411 A BILL TO BE ENTITLED
512 AN ACT
613 relating to the creation of the Moore's Crossing Municipal
714 Management District; providing authority to issue bonds; providing
815 authority to impose assessments, fees, and taxes.
916 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1017 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1118 Code, is amended by adding Chapter 3999 to read as follows:
1219 CHAPTER 3999. MOORE'S CROSSING MUNICIPAL MANAGEMENT DISTRICT
1320 SUBCHAPTER A. GENERAL PROVISIONS
1421 Sec. 3999.0101. DEFINITIONS. In this chapter:
1522 (1) "Board" means the district's board of directors.
1623 (2) "City" means the City of Austin.
1724 (3) "Commission" means the Texas Commission on
1825 Environmental Quality.
1926 (4) "Director" means a board member.
2027 (5) "District" means the Moore's Crossing Municipal
2128 Management District.
2229 (6) "Exempt property" means property owned by a
2330 governmental entity, including the city, a county, or the Moore's
2431 Crossing MUD.
2532 Sec. 3999.0102. NATURE OF DISTRICT. The Moore's Crossing
2633 Municipal Management District is a special district created under
2734 Section 59, Article XVI, Texas Constitution.
2835 Sec. 3999.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2936 creation of the district is essential to accomplish the purposes of
3037 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
3138 Texas Constitution, and other public purposes stated in this
3239 chapter.
3340 (b) By creating the district and in authorizing the city and
3441 other political subdivisions to contract with the district, the
3542 legislature has established a program to accomplish the public
3643 purposes set out in Section 52-a, Article III, Texas Constitution.
3744 (c) The creation of the district is necessary to promote,
3845 develop, encourage, and maintain employment, commerce,
3946 transportation, housing, tourism, recreation, the arts,
4047 entertainment, economic development, safety, and the public
4148 welfare in the district.
4249 (d) This chapter and the creation of the district may not be
4350 interpreted to relieve the city from providing the level of
4451 services provided as of the effective date of the Act enacting this
4552 chapter to the area in the district. The district is created to
4653 supplement and not to supplant city services provided in the
4754 district.
4855 Sec. 3999.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4956 (a) All land and other property included in the district will
5057 benefit from the improvements and services to be provided by the
5158 district under powers conferred by Sections 52 and 52-a, Article
5259 III, and Section 59, Article XVI, Texas Constitution, and other
5360 powers granted under this chapter.
5461 (b) The district is created to serve a public use and
5562 benefit.
5663 (c) The creation of the district is in the public interest
5764 and is essential to further the public purposes of:
5865 (1) developing and diversifying the economy of the
5966 state;
6067 (2) eliminating unemployment and underemployment; and
6168 (3) developing or expanding transportation and
6269 commerce.
6370 (d) The district will:
6471 (1) promote the health, safety, and general welfare of
6572 residents, employers, potential employees, employees, visitors,
6673 and consumers in the district, and of the public;
6774 (2) provide needed funding for the district to
6875 preserve, maintain, and enhance the economic health and vitality of
6976 the district territory as a community and business center;
7077 (3) promote the health, safety, welfare, and enjoyment
7178 of the public by providing pedestrian ways and by landscaping and
7279 developing certain areas in the district, which are necessary for
7380 the restoration, preservation, and enhancement of scenic beauty;
7481 and
7582 (4) provide for drainage, road, and recreational
7683 facilities for the district.
7784 (e) Pedestrian ways along or across a street, whether at
7885 grade or above or below the surface, and street lighting, street
7986 landscaping, parking, and street art objects are parts of and
8087 necessary components of a street and are considered to be a street
8188 or road improvement.
8289 (f) The district will not act as the agent or
8390 instrumentality of any private interest even though the district
8491 will benefit many private interests as well as the public.
8592 Sec. 3999.0105. INITIAL DISTRICT TERRITORY. (a) The
8693 district is initially composed of the territory described by
8794 Section 2 of the Act enacting this chapter.
8895 (b) The boundaries and field notes contained in Section 2 of
8996 the Act enacting this chapter form a closure. A mistake in the
9097 field notes or in copying the field notes in the legislative process
9198 does not affect the district's:
9299 (1) organization, existence, or validity;
93100 (2) right to issue any type of bonds for the purposes
94101 for which the district is created or to pay the principal of and
95102 interest on the bonds;
96103 (3) right to impose or collect an assessment or tax; or
97104 (4) legality or operation.
