8 | 13 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 14 | SECTION 1. Chapter 112, Occupations Code, is amended by | |
10 | 15 | adding Subchapter C to read as follows: | |
11 | 16 | SUBCHAPTER C. COMPLAINT REFERRALS | |
12 | 17 | Sec. 112.101. COMPLAINTS AGAINST HEALTH CARE PRACTITIONER | |
13 | 18 | LICENSED BY DIFFERENT LICENSING ENTITY. (a) Notwithstanding any | |
14 | 19 | other law, a licensing entity that receives a complaint concerning | |
15 | 20 | a health care practitioner who holds a license issued by a different | |
16 | 21 | licensing entity shall promptly forward a copy of the complaint to | |
17 | 22 | that licensing entity. | |
18 | 23 | (b) A licensing entity may not take disciplinary action | |
19 | 24 | based on a complaint against a health care practitioner who holds a | |
20 | - | license issued by a different licensing entity unless: | |
21 | - | (1) the licensing entity that issued the license | |
22 | - | refers the complaint back to the licensing entity that received the | |
23 | - | complaint for investigation and resolution; or | |
24 | - | (2) the disciplinary action is taken under Subtitle B | |
25 | - | for practicing medicine in this state without a license. | |

26 | 28 | SECTION 2. The changes in law made by this Act apply only to | |

29 | 31 | date of this Act is governed by the law in effect on the date the | |
30 | 32 | complaint was filed, and the former law is continued in effect for | |
31 | 33 | that purpose. | |
32 | 34 | SECTION 3. This Act takes effect immediately if it receives | |
33 | 35 | a vote of two-thirds of all the members elected to each house, as | |
34 | 36 | provided by Section 39, Article III, Texas Constitution. If this | |
35 | 37 | Act does not receive the vote necessary for immediate effect, this | |
36 | 38 | Act takes effect September 1, 2021. | |
