5	12		AN ACT
6	13		relating to the creation of the Moore's Crossing Municipal
7	14		Management District; providing authority to issue bonds; providing
8	15		authority to impose assessments, fees, and taxes.
9	16		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	17		SECTION 1. Subtitle C, Title 4, Special District Local Laws
11	18		Code, is amended by adding Chapter 3999 to read as follows:
12	19		CHAPTER 3999. MOORE'S CROSSING MUNICIPAL MANAGEMENT DISTRICT
13	20		SUBCHAPTER A. GENERAL PROVISIONS
14	21		Sec. 3999.0101. DEFINITIONS. In this chapter:
15	22		(1) "Board" means the district's board of directors.
16	23		(2) "City" means the City of Austin.
17	24		(3) "Commission" means the Texas Commission on
18	25		Environmental Quality.
19	26		(4) "Director" means a board member.
20	27		(5) "District" means the Moore's Crossing Municipal
21	28		Management District.
22	29		(6) "Exempt property" means property owned by a
23	30		governmental entity, including the city, a county, or the Moore's
24	31		Crossing MUD.
25	32		Sec. 3999.0102. NATURE OF DISTRICT. The Moore's Crossing
26	33		Municipal Management District is a special district created under
27	34		Section 59, Article XVI, Texas Constitution.
28	35		Sec. 3999.0103. PURPOSE; DECLARATION OF INTENT. (a) The
29	36		creation of the district is essential to accomplish the purposes of
30	37		Sections 52 and 52-a, Article III, and Section 59, Article XVI,
31	38		Texas Constitution, and other public purposes stated in this
32	39		chapter.
33	40		(b) By creating the district and in authorizing the city and
34	41		other political subdivisions to contract with the district, the
35	42		legislature has established a program to accomplish the public
36	43		purposes set out in Section 52-a, Article III, Texas Constitution.
37	44		(c) The creation of the district is necessary to promote,
38	45		develop, encourage, and maintain employment, commerce,
39	46		transportation, housing, tourism, recreation, the arts,
40	47		entertainment, economic development, safety, and the public
41	48		welfare in the district.
42	49		(d) This chapter and the creation of the district may not be
43	50		interpreted to relieve the city from providing the level of
44	51		services provided as of the effective date of the Act enacting this
45	52		chapter to the area in the district. The district is created to
46	53		supplement and not to supplant city services provided in the
47	54		district.
48	55		Sec. 3999.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
49	56		(a) All land and other property included in the district will
50	57		benefit from the improvements and services to be provided by the
51	58		district under powers conferred by Sections 52 and 52-a, Article
52	59		III, and Section 59, Article XVI, Texas Constitution, and other
53	60		powers granted under this chapter.
54	61		(b) The district is created to serve a public use and
55	62		benefit.
56	63		(c) The creation of the district is in the public interest
57	64		and is essential to further the public purposes of:
58	65		(1) developing and diversifying the economy of the
59	66		state;
60	67		(2) eliminating unemployment and underemployment; and
61	68		(3) developing or expanding transportation and
62	69		commerce.
63	70		(d) The district will:
64	71		(1) promote the health, safety, and general welfare of
65	72		residents, employers, potential employees, employees, visitors,
66	73		and consumers in the district, and of the public;
67	74		(2) provide needed funding for the district to
68	75		preserve, maintain, and enhance the economic health and vitality of
69	76		the district territory as a community and business center;
70	77		(3) promote the health, safety, welfare, and enjoyment
71	78		of the public by providing pedestrian ways and by landscaping and
72	79		developing certain areas in the district, which are necessary for
73	80		the restoration, preservation, and enhancement of scenic beauty;
74	81		and
75	82		(4) provide for drainage, road, and recreational
76	83		facilities for the district.
77	84		(e) Pedestrian ways along or across a street, whether at
78	85		grade or above or below the surface, and street lighting, street
79	86		landscaping, parking, and street art objects are parts of and
80	87		necessary components of a street and are considered to be a street
81	88		or road improvement.
82	89		(f) The district will not act as the agent or
83	90		instrumentality of any private interest even though the district
84	91		will benefit many private interests as well as the public.
85	92		Sec. 3999.0105. INITIAL DISTRICT TERRITORY. (a) The
86	93		district is initially composed of the territory described by
87	94		Section 2 of the Act enacting this chapter.
88	95		(b) The boundaries and field notes contained in Section 2 of
89	96		the Act enacting this chapter form a closure. A mistake in the
90	97		field notes or in copying the field notes in the legislative process
91	98		does not affect the district's:
92	99		(1) organization, existence, or validity;
93	100		(2) right to issue any type of bonds for the purposes
94	101		for which the district is created or to pay the principal of and
95	102		interest on the bonds;
96	103		(3) right to impose or collect an assessment or tax; or
97	104		(4) legality or operation.
