49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to the procedure for certain complaints against health
712 care practitioners.
813 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
914 SECTION 1. Chapter 112, Occupations Code, is amended by
1015 adding Subchapter C to read as follows:
1116 SUBCHAPTER C. COMPLAINT REFERRALS
1217 Sec. 112.101. COMPLAINTS AGAINST HEALTH CARE PRACTITIONER
1318 LICENSED BY DIFFERENT LICENSING ENTITY. (a) Notwithstanding any
1419 other law, a licensing entity that receives a complaint concerning
1520 a health care practitioner who holds a license issued by a different
1621 licensing entity shall promptly forward a copy of the complaint to
1722 that licensing entity.
1823 (b) A licensing entity may not take disciplinary action
1924 based on a complaint against a health care practitioner who holds a
20- license issued by a different licensing entity unless:
21- (1) the licensing entity that issued the license
22- refers the complaint back to the licensing entity that received the
23- complaint for investigation and resolution; or
24- (2) the disciplinary action is taken under Subtitle B
25- for practicing medicine in this state without a license.

2628 SECTION 2. The changes in law made by this Act apply only to
2729 a complaint filed against a health care practitioner on or after the
2830 effective date of this Act. A complaint filed before the effective
2931 date of this Act is governed by the law in effect on the date the
3032 complaint was filed, and the former law is continued in effect for
3133 that purpose.
3234 SECTION 3. This Act takes effect immediately if it receives
3335 a vote of two-thirds of all the members elected to each house, as
3436 provided by Section 39, Article III, Texas Constitution. If this
3537 Act does not receive the vote necessary for immediate effect, this
3638 Act takes effect September 1, 2021.
