| 6 | 6 | | relating to the development and operation of a transportation |

| 7 | 7 | | project by a regional mobility authority. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 370.003(14), Transportation Code, are |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (14) "Transportation project" means: |
|---|
| 12 | 12 | | (A) a turnpike project; |
|---|
| 13 | 13 | | (B) a system; |
|---|
| 14 | 14 | | (C) a passenger or freight rail facility, |
|---|
| 15 | 15 | | including: |
|---|
| 16 | 16 | | (i) tracks; |
|---|
| 17 | 17 | | (ii) a rail line; |
|---|
| 18 | 18 | | (iii) switching, signaling, or other |
|---|
| 19 | 19 | | operating equipment; |
|---|
| 20 | 20 | | (iv) a depot; |
|---|
| 21 | 21 | | (v) a locomotive; |
|---|
| 22 | 22 | | (vi) rolling stock; |
|---|
| 23 | 23 | | (vii) a maintenance facility; and |
|---|
| 24 | 24 | | (viii) other real and personal property |
|---|
| 25 | 25 | | associated with a rail operation; |
|---|
| 26 | 26 | | (D) a roadway with a functional classification |
|---|
| 27 | 27 | | greater than a local road or rural minor collector; |
|---|
| 28 | 28 | | (D-1) a bridge; |
|---|
| 29 | 29 | | (E) a ferry; |
|---|
| 30 | 30 | | (F) an airport, other than an airport that on |
|---|
| 31 | 31 | | September 1, 2005, was served by one or more air carriers engaged in |
|---|
| 32 | 32 | | scheduled interstate transportation, as those terms were defined by |
|---|
| 33 | 33 | | 14 C.F.R. Section 1.1 on that date; |
|---|
| 34 | 34 | | (G) a pedestrian or bicycle facility; |
|---|
| 35 | 35 | | (H) an intermodal hub; |
|---|
| 36 | 36 | | (I) an automated conveyor belt for the movement |
|---|
| 37 | 37 | | of freight; |
|---|
| 38 | 38 | | (J) a border crossing inspection station, |
|---|
| 39 | 39 | | including: |
|---|
| 40 | 40 | | (i) a border crossing inspection station |
|---|
| 41 | 41 | | located at or near an international border crossing; and |
|---|
| 42 | 42 | | (ii) a border crossing inspection station |
|---|
| 43 | 43 | | located at or near a border crossing from another state of the |
|---|
| 44 | 44 | | United States and not more than 50 miles from an international |
|---|
| 45 | 45 | | border; |
|---|
| 46 | 46 | | (K) an air quality improvement initiative; |
|---|
| 47 | 47 | | (L) a public utility facility; |
|---|
| 48 | 48 | | (M) a transit system; |
|---|
| 49 | 49 | | (M-1) a parking area, structure, or facility, or |
|---|
| 50 | 50 | | a collection device for parking fees; |
|---|
| 51 | 51 | | (N) if applicable, projects and programs listed |
|---|
| 52 | 52 | | in the most recently approved state implementation plan for the |
|---|
| 53 | 53 | | area covered by the authority, including an early action compact; |
|---|
| 54 | 54 | | (O) improvements in a transportation |
|---|
| 55 | 55 | | reinvestment zone designated under Subchapter E, Chapter 222; |
|---|
| 56 | 56 | | (P) port security, transportation, or facility |
|---|
| 57 | 57 | | projects eligible for funding under Section 55.002; [and] |
|---|
| 58 | 58 | | (Q) an aerial cable car or aerial tramway for the |
|---|
| 59 | 59 | | transportation of persons or property, or both, that is located in |
|---|
| 60 | 60 | | the jurisdiction of an authority created under Section 370.031(c); |
|---|
| 61 | 61 | | and |
|---|
| 62 | 62 | | (R) an urban green space or aesthetic enhancement |
|---|
| 63 | 63 | | located adjacent to or connected with an interstate highway, which |
|---|
| 64 | 64 | | may include: |
|---|
| 65 | 65 | | (i) recreational, bicycle, and pedestrian |
|---|
| 66 | 66 | | facilities; |
|---|
| 67 | 67 | | (ii) an intermodal hub; or |
|---|
| 68 | 68 | | (iii) parking areas, |
|---|
| 69 | 69 | | and which may include components, which will: |
|---|
| 70 | 70 | | (i) benefit a transit provider; and |
|---|
| 71 | 71 | | (ii) promote economic development in areas |
|---|
| 72 | 72 | | adjacent to the facility. |
|---|
| 73 | 73 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 74 | 74 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 75 | 75 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 76 | 76 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 77 | 77 | | Act takes effect September 1, 2021. |