98105 Sec. 3999.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
99106 All or any part of the area of the district is eligible to be
100107 included in:
101108 (1) a tax increment reinvestment zone created under
102109 Chapter 311, Tax Code; or
103110 (2) a tax abatement reinvestment zone created under
104111 Chapter 312, Tax Code.
105112 Sec. 3999.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
106113 DISTRICTS LAW. Except as otherwise provided by this chapter,
107114 Chapter 375, Local Government Code, applies to the district.
108115 Sec. 3999.0108. CONSTRUCTION OF CHAPTER. This chapter
109116 shall be liberally construed in conformity with the findings and
110117 purposes stated in this chapter.
111118 SUBCHAPTER B. BOARD OF DIRECTORS
112119 Sec. 3999.0201. GOVERNING BODY; TERMS. (a) The district is
113120 governed by a board of five elected directors who serve staggered
114121 terms of four years.
115122 (b) Directors are elected in the manner provided by
116123 Subchapter D, Chapter 49, Water Code.
117124 (c) The board may not create an executive committee to
118125 exercise the powers of the board.
119126 Sec. 3999.0202. MEETINGS; NOTICE. (a) The board shall hold
120127 meetings at a place accessible to the public.
121128 (b) The board must post notice of each meeting with the city
122129 secretary not later than 72 hours before the scheduled time of the
123130 meeting.
124131 Sec. 3999.0203. COMPENSATION; EXPENSES. The district may
125132 compensate each director in an amount not to exceed $150 for each
126133 board meeting. The total amount of compensation for each director
127134 in one year may not exceed $7,200.
128135 Sec. 3999.0204. TEMPORARY DIRECTORS. (a) On or after the
129136 effective date of the Act creating this chapter, the owner or owners
130137 of a majority of the assessed value of the real property in the
131138 district according to the most recent certified tax appraisal roll
132139 for the county may submit a petition to the commission requesting
133140 that the commission appoint as temporary directors the five persons
134141 named in the petition. The commission shall appoint as temporary
135142 directors the five persons named in the petition.
136143 (b) The temporary or successor temporary directors shall
137144 hold an election to elect five permanent directors as provided by
138145 Section 49.102, Water Code.
139146 (c) Temporary directors serve until the earlier of:
140147 (1) the date permanent directors are elected under
141148 Subsection (b); or
142149 (2) the fourth anniversary of the effective date of
143150 the Act creating this chapter.
144151 (d) If permanent directors have not been elected under
145152 Subsection (b) and the terms of the temporary directors have
146153 expired, successor temporary directors shall be appointed or
147154 reappointed as provided by Subsection (e) to serve terms that
148155 expire on the earlier of:
149156 (1) the date permanent directors are elected under
150157 Subsection (b); or
151158 (2) the fourth anniversary of the date of the
152159 appointment or reappointment.
153160 (e) If Subsection (d) applies, the owner or owners of a
154161 majority of the assessed value of the real property in the district
155162 according to the most recent certified tax appraisal roll for the
156163 county may submit a petition to the commission requesting that the
157164 commission appoint as successor temporary directors the five
158165 persons named in the petition. The commission shall appoint as
159166 successor temporary directors the five persons named in the
160167 petition.
161168 SUBCHAPTER C. POWERS AND DUTIES
162169 Sec. 3999.0301. GENERAL POWERS AND DUTIES. The district
163170 has the powers and duties necessary to accomplish the purposes for
164171 which the district is created.
165172 Sec. 3999.0302. IMPROVEMENT PROJECTS AND SERVICES. (a)
166173 The district, using any money available to the district for the
167174 purpose, may provide, design, construct, acquire, improve,
168175 relocate, operate, maintain, or finance an improvement project or
169176 service authorized under this chapter or Chapter 375, Local
170177 Government Code.
171178 (b) The district may contract with a governmental or private
172179 entity to carry out an action under Subsection (a).