98	105		Sec. 3999.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
99	106		All or any part of the area of the district is eligible to be
100	107		included in:
101	108		(1) a tax increment reinvestment zone created under
102	109		Chapter 311, Tax Code; or
103	110		(2) a tax abatement reinvestment zone created under
104	111		Chapter 312, Tax Code.
105	112		Sec. 3999.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
106	113		DISTRICTS LAW. Except as otherwise provided by this chapter,
107	114		Chapter 375, Local Government Code, applies to the district.
108	115		Sec. 3999.0108. CONSTRUCTION OF CHAPTER. This chapter
109	116		shall be liberally construed in conformity with the findings and
110	117		purposes stated in this chapter.
111	118		SUBCHAPTER B. BOARD OF DIRECTORS
112	119		Sec. 3999.0201. GOVERNING BODY; TERMS. (a) The district is
113	120		governed by a board of five elected directors who serve staggered
114	121		terms of four years.
115	122		(b) Directors are elected in the manner provided by
116	123		Subchapter D, Chapter 49, Water Code.
117	124		(c) The board may not create an executive committee to
118	125		exercise the powers of the board.
119	126		Sec. 3999.0202. MEETINGS; NOTICE. (a) The board shall hold
120	127		meetings at a place accessible to the public.
121	128		(b) The board must post notice of each meeting with the city
122	129		secretary not later than 72 hours before the scheduled time of the
123	130		meeting.
124	131		Sec. 3999.0203. COMPENSATION; EXPENSES. The district may
125	132		compensate each director in an amount not to exceed $150 for each
126	133		board meeting. The total amount of compensation for each director
127	134		in one year may not exceed $7,200.
128	135		Sec. 3999.0204. TEMPORARY DIRECTORS. (a) On or after the
129	136		effective date of the Act creating this chapter, the owner or owners
130	137		of a majority of the assessed value of the real property in the
131	138		district according to the most recent certified tax appraisal roll
132	139		for the county may submit a petition to the commission requesting
133	140		that the commission appoint as temporary directors the five persons
134	141		named in the petition. The commission shall appoint as temporary
135	142		directors the five persons named in the petition.
136	143		(b) The temporary or successor temporary directors shall
137	144		hold an election to elect five permanent directors as provided by
138	145		Section 49.102, Water Code.
139	146		(c) Temporary directors serve until the earlier of:
140	147		(1) the date permanent directors are elected under
141	148		Subsection (b); or
142	149		(2) the fourth anniversary of the effective date of
143	150		the Act creating this chapter.
144	151		(d) If permanent directors have not been elected under
145	152		Subsection (b) and the terms of the temporary directors have
146	153		expired, successor temporary directors shall be appointed or
147	154		reappointed as provided by Subsection (e) to serve terms that
148	155		expire on the earlier of:
149	156		(1) the date permanent directors are elected under
150	157		Subsection (b); or
151	158		(2) the fourth anniversary of the date of the
152	159		appointment or reappointment.
153	160		(e) If Subsection (d) applies, the owner or owners of a
154	161		majority of the assessed value of the real property in the district
155	162		according to the most recent certified tax appraisal roll for the
156	163		county may submit a petition to the commission requesting that the
157	164		commission appoint as successor temporary directors the five
158	165		persons named in the petition. The commission shall appoint as
159	166		successor temporary directors the five persons named in the
160	167		petition.
161	168		SUBCHAPTER C. POWERS AND DUTIES
162	169		Sec. 3999.0301. GENERAL POWERS AND DUTIES. The district
163	170		has the powers and duties necessary to accomplish the purposes for
164	171		which the district is created.
165	172		Sec. 3999.0302. IMPROVEMENT PROJECTS AND SERVICES. (a)
166	173		The district, using any money available to the district for the
167	174		purpose, may provide, design, construct, acquire, improve,
168	175		relocate, operate, maintain, or finance an improvement project or
169	176		service authorized under this chapter or Chapter 375, Local
170	177		Government Code.
171	178		(b) The district may contract with a governmental or private
172	179		entity to carry out an action under Subsection (a).
173	180		(c) The implementation of a district project or service is a
174	181		governmental function or service for the purposes of Chapter 791,
175	182		Government Code.
