66 AN ACT
77 relating to a grant program for public improvement projects for
88 unincorporated communities in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 12, Local Government Code, is
1111 amended by adding Chapter 388 to read as follows:
1212 CHAPTER 388. GRANT PROGRAM FOR UNINCORPORATED COMMUNITIES IN
1313 CERTAIN COUNTIES
1414 Sec. 388.001. APPLICABILITY. This chapter applies only to
1515 a county that:
1616 (1) has a population of not more than 3,000;
1717 (2) is adjacent to at least three counties with
1818 populations of less than 10,000; and
1919 (3) is located on an international border.
2020 Sec. 388.002. IMPROVEMENT PROJECT GRANT PROGRAM. (a) The
2121 commissioners court of a county by order may establish and
2222 implement a grant program for the purpose of funding public
2323 improvement projects to benefit unincorporated communities located
2424 in the county.
2525 (b) A public improvement project includes:
2626 (1) the acquisition, construction, or improvement of:
2727 (A) sidewalks, streets, roads, or other
2828 transportation infrastructure;
2929 (B) water, wastewater, or drainage facilities or
3030 improvements; or
3131 (C) other public facilities or improvements; and
3232 (2) special supplemental services for improvement and
3333 promotion of the area, including services relating to advertising,
3434 promotion, health and sanitation, water and wastewater, public
3535 safety, security, business recruitment, development, recreation,
3636 and cultural enhancement.
3737 Sec. 388.003. GIFTS, GRANTS, AND DONATIONS. The county may
3838 accept a gift, grant, or donation from any source to fund a public
3939 improvement project described by Section 388.002.
4040 SECTION 2. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2021.
