55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a reduction of the amount by which a school district
88 with high enrollment of educationally disadvantaged students or
99 students of limited English proficiency must reduce the district's
1010 local revenue levels in excess of entitlement under the public
1111 school finance system.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 48.257, Education Code, is amended by
1414 amending Subsection (a) and adding Subsection (b-1) to read as
1515 follows:
1616 (a) Subject to Subsection (b) and except as provided by
1717 Subsection (b-1), if a school district's tier one local share under
1818 Section 48.256 exceeds the district's entitlement under Section
1919 48.266(a)(1) less the district's distribution from the state
2020 available school fund, the district must reduce the district's tier
2121 one revenue level in accordance with Chapter 49 to a level not to
2222 exceed the district's entitlement under Section 48.266(a)(1) less
2323 the district's distribution from the state available school fund.
2424 (b-1) Notwithstanding Subsection (a), for a school district
2525 to which Subsection (a) applies and in which more than 80 percent of
2626 the students are educationally disadvantaged or students of limited
2727 English proficiency, as defined by Section 29.052, the agency shall
2828 adjust the amount of the reduction required in the district's tier
2929 one revenue level under Subsection (a) by 20 percent.
3030 SECTION 2. This Act takes effect September 1, 2021.