176	183		Sec. 3999.0303. AUTHORITY FOR ROAD PROJECTS. Under Section
177	184		52, Article III, Texas Constitution, the district may design,
178	185		acquire, construct, finance, issue bonds for, improve, operate,
179	186		maintain, and convey to this state, a county, or a municipality for
180	187		operation and maintenance macadamized, graveled, or paved roads or
181	188		improvements, including storm drainage, in aid of those roads.
182	189		Sec. 3999.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
183	190		road project must meet all applicable construction standards,
184	191		zoning and subdivision requirements, and regulations of each
185	192		municipality in whose corporate limits or extraterritorial
186	193		jurisdiction the road project is located.
187	194		(b) If a road project is not located in the corporate limits
188	195		or extraterritorial jurisdiction of a municipality, the road
189	196		project must meet all applicable construction standards,
190	197		subdivision requirements, and regulations of each county in which
191	198		the road project is located.
192	199		(c) If the state will maintain and operate the road, the
193	200		Texas Transportation Commission must approve the plans and
194	201		specifications of the road project.
195	202		Sec. 3999.0305. PARKING FACILITIES. (a) The district may
196	203		acquire, lease as lessor or lessee, construct, develop, own,
197	204		operate, and maintain parking facilities or a system of parking
198	205		facilities, including lots, garages, parking terminals, or other
199	206		structures or accommodations for parking motor vehicles off the
200	207		streets and related appurtenances.
201	208		(b) The district's parking facilities serve the public
202	209		purposes of the district and are owned, used, and held for a public
203	210		purpose even if leased or operated by a private entity for a term of
204	211		years.
205	212		(c) The district's parking facilities are parts of and
206	213		necessary components of a street and are considered to be a street
207	214		or road improvement.
208	215		(d) The development and operation of the district's parking
209	216		facilities may be considered an economic development program.
210	217		Sec. 3999.0306. ADDING OR EXCLUDING LAND. The district may
211	218		add or exclude land in the manner provided by Subchapter J, Chapter
212	219		49, Water Code, or by Subchapter H, Chapter 54, Water Code.
213	220		Sec. 3999.0307. DISBURSEMENTS AND TRANSFERS OF MONEY. The
214	221		board by resolution shall establish the number of directors'
215	222		signatures and the procedure required for a disbursement or
216	223		transfer of district money.
217	224		Sec. 3999.0308. EXEMPT PROPERTY. The district may not
218	225		impose an assessment, fee, tax, or other charge on an exempt
219	226		property.
220	227		Sec. 3999.0309. NO EMINENT DOMAIN POWER. The district may
221	228		not exercise the power of eminent domain.
222	229		SUBCHAPTER D. ASSESSMENTS
223	230		Sec. 3999.0401. PETITION REQUIRED FOR FINANCING SERVICES
224	231		AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
225	232		service or improvement project with assessments under this chapter
226	233		unless a written petition requesting that service or improvement
227	234		has been filed with the board.
228	235		(b) A petition filed under Subsection (a) must be signed by
229	236		the owners of a majority of the assessed value of real property in
230	237		the district subject to assessment according to the most recent
231	238		certified tax appraisal roll for the county.
232	239		Sec. 3999.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
233	240		The board by resolution may impose and collect an assessment for any
234	241		purpose authorized by this chapter in all or any part of the
235	242		district.
236	243		(b) An assessment, a reassessment, or an assessment
237	244		resulting from an addition to or correction of the assessment roll
238	245		by the district, penalties and interest on an assessment or
239	246		reassessment, an expense of collection, and reasonable attorney's
240	247		fees incurred by the district:
241	248		(1) are a first and prior lien against the property
242	249		assessed;
243	250		(2) are superior to any other lien or claim other than
244	251		a lien or claim for county, school district, or municipal ad valorem
245	252		taxes; and
246	253		(3) are the personal liability of and a charge against
247	254		the owners of the property even if the owners are not named in the
248	255		assessment proceedings.
249	256		(c) The lien is effective from the date of the board's
250	257		resolution imposing the assessment until the date the assessment is
251	258		paid. The board may enforce the lien in the same manner that the
252	259		board may enforce an ad valorem tax lien against real property.
253	260		(d) The board may make a correction to or deletion from the
254	261		assessment roll that does not increase the amount of assessment of
255	262		any parcel of land without providing notice and holding a hearing in
256	263		the manner required for additional assessments.
257	264		SUBCHAPTER E. TAXES AND BONDS
258	265		Sec. 3999.0501. TAX ELECTION REQUIRED. The district must
259	266		hold an election in the manner provided by Chapter 49, Water Code,
260	267		or, if applicable, Chapter 375, Local Government Code, to obtain
261	268		voter approval before the district may impose an ad valorem tax.