173180 (c) The implementation of a district project or service is a
174181 governmental function or service for the purposes of Chapter 791,
175182 Government Code.
176183 Sec. 3999.0303. AUTHORITY FOR ROAD PROJECTS. Under Section
177184 52, Article III, Texas Constitution, the district may design,
178185 acquire, construct, finance, issue bonds for, improve, operate,
179186 maintain, and convey to this state, a county, or a municipality for
180187 operation and maintenance macadamized, graveled, or paved roads or
181188 improvements, including storm drainage, in aid of those roads.
182189 Sec. 3999.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
183190 road project must meet all applicable construction standards,
184191 zoning and subdivision requirements, and regulations of each
185192 municipality in whose corporate limits or extraterritorial
186193 jurisdiction the road project is located.
187194 (b) If a road project is not located in the corporate limits
188195 or extraterritorial jurisdiction of a municipality, the road
189196 project must meet all applicable construction standards,
190197 subdivision requirements, and regulations of each county in which
191198 the road project is located.
192199 (c) If the state will maintain and operate the road, the
193200 Texas Transportation Commission must approve the plans and
194201 specifications of the road project.
195202 Sec. 3999.0305. PARKING FACILITIES. (a) The district may
196203 acquire, lease as lessor or lessee, construct, develop, own,
197204 operate, and maintain parking facilities or a system of parking
198205 facilities, including lots, garages, parking terminals, or other
199206 structures or accommodations for parking motor vehicles off the
200207 streets and related appurtenances.
201208 (b) The district's parking facilities serve the public
202209 purposes of the district and are owned, used, and held for a public
203210 purpose even if leased or operated by a private entity for a term of
204211 years.
205212 (c) The district's parking facilities are parts of and
206213 necessary components of a street and are considered to be a street
207214 or road improvement.
208215 (d) The development and operation of the district's parking
209216 facilities may be considered an economic development program.
210217 Sec. 3999.0306. ADDING OR EXCLUDING LAND. The district may
211218 add or exclude land in the manner provided by Subchapter J, Chapter
212219 49, Water Code, or by Subchapter H, Chapter 54, Water Code.
213220 Sec. 3999.0307. DISBURSEMENTS AND TRANSFERS OF MONEY. The
214221 board by resolution shall establish the number of directors'
215222 signatures and the procedure required for a disbursement or
216223 transfer of district money.
217224 Sec. 3999.0308. EXEMPT PROPERTY. The district may not
218225 impose an assessment, fee, tax, or other charge on an exempt
219226 property.
220227 Sec. 3999.0309. NO EMINENT DOMAIN POWER. The district may
221228 not exercise the power of eminent domain.
222229 SUBCHAPTER D. ASSESSMENTS
223230 Sec. 3999.0401. PETITION REQUIRED FOR FINANCING SERVICES
224231 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
225232 service or improvement project with assessments under this chapter
226233 unless a written petition requesting that service or improvement
227234 has been filed with the board.
228235 (b) A petition filed under Subsection (a) must be signed by
229236 the owners of a majority of the assessed value of real property in
230237 the district subject to assessment according to the most recent
231238 certified tax appraisal roll for the county.
232239 Sec. 3999.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
233240 The board by resolution may impose and collect an assessment for any
234241 purpose authorized by this chapter in all or any part of the
235242 district.
236243 (b) An assessment, a reassessment, or an assessment
237244 resulting from an addition to or correction of the assessment roll
238245 by the district, penalties and interest on an assessment or
239246 reassessment, an expense of collection, and reasonable attorney's
240247 fees incurred by the district:
241248 (1) are a first and prior lien against the property
242249 assessed;
243250 (2) are superior to any other lien or claim other than
244251 a lien or claim for county, school district, or municipal ad valorem
245252 taxes; and
246253 (3) are the personal liability of and a charge against
247254 the owners of the property even if the owners are not named in the
248255 assessment proceedings.
249256 (c) The lien is effective from the date of the board's
250257 resolution imposing the assessment until the date the assessment is
251258 paid. The board may enforce the lien in the same manner that the
252259 board may enforce an ad valorem tax lien against real property.
253260 (d) The board may make a correction to or deletion from the
254261 assessment roll that does not increase the amount of assessment of
255262 any parcel of land without providing notice and holding a hearing in
256263 the manner required for additional assessments.
