57 relating to the creation of the Montgomery County Water Control and
68 Improvement District No. 205; granting a limited power of eminent
79 domain; providing authority to issue bonds; providing authority to
810 impose assessments, fees, and taxes.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1113 Code, is amended by adding Chapter 9082 to read as follows:
1214 CHAPTER 9082. MONTGOMERY COUNTY WATER CONTROL AND IMPROVEMENT
1315 DISTRICT NO. 205
1416 SUBCHAPTER A. GENERAL PROVISIONS
1517 Sec. 9082.0101. DEFINITIONS. In this chapter:
1618 (1) "Board" means the district's board of directors.
1719 (2) "Commission" means the Texas Commission on
1820 Environmental Quality.
1921 (3) "Director" means a board member.
2022 (4) "District" means the Montgomery County Water
2123 Control and Improvement District No. 205.
2224 Sec. 9082.0102. NATURE OF DISTRICT. The district is a water
2325 control and improvement district created under Section 59, Article
2426 XVI, Texas Constitution.
2527 Sec. 9082.0103. CONFIRMATION AND DIRECTOR ELECTION
2628 REQUIRED. The temporary directors shall hold an election to
2729 confirm the creation of the district and to elect five permanent
2830 directors as provided by Section 49.102, Water Code.
2931 Sec. 9082.0104. CONSENT OF MUNICIPALITY REQUIRED. The
3032 temporary directors may not hold an election under Section
3133 9082.0103 until each municipality in whose corporate limits or
3234 extraterritorial jurisdiction the district is located has
3335 consented by ordinance or resolution to the creation of the
3436 district and to the inclusion of land in the district.
3537 Sec. 9082.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3638 (a) The district is created to serve a public purpose and benefit.
3739 (b) The district is created to accomplish the purposes of:
3840 (1) a water control and improvement district as
3941 provided by general law and Section 59, Article XVI, Texas
4042 Constitution, including the collection, transportation,
4143 processing, disposal, and control of domestic, industrial, or
4244 communal waste and the gathering, conducting, diverting, and
4345 control of local storm water or other harmful excesses of water; and
4446 (2) Section 52, Article III, Texas Constitution, that
4547 relate to the construction, acquisition, improvement, operation,
4648 or maintenance of macadamized, graveled, or paved roads, or
4749 improvements, including storm drainage, in aid of those roads.
4850 Sec. 9082.0106. INITIAL DISTRICT TERRITORY. (a) The
4951 district is initially composed of the territory described by
5052 Section 2 of the Act enacting this chapter.
5153 (b) The boundaries and field notes contained in Section 2 of
5254 the Act enacting this chapter form a closure. A mistake made in the
5355 field notes or in copying the field notes in the legislative process
5456 does not affect the district's:
5557 (1) organization, existence, or validity;
5658 (2) right to issue any type of bond for the purposes
5759 for which the district is created or to pay the principal of and
5860 interest on a bond;
5961 (3) right to impose a tax; or
6062 (4) legality or operation.
6163 SUBCHAPTER B. BOARD OF DIRECTORS
6264 Sec. 9082.0201. GOVERNING BODY; TERMS. (a) The district is
6365 governed by a board of five elected directors.
6466 (b) Except as provided by Section 9082.0202, directors
6567 serve staggered four-year terms.
6668 Sec. 9082.0202. TEMPORARY DIRECTORS. (a) The temporary
6769 board consists of:
6870 (1) Harris Allen Reynolds III;
6971 (2) Elliott Brayshaw;
7072 (3) Cindy Fields;
7173 (4) Alene Efaw; and
7274 (5) Robert Wanninger.
7375 (b) Temporary directors serve until the earlier of:
7476 (1) the date permanent directors are elected under
7577 Section 9082.0103; or
7678 (2) the fourth anniversary of the effective date of
7779 the Act enacting this chapter.
7880 (c) If permanent directors have not been elected under
7981 Section 9082.0103 and the terms of the temporary directors have
8082 expired, successor temporary directors shall be appointed or
8183 reappointed as provided by Subsection (d) to serve terms that
8284 expire on the earlier of:
8385 (1) the date permanent directors are elected under
8486 Section 9082.0103; or
8587 (2) the fourth anniversary of the date of the
8688 appointment or reappointment.
