increase in the minimum weekly |
|---|
| 31 | 31 | | benefit amount may not exceed $1 in any year. The limitations |
|---|
| 32 | 32 | | prescribed by this subsection apply only to an increase that is |
|---|
| 33 | 33 | | caused solely by an increase in the average weekly wage in covered |
|---|
| 34 | 34 | | employment in this state. |
|---|
| 35 | 35 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 36 | 36 | | a claim for unemployment compensation benefits filed with the Texas |
|---|
| 37 | 37 | | Workforce Commission on or after the effective date of this Act. A |
|---|
| 38 | 38 | | claim filed before the effective date of this Act is governed by the |
|---|
| 39 | 39 | | law in effect on the date the claim was filed, and the former law is |
|---|
| 40 | 40 | | continued in effect for that purpose. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect October 1, 2021. |