262	269		Sec. 3999.0502. OPERATION AND MAINTENANCE TAX. (a) If
263	270		authorized by a majority of the district voters voting at an
264	271		election under Section 3999.0501, the district may impose an
265	272		operation and maintenance tax on taxable property in the district
266	273		in the manner provided by Section 49.107, Water Code, for any
267	274		district purpose, including to:
268	275		(1) maintain and operate the district;
269	276		(2) construct or acquire improvements; or
270	277		(3) provide a service.
271	278		(b) The board shall determine the operation and maintenance
272	279		tax rate. The rate may not exceed the rate approved at the
273	280		election.
274	281		Sec. 3999.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
275	282		BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
276	283		terms determined by the board.
277	284		(b) The district may issue bonds, notes, or other
278	285		obligations payable wholly or partly from ad valorem taxes,
279	286		assessments, impact fees, revenue, contract payments, grants, or
280	287		other district money, or any combination of those sources of money,
281	288		to pay for any authorized district purpose.
282	289		Sec. 3999.0504. BONDS SECURED BY REVENUE OR CONTRACT
283	290		PAYMENTS. The district may issue, without an election, bonds
284	291		secured by:
285	292		(1) revenue other than ad valorem taxes, including
286	293		contract revenues; or
287	294		(2) contract payments, provided that the requirements
288	295		of Section 49.108, Water Code, have been met.
289	296		Sec. 3999.0505. BONDS SECURED BY AD VALOREM TAXES;
290	297		ELECTIONS. (a) If authorized at an election under Section
291	298		3999.0501, the district may issue bonds payable from ad valorem
292	299		taxes.
293	300		(b) Section 375.243, Local Government Code, does not apply
294	301		to the district.
295	302		(c) At the time the district issues bonds payable wholly or
296	303		partly from ad valorem taxes, the board shall provide for the annual
297	304		imposition of a continuing direct annual ad valorem tax, without
298	305		limit as to rate or amount, for each year that all or part of the
299	306		bonds are outstanding as required and in the manner provided by
300	307		Sections 54.601 and 54.602, Water Code.
301	308		(d) All or any part of any facilities or improvements that
302	309		may be acquired by a district by the issuance of its bonds may be
303	310		submitted as a single proposition or as several propositions to be
304	311		voted on at the election.
305	312		Sec. 3999.0506. CONSENT OF MUNICIPALITY REQUIRED. (a) The
306	313		board may not issue bonds until each municipality in whose
307	314		corporate limits or extraterritorial jurisdiction the district is
308	315		located has consented by ordinance or resolution to the creation of
309	316		the district and to the inclusion of land in the district.
310	317		(b) This section applies only to the district's first
311	318		issuance of bonds payable from ad valorem taxes.
312	319		SECTION 2. The Moore's Crossing Municipal Management
313	320		District initially includes all territory contained in the
314	321		following area:
315	322		TRACT 1
316	323		A 162.83 ACRE TRACT OF LAND, SITUATED IN THE NOEL M. BAIN SURVEY,
317	324		SECTION NO. 1, ABSTRACT NO. 61, BEING OUT OF THE REMNANT PORTION OF
318	325		A CALLED 1.425 ACRE TRACT, CONVEYED TO SR DEVELOPMENT, INC.,
319	326		RECORDED IN DOCUMENT NO. 2006151559 OF THE OFFICIAL PUBLIC RECORDS

819	826		SECTION 3. (a) The legal notice of the intention to
820	827		introduce this Act, setting forth the general substance of this
821	828		Act, has been published as provided by law, and the notice and a
822	829		copy of this Act have been furnished to all persons, agencies,
823	830		officials, or entities to which they are required to be furnished
824	831		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
825	832		Government Code.
826	833		(b) The governor, one of the required recipients, has
827	834		submitted the notice and Act to the Texas Commission on
828	835		Environmental Quality.
829	836		(c) The Texas Commission on Environmental Quality has filed
830	837		its recommendations relating to this Act with the governor,
831	838		lieutenant governor, and speaker of the house of representatives
832	839		within the required time.
833	840		(d) All requirements of the constitution and laws of this
834	841		state and the rules and procedures of the legislature with respect
835	842		to the notice, introduction, and passage of this Act have been
836	843		fulfilled and accomplished.
837	844		SECTION 4. This Act takes effect immediately if it receives
838	845		a vote of two-thirds of all the members elected to each house, as
839	846		provided by Section 39, Article III, Texas Constitution. If this
840	847		Act does not receive the vote necessary for immediate effect, this
841	848		Act takes effect September 1, 2021.