8789 (d) If Subsection (c) applies, the owner or owners of a
8890 majority of the assessed value of the real property in the district
8991 may submit a petition to the commission requesting that the
9092 commission appoint as successor temporary directors the five
9193 persons named in the petition. The commission shall appoint as
9294 successor temporary directors the five persons named in the
9395 petition.
9496 SUBCHAPTER C. POWERS AND DUTIES
9597 Sec. 9082.0301. GENERAL POWERS AND DUTIES. The district
9698 has the powers and duties necessary to accomplish the purposes for
9799 which the district is created.
98100 Sec. 9082.0302. WATER CONTROL AND IMPROVEMENT DISTRICT
99101 POWERS AND DUTIES. The district has the powers and duties provided
100102 by the general law of this state, including Chapters 49 and 51,
101103 Water Code, applicable to water control and improvement districts
102104 created under Section 59, Article XVI, Texas Constitution,
103105 specifically including the powers and duties authorized under
104106 Subchapter H, Chapter 51, Water Code.
105107 Sec. 9082.0303. AUTHORITY FOR ROAD PROJECTS. Under Section
106108 52, Article III, Texas Constitution, the district may design,
107109 acquire, construct, finance, issue bonds for, improve, operate,
108110 maintain, and convey to this state, a county, or a municipality for
109111 operation and maintenance macadamized, graveled, or paved roads, or
110112 improvements, including storm drainage, in aid of those roads.
111113 Sec. 9082.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
112114 road project must meet all applicable construction standards,
113115 zoning and subdivision requirements, and regulations of each
114116 municipality in whose corporate limits or extraterritorial
115117 jurisdiction the road project is located.
116118 (b) If a road project is not located in the corporate limits
117119 or extraterritorial jurisdiction of a municipality, the road
118120 project must meet all applicable construction standards,
119121 subdivision requirements, and regulations of each county in which
120122 the road project is located.
121123 (c) If the state will maintain and operate the road, the
122124 Texas Transportation Commission must approve the plans and
123125 specifications of the road project.
124126 Sec. 9082.0305. COMPLIANCE WITH MUNICIPAL CONSENT
125127 ORDINANCE OR RESOLUTION. The district shall comply with all
126128 applicable requirements of any ordinance or resolution that is
127129 adopted under Section 42.042 or 42.0425, Local Government Code, and
128130 that consents to the creation of the district or to the inclusion of
129131 land in the district.
130132 Sec. 9082.0306. LIMITATION ON USE OF EMINENT DOMAIN. The
131133 district may not exercise the power of eminent domain outside the
132134 district boundaries to acquire a site or easement for:
133135 (1) a recreational facility, as defined by Section
134136 49.462, Water Code; or
135137 (2) a road project authorized by Section 9082.0303.
136138 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
137139 Sec. 9082.0401. ELECTIONS REGARDING TAXES OR BONDS. (a)
138140 The district may issue, without an election, bonds and other
139141 obligations secured by:
140142 (1) revenue other than ad valorem taxes; or
141143 (2) contract payments described by Section 9082.0403.
142144 (b) The district must hold an election in the manner
143145 provided by Chapters 49 and 51, Water Code, to obtain voter approval
144146 before the district may impose an ad valorem tax or issue bonds
145147 payable from ad valorem taxes.
146148 (c) The district may not issue bonds payable from ad valorem
147149 taxes to finance a road project unless the issuance is approved by a
148150 vote of a two-thirds majority of the district voters voting at an
149151 election held for that purpose.
150152 Sec. 9082.0402. OPERATION AND MAINTENANCE TAX. (a) If
151153 authorized at an election held under Section 9082.0401, the
152154 district may impose an operation and maintenance tax on taxable
153155 property in the district in accordance with Section 49.107, Water
154156 Code.
155157 (b) The board shall determine the tax rate. The rate may not
156158 exceed the rate approved at the election.
157159 Sec. 9082.0403. CONTRACT TAXES. (a) In accordance with
158160 Section 49.108, Water Code, the district may impose a tax other than
159161 an operation and maintenance tax and use the revenue derived from
160162 the tax to make payments under a contract after the provisions of
161163 the contract have been approved by a majority of the district voters
162164 voting at an election held for that purpose.
163165 (b) A contract approved by the district voters may contain a
164166 provision stating that the contract may be modified or amended by
165167 the board without further voter approval.
