66 AN ACT
77 relating to the qualifications and method of electing directors of
88 the High Point Special Utility District of Kaufman and Rockwall
99 Counties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle C, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 7220 to read as follows:
1313 CHAPTER 7220. HIGH POINT SPECIAL UTILITY DISTRICT OF KAUFMAN AND
1414 ROCKWALL COUNTIES
1515 SUBCHAPTER A. GENERAL PROVISIONS
1616 Sec. 7220.0101. DEFINITIONS. In this chapter:
1717 (1) "Board" means the board of directors of the
1818 district.
1919 (2) "Director" means a member of the board.
2020 (3) "District" means the High Point Special Utility
2121 District of Kaufman and Rockwall Counties.
2222 SUBCHAPTER B. BOARD OF DIRECTORS
2323 Sec. 7220.0201. COMPOSITION OF BOARD. The district is
2424 governed by a board of seven directors.
2525 Sec. 7220.0202. ELECTION OF DIRECTORS FROM SINGLE-MEMBER
2626 DISTRICTS. (a) The board by rule may provide for the election of
2727 some or all of the directors from single-member districts.
2828 (b) If the board provides for the election of some or all of
2929 the directors from single-member districts, to be eligible to be
3030 listed on the ballot as a candidate for or to serve as a director
3131 from a single-member district, a person must be a resident of that
3232 district.
3333 SECTION 2. The change in law made by Section 7220.0202,
3434 Special District Local Laws Code, as added by this Act, does not
3535 affect the entitlement of a member serving on the board of directors
3636 of the High Point Special Utility District of Kaufman and Rockwall
3737 Counties immediately before the effective date of this Act to
3838 continue to carry out the board's functions for the remainder of the
3939 member's term. The change in law applies only to a member elected
4040 on or after the effective date of this Act. This Act does not
4141 prohibit a person who is a member of the board on the effective date
4242 of this Act from being reelected to the board if the person has the
4343 qualifications required for a member under Section 7220.0202,
4444 Special District Local Laws Code, as added by this Act.
4545 SECTION 3. (a) The legal notice of the intention to
4646 introduce this Act, setting forth the general substance of this
4747 Act, has been published as provided by law, and the notice and a
4848 copy of this Act have been furnished to all persons, agencies,
4949 officials, or entities to which they are required to be furnished
5050 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5151 Government Code.
5252 (b) The governor, one of the required recipients, has
5353 submitted the notice and Act to the Texas Commission on
5454 Environmental Quality.
5555 (c) The Texas Commission on Environmental Quality has filed
5656 its recommendations relating to this Act with the governor, the
5757 lieutenant governor, and the speaker of the house of
5858 representatives within the required time.
5959 (d) All requirements of the constitution and laws of this
6060 state and the rules and procedures of the legislature with respect
6161 to the notice, introduction, and passage of this Act are fulfilled
6262 and accomplished.
6363 SECTION 4. This Act takes effect September 1, 2021.
