55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to desired future conditions for groundwater that are
88 declared unreasonable.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 36.1071, Water Code, is amended by
1111 amending Subsection (b) and adding Subsections (b-1) and (b-2) to
1212 read as follows:
1313 (b) The management plan, or any amendments to the plan,
1414 shall:
1515 (1) be developed using the district's best available
1616 data and forwarded to the regional water planning group for use in
1717 their planning process; and
1818 (2) include the:
1919 (A) most recently approved desired future
2020 conditions adopted under Section 36.108; and
2121 (B) amount of modeled available groundwater
2222 corresponding to the most recently approved desired future
2323 conditions.
2424 (b-1) A district shall amend a management plan before the
2525 second anniversary of the adoption of desired future conditions
2626 included under Subsection (b).
2727 (b-2) If a petition challenging the reasonableness of a
2828 desired future condition is filed under Section 36.1083(b), the
2929 executive administrator shall consider the management plan
3030 administratively complete if the district includes:
3131 (1) the most recently approved desired future
3232 conditions adopted under Section 36.108;
3333 (2) the amount of modeled available groundwater
3434 corresponding to the desired future conditions;
3535 (3) a statement of the status of the petition
3636 challenging the reasonableness of a desired future condition; and
3737 (4) the information required by Subsections (a) and
3838 (e).
3939 SECTION 2. Section 36.1083(a)(1), Water Code, is amended to
4040 read as follows:
4141 (1) "Affected person" means:
4242 (A) an owner of land in a district in the same
4343 management area in which a petition is filed;
4444 (B) a district;
4545 (C) a regional water planning group that has
4646 approved a regional water plan that includes a water management
4747 strategy applicable to the district that adopted the desired future
4848 conditions;
4949 (D) a person who holds or is applying for a permit
5050 from a district in the same management area in which a petition is
5151 filed;
5252 (E) a person who has groundwater rights in a
5353 district in the same management area in which a petition is filed;
5454 or
5555 (F) any other person defined as affected by
5656 commission rule [has the meaning assigned by Section 36.1082].
5757 SECTION 3. The changes in law made by this Act apply only to
5858 a petition filed under Section 36.1083, Water Code, as amended by
5959 this Act, on or after the effective date of this Act. A petition
6060 filed before the effective date of this Act is governed by the law
6161 in effect on the date the hearing was conducted, and the former law
6262 is continued in effect for that purpose.
6363 SECTION 4. This Act takes effect September 1, 2021.
