55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the powers of the Hidalgo County Drainage District
88 Number 1; authorizing the issuance of bonds.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. In this Act, "district" means the Hidalgo County
1111 Drainage District Number 1.
1212 SECTION 2. (a) District bonds may be secured as described
1313 by a board resolution by a pledge of:
1414 (1) all or part of the district's gross revenue, other
1515 than taxation, minus the amount necessary to pay the cost of
1616 maintaining and operating the district and its property;
1717 (2) the net revenue of a contract made at any time; or
1818 (3) other revenue specified by board resolution.
1919 (b) The pledge may reserve the right to issue additional
2020 bonds on a parity with or subordinate to the bonds being issued,
2121 subject to conditions specified by the pledge.
2222 (c) District bonds not payable wholly or partly from ad
2323 valorem taxes may be issued without an election.
2424 SECTION 3. (a) The district may sell reclaimed water to
2525 consumers.
2626 (b) The district may enter into public-private partnership
2727 agreements to fund infrastructure improvements needed to sell
2828 reclaimed water to consumers.
2929 SECTION 4. (a) The legal notice of the intention to
3030 introduce this Act, setting forth the general substance of this
3131 Act, has been published as provided by law, and the notice and a
3232 copy of this Act have been furnished to all persons, agencies,
3333 officials, or entities to which they are required to be furnished
3434 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3535 Government Code.
3636 (b) The governor, one of the required recipients, has
3737 submitted the notice and Act to the Texas Commission on
3838 Environmental Quality.
3939 (c) The Texas Commission on Environmental Quality has filed
4040 its recommendations relating to this Act with the governor, the
4141 lieutenant governor, and the speaker of the house of
4242 representatives within the required time.
4343 (d) All requirements of the constitution and laws of this
4444 state and the rules and procedures of the legislature with respect
4545 to the notice, introduction, and passage of this Act are fulfilled
4646 and accomplished.
4747 SECTION 5. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2021.