166168 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
167169 Sec. 9082.0501. AUTHORITY TO ISSUE BONDS AND OTHER
168170 OBLIGATIONS. The district may issue bonds or other obligations
169171 payable wholly or partly from ad valorem taxes, impact fees,
170172 revenue, contract payments, grants, or other district money, or any
171173 combination of those sources, to pay for any authorized district
172174 purpose.
173175 Sec. 9082.0502. TAXES FOR BONDS. At the time the district
174176 issues bonds payable wholly or partly from ad valorem taxes, the
175177 board shall provide for the annual imposition of a continuing
176178 direct ad valorem tax, without limit as to rate or amount, while all
177179 or part of the bonds are outstanding as required and in the manner
178180 provided by Chapter 51, Water Code.
179181 Sec. 9082.0503. BONDS FOR ROAD PROJECTS. At the time of
180182 issuance, the total principal amount of bonds or other obligations
181183 issued or incurred to finance road projects and payable from ad
182184 valorem taxes may not exceed one-fourth of the assessed value of the
183185 real property in the district.
184186 Sec. 9082.0504. BONDS FOR RECREATIONAL FACILITIES. (a)
185187 The district may develop recreational facilities and issue bonds
186188 for recreational facilities as provided by Chapter 49, Water Code,
187189 regardless of whether the district's territory overlaps with the
188190 territory of a political subdivision that is authorized to develop
189191 recreational facilities and issue bonds for recreational
190192 facilities under Chapter 49, Water Code.
191193 (b) The authority of the district to develop recreational
192194 facilities and issue bonds for recreational facilities under this
193195 section does not limit the authority of another political
194196 subdivision whose territory the territory of the district may
195197 overlap, wholly or partly, to develop recreational facilities and
196198 issue bonds for recreational facilities under Chapter 49, Water
197199 Code.
198200 SECTION 2. The Montgomery County Water Control and
199201 Improvement District No. 205 initially includes all the territory
200202 contained in the following area:
201203 A METES & BOUNDS description of a certain 964.58 acre tract of
202204 land situated in the Montgomery County School Land Survey, Abstract
203205 No. 350 & 351, the T. F. Johnson Survey, Abstract No. 299 and the
204206 Timothy O'Neil Survey, Abstract No. 406 in Montgomery County,
205207 Texas, being comprised of a called 364.70 acre tract of land (Tract
206208 1) and a called 336.60 acre tract of land (Tract 2), SAVE AND EXCEPT
207209 a called 45.98 acre tract of land (Tract 3); PLUS a called 315.26
208210 acre tract of land (Tract 4).

374376 SECTION 3. (a) The legal notice of the intention to
375377 introduce this Act, setting forth the general substance of this
376378 Act, has been published as provided by law, and the notice and a
377379 copy of this Act have been furnished to all persons, agencies,
378380 officials, or entities to which they are required to be furnished
379381 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
380382 Government Code.
381383 (b) The governor, one of the required recipients, has
382384 submitted the notice and Act to the Texas Commission on
383385 Environmental Quality.
384386 (c) The Texas Commission on Environmental Quality has filed
385387 its recommendations relating to this Act with the governor, the
386388 lieutenant governor, and the speaker of the house of
387389 representatives within the required time.
388390 (d) All requirements of the constitution and laws of this
389391 state and the rules and procedures of the legislature with respect
390392 to the notice, introduction, and passage of this Act are fulfilled
391393 and accomplished.
392394 SECTION 4. (a) Section 9082.0306, Special District Local
393395 Laws Code, as added by Section 1 of this Act, takes effect only if
394396 this Act receives a two-thirds vote of all the members elected to
395397 each house.
396398 (b) If this Act does not receive a two-thirds vote of all the
397399 members elected to each house, Subchapter C, Chapter 9082, Special
398400 District Local Laws Code, as added by Section 1 of this Act, is
399401 amended by adding Section 9082.0306 to read as follows:
400402 Sec. 9082.0306. NO EMINENT DOMAIN POWER. The district may
401403 not exercise the power of eminent domain.
402404 (c) This section is not intended to be an expression of a
403405 legislative interpretation of the requirements of Section 17(c),
404406 Article I, Texas Constitution.
405407 SECTION 5. This Act takes effect immediately if it receives
406408 a vote of two-thirds of all the members elected to each house, as
407409 provided by Section 39, Article III, Texas Constitution. If this
408410 Act does not receive the vote necessary for immediate effect, this
409411 Act takes effect September 1, 2021.
