| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Subtitle B, Title 12, Local Government Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 388 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 388. GRANT PROGRAM FOR UNINCORPORATED COMMUNITIES IN |
|---|
| 13 | 13 | | CERTAIN COUNTIES |
|---|
| 14 | 14 | | Sec. 388.001. APPLICABILITY. This chapter applies only to |
|---|
| 15 | 15 | | a county that: |
|---|
| 16 | 16 | | (1) has a population of not more than 3,000; |
|---|
| 17 | 17 | | (2) is adjacent to at least three counties with |
|---|
| 18 | 18 | | populations of less than 10,000; and |
|---|
| 19 | 19 | | (3) is located on an international border. |
|---|
| 20 | 20 | | Sec. 388.002. IMPROVEMENT PROJECT GRANT PROGRAM. (a) The |
|---|
| 21 | 21 | | commissioners court of a county by order may establish and |
|---|
| 22 | 22 | | implement a grant program for the purpose of funding public |
|---|
| 23 | 23 | | improvement projects to benefit unincorporated communities located |
|---|
| 24 | 24 | | in the county. |
|---|
| 25 | 25 | | (b) A public improvement project includes: |
|---|
| 26 | 26 | | (1) the acquisition, construction, or improvement of: |
|---|
| 27 | 27 | | (A) sidewalks, streets, roads, or other |
|---|
| 28 | 28 | | transportation infrastructure; |
|---|
| 29 | 29 | | (B) water, wastewater, or drainage facilities or |
|---|
| 30 | 30 | | improvements; or |
|---|
| 31 | 31 | | (C) other public facilities or improvements; and |
|---|
| 32 | 32 | | (2) special supplemental services for improvement and |
|---|
| 33 | 33 | | promotion of the area, including services relating to advertising, |
|---|
| 34 | 34 | | promotion, health and sanitation, water and wastewater, public |
|---|
| 35 | 35 | | safety, security, business recruitment, development, recreation, |
|---|
| 36 | 36 | | and cultural enhancement. |
|---|
| 37 | 37 | | Sec. 388.003. GIFTS, GRANTS, AND DONATIONS. The county may |
|---|
| 38 | 38 | | accept a gift, grant, or donation from any source to fund a public |
|---|
| 39 | 39 | | improvement project described by Section 388.002. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2021. |
