6	6	AN ACT
7	7	relating to the qualifications and method of electing directors of
8	8	the High Point Special Utility District of Kaufman and Rockwall
9	9	Counties.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subtitle C, Title 6, Special District Local Laws
12	12	Code, is amended by adding Chapter 7220 to read as follows:
13	13	CHAPTER 7220. HIGH POINT SPECIAL UTILITY DISTRICT OF KAUFMAN AND
14	14	ROCKWALL COUNTIES
15	15	SUBCHAPTER A. GENERAL PROVISIONS
16	16	Sec. 7220.0101. DEFINITIONS. In this chapter:
17	17	(1) "Board" means the board of directors of the
18	18	district.
19	19	(2) "Director" means a member of the board.
20	20	(3) "District" means the High Point Special Utility
21	21	District of Kaufman and Rockwall Counties.
22	22	SUBCHAPTER B. BOARD OF DIRECTORS
23	23	Sec. 7220.0201. COMPOSITION OF BOARD. The district is
24	24	governed by a board of seven directors.
25	25	Sec. 7220.0202. ELECTION OF DIRECTORS FROM SINGLE-MEMBER
26	26	DISTRICTS. (a) The board by rule may provide for the election of
27	27	some or all of the directors from single-member districts.
28	28	(b) If the board provides for the election of some or all of
29	29	the directors from single-member districts, to be eligible to be
30	30	listed on the ballot as a candidate for or to serve as a director
31	31	from a single-member district, a person must be a resident of that
32	32	district.
33	33	SECTION 2. The change in law made by Section 7220.0202,
34	34	Special District Local Laws Code, as added by this Act, does not
35	35	affect the entitlement of a member serving on the board of directors
36	36	of the High Point Special Utility District of Kaufman and Rockwall
37	37	Counties immediately before the effective date of this Act to
38	38	continue to carry out the board's functions for the remainder of the
39	39	member's term. The change in law applies only to a member elected
40	40	on or after the effective date of this Act. This Act does not
41	41	prohibit a person who is a member of the board on the effective date
42	42	of this Act from being reelected to the board if the person has the
43	43	qualifications required for a member under Section 7220.0202,
44	44	Special District Local Laws Code, as added by this Act.
45	45	SECTION 3. (a) The legal notice of the intention to
46	46	introduce this Act, setting forth the general substance of this
47	47	Act, has been published as provided by law, and the notice and a
48	48	copy of this Act have been furnished to all persons, agencies,
49	49	officials, or entities to which they are required to be furnished
50	50	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
51	51	Government Code.
52	52	(b) The governor, one of the required recipients, has
53	53	submitted the notice and Act to the Texas Commission on
54	54	Environmental Quality.
55	55	(c) The Texas Commission on Environmental Quality has filed
56	56	its recommendations relating to this Act with the governor, the
57	57	lieutenant governor, and the speaker of the house of
58	58	representatives within the required time.
59	59	(d) All requirements of the constitution and laws of this
60	60	state and the rules and procedures of the legislature with respect
61	61	to the notice, introduction, and passage of this Act are fulfilled
62	62	and accomplished.
63	63	SECTION 4. This Act takes effect September 1, 2021.