257264 SUBCHAPTER E. TAXES AND BONDS
258265 Sec. 3999.0501. TAX ELECTION REQUIRED. The district must
259266 hold an election in the manner provided by Chapter 49, Water Code,
260267 or, if applicable, Chapter 375, Local Government Code, to obtain
261268 voter approval before the district may impose an ad valorem tax.
262269 Sec. 3999.0502. OPERATION AND MAINTENANCE TAX. (a) If
263270 authorized by a majority of the district voters voting at an
264271 election under Section 3999.0501, the district may impose an
265272 operation and maintenance tax on taxable property in the district
266273 in the manner provided by Section 49.107, Water Code, for any
267274 district purpose, including to:
268275 (1) maintain and operate the district;
269276 (2) construct or acquire improvements; or
270277 (3) provide a service.
271278 (b) The board shall determine the operation and maintenance
272279 tax rate. The rate may not exceed the rate approved at the
273280 election.
274281 Sec. 3999.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
275282 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
276283 terms determined by the board.
277284 (b) The district may issue bonds, notes, or other
278285 obligations payable wholly or partly from ad valorem taxes,
279286 assessments, impact fees, revenue, contract payments, grants, or
280287 other district money, or any combination of those sources of money,
281288 to pay for any authorized district purpose.
282289 Sec. 3999.0504. BONDS SECURED BY REVENUE OR CONTRACT
283290 PAYMENTS. The district may issue, without an election, bonds
284291 secured by:
285292 (1) revenue other than ad valorem taxes, including
286293 contract revenues; or
287294 (2) contract payments, provided that the requirements
288295 of Section 49.108, Water Code, have been met.
289296 Sec. 3999.0505. BONDS SECURED BY AD VALOREM TAXES;
290297 ELECTIONS. (a) If authorized at an election under Section
291298 3999.0501, the district may issue bonds payable from ad valorem
292299 taxes.
293300 (b) Section 375.243, Local Government Code, does not apply
294301 to the district.
295302 (c) At the time the district issues bonds payable wholly or
296303 partly from ad valorem taxes, the board shall provide for the annual
297304 imposition of a continuing direct annual ad valorem tax, without
298305 limit as to rate or amount, for each year that all or part of the
299306 bonds are outstanding as required and in the manner provided by
300307 Sections 54.601 and 54.602, Water Code.
301308 (d) All or any part of any facilities or improvements that
302309 may be acquired by a district by the issuance of its bonds may be
303310 submitted as a single proposition or as several propositions to be
304311 voted on at the election.
305312 Sec. 3999.0506. CONSENT OF MUNICIPALITY REQUIRED. (a) The
306313 board may not issue bonds until each municipality in whose
307314 corporate limits or extraterritorial jurisdiction the district is
308315 located has consented by ordinance or resolution to the creation of
309316 the district and to the inclusion of land in the district.
310317 (b) This section applies only to the district's first
311318 issuance of bonds payable from ad valorem taxes.
312319 SECTION 2. The Moore's Crossing Municipal Management
313320 District initially includes all territory contained in the
314321 following area:

816823 angle point hereof, and
817824 N 47°11'15" E, a distance of 252.87 feet to the POINT OF
818825 BEGINNING and containing 10.39 acres in Travis County, Texas.
819826 SECTION 3. (a) The legal notice of the intention to
820827 introduce this Act, setting forth the general substance of this
821828 Act, has been published as provided by law, and the notice and a
822829 copy of this Act have been furnished to all persons, agencies,
823830 officials, or entities to which they are required to be furnished
824831 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
825832 Government Code.
826833 (b) The governor, one of the required recipients, has
827834 submitted the notice and Act to the Texas Commission on
828835 Environmental Quality.
829836 (c) The Texas Commission on Environmental Quality has filed
830837 its recommendations relating to this Act with the governor,
831838 lieutenant governor, and speaker of the house of representatives
832839 within the required time.
833840 (d) All requirements of the constitution and laws of this
834841 state and the rules and procedures of the legislature with respect
835842 to the notice, introduction, and passage of this Act have been
836843 fulfilled and accomplished.
837844 SECTION 4. This Act takes effect immediately if it receives
838845 a vote of two-thirds of all the members elected to each house, as
839846 provided by Section 39, Article III, Texas Constitution. If this
840847 Act does not receive the vote necessary for immediate effect, this
841848 Act takes effect September 1, 2021.
