55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of the Brazoria Drainage District Number
88 Four to impose a maintenance tax and the validation of certain acts
99 of the Brazoria Drainage District Number Four.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 19, Chapter 991, Acts of the 74th
1212 Legislature, Regular Session, 1995, is amended by adding Subsection
1313 (e) to read as follows:
1414 (e) This section applies only to a maintenance tax levied
1515 and collected under the powers conferred by Section 59, Article
1616 XVI, Texas Constitution.
1717 SECTION 2. Chapter 991, Acts of the 74th Legislature,
1818 Regular Session, 1995, is amended by adding Section 19A to read as
1919 follows:
2020 Sec. 19A. MAINTENANCE TAX: SECTION 52, ARTICLE III. (a) The
2121 district may impose a maintenance tax under the powers conferred by
2222 Section 52, Article III, Texas Constitution, as authorized by
2323 Chapter 7, Acts of the 41st Legislature, 1st Called Session, 1929.
2424 (b) Section 56.242(a), Water Code, does not apply to a
2525 maintenance tax imposed under this section.
2626 SECTION 3. The legislature validates and confirms all
2727 governmental acts and proceedings of Brazoria Drainage District
2828 Number Four before the effective date of this Act in imposing a
2929 maintenance tax.
3030 SECTION 4. (a) The legal notice of the intention to
3131 introduce this Act, setting forth the general substance of this
3232 Act, has been published as provided by law, and the notice and a
3333 copy of this Act have been furnished to all persons, agencies,
3434 officials, or entities to which they are required to be furnished
3535 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3636 Government Code.
3737 (b) The governor, one of the required recipients, has
3838 submitted the notice and Act to the Texas Commission on
3939 Environmental Quality.
4040 (c) The Texas Commission on Environmental Quality has filed
4141 its recommendations relating to this Act with the governor, the
4242 lieutenant governor, and the speaker of the house of
4343 representatives within the required time.
4444 (d) All requirements of the constitution and laws of this
4545 state and the rules and procedures of the legislature with respect
4646 to the notice, introduction, and passage of this Act are fulfilled
4747 and accomplished.
4848 SECTION 5. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2021.
