77 relating to the creation of the Montgomery County Municipal Utility
88 District No. 208; granting a limited power of eminent domain;
99 providing authority to issue bonds; providing authority to impose
1010 assessments, fees, and taxes.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1313 Code, is amended by adding Chapter 7939A to read as follows:
1414 CHAPTER 7939A. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT

1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 7939A.0101. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "City" means the City of Conroe, Texas.
2020 (3) "Commission" means the Texas Commission on
2121 Environmental Quality.
2222 (4) "Director" means a board member.
2323 (5) "District" means the Montgomery County Municipal
2424 Utility District No. 208.
2525 Sec. 7939A.0102. NATURE OF DISTRICT. The district is a
2626 municipal utility district created under Section 59, Article XVI,
2727 Texas Constitution.
2828 Sec. 7939A.0103. CONFIRMATION AND DIRECTOR ELECTION
2929 REQUIRED. The temporary directors shall hold an election to
3030 confirm the creation of the district and to elect five permanent
3131 directors as provided by Section 49.102, Water Code.
3232 Sec. 7939A.0104. CONSENT OF MUNICIPALITY REQUIRED. The
3333 temporary directors may not hold an election under Section
3434 7939A.0103 until each municipality in whose corporate limits or
3535 extraterritorial jurisdiction the district is located has
3636 consented by ordinance or resolution to the creation of the
3737 district and to the inclusion of land in the district.
3838 Sec. 7939A.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3939 (a) The district is created to serve a public purpose and benefit.
4040 (b) The district is created to accomplish the purposes of:
4141 (1) a municipal utility district as provided by
4242 general law and Section 59, Article XVI, Texas Constitution; and
4343 (2) Section 52, Article III, Texas Constitution, that
4444 relate to the construction, acquisition, improvement, operation,
4545 or maintenance of macadamized, graveled, or paved roads, or
4646 improvements, including storm drainage, in aid of those roads.
4747 Sec. 7939A.0106. INITIAL DISTRICT TERRITORY. (a) The
4848 district is initially composed of the territory described by
4949 Section 2 of the Act enacting this chapter.
5050 (b) The boundaries and field notes contained in Section 2 of
5151 the Act enacting this chapter form a closure. A mistake made in the
5252 field notes or in copying the field notes in the legislative process
5353 does not affect the district's:
5454 (1) organization, existence, or validity;
5555 (2) right to issue any type of bond for the purposes
5656 for which the district is created or to pay the principal of and
5757 interest on a bond;
5858 (3) right to impose a tax; or
5959 (4) legality or operation.
6060 Sec. 7939A.0107. EFFECT OF ANNEXATION. Notwithstanding any
6161 other law, if all or part of the territory of the district is
6262 annexed by the city into the city's corporate limits, the district:
6363 (1) retains all of the district's outstanding debt and
6464 obligations; and
6565 (2) is not dissolved.
6666 SUBCHAPTER B. BOARD OF DIRECTORS
6767 Sec. 7939A.0201. GOVERNING BODY; TERMS. (a) The district
6868 is governed by a board of five elected directors.
6969 (b) Except as provided by Section 7939A.0202, directors
7070 serve staggered four-year terms.
7171 Sec. 7939A.0202. TEMPORARY DIRECTORS. (a) On or after
7272 September 1, 2021, the owner or owners of a majority of the assessed
7373 value of the real property in the district may submit a petition to
7474 the commission requesting that the commission appoint as temporary
7575 directors the five persons named in the petition. The commission
7676 shall appoint as temporary directors the five persons named in the
7777 petition.
7878 (b) Temporary directors serve until the earlier of:
7979 (1) the date permanent directors are elected under
8080 Section 7939A.0103; or
8181 (2) September 1, 2025.
8282 (c) If permanent directors have not been elected under
8383 Section 7939A.0103 and the terms of the temporary directors have
8484 expired, successor temporary directors shall be appointed or
8585 reappointed as provided by Subsection (d) to serve terms that
8686 expire on the earlier of:
8787 (1) the date permanent directors are elected under
8888 Section 7939A.0103; or
8989 (2) the fourth anniversary of the date of the
9090 appointment or reappointment.
9191 (d) If Subsection (c) applies, the owner or owners of a
9292 majority of the assessed value of the real property in the district
9393 may submit a petition to the commission requesting that the
9494 commission appoint as successor temporary directors the five
9595 persons named in the petition. The commission shall appoint as
9696 successor temporary directors the five persons named in the
9797 petition.
9898 SUBCHAPTER C. POWERS AND DUTIES
9999 Sec. 7939A.0301. GENERAL POWERS AND DUTIES. The district
100100 has the powers and duties necessary to accomplish the purposes for
101101 which the district is created.
102102 Sec. 7939A.0302. MUNICIPAL UTILITY DISTRICT POWERS AND
103103 DUTIES. The district has the powers and duties provided by the
104104 general law of this state, including Chapters 49 and 54, Water Code,
105105 applicable to municipal utility districts created under Section 59,
106106 Article XVI, Texas Constitution.
107107 Sec. 7939A.0303. AUTHORITY FOR ROAD PROJECTS. Under
108108 Section 52, Article III, Texas Constitution, the district may
109109 design, acquire, construct, finance, issue bonds for, improve,
110110 operate, maintain, and convey to this state, a county, or a
111111 municipality for operation and maintenance macadamized, graveled,
112112 or paved roads, or improvements, including storm drainage, in aid
113113 of those roads.
114114 Sec. 7939A.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
115115 road project must meet all applicable construction standards,
116116 zoning and subdivision requirements, and regulations of each
117117 municipality in whose corporate limits or extraterritorial
118118 jurisdiction the road project is located.
119119 (b) If a road project is not located in the corporate limits
120120 or extraterritorial jurisdiction of a municipality, the road
121121 project must meet all applicable construction standards,
122122 subdivision requirements, and regulations of each county in which
123123 the road project is located.
124124 (c) If the state will maintain and operate the road, the
125125 Texas Transportation Commission must approve the plans and
126126 specifications of the road project.
127127 Sec. 7939A.0305. COMPLIANCE WITH MUNICIPAL CONSENT
128128 ORDINANCE OR RESOLUTION. The district shall comply with all
129129 applicable requirements of any ordinance or resolution that is
130130 adopted under Section 54.016 or 54.0165, Water Code, and that
131131 consents to the creation of the district or to the inclusion of land
132132 in the district.
133133 Sec. 7939A.0306. DIVISION OF DISTRICT. (a) The district
134134 may be divided into two or more new districts only if the district:
135135 (1) has no outstanding bonded debt; and
136136 (2) is not imposing ad valorem taxes.
137137 (b) This chapter applies to any new district created by the
138138 division of the district, and a new district has all the powers and
139139 duties of the district.
140140 (c) Any new district created by the division of the district
141141 may not, at the time the new district is created, contain any land
142142 outside the area described by Section 2 of the Act enacting this
143143 chapter.
144144 (d) The board, on its own motion or on receipt of a petition
145145 signed by the owner or owners of a majority of the assessed value of
146146 the real property in the district, may adopt an order dividing the
147147 district.
148148 (e) The board may adopt an order dividing the district
149149 before or after the date the board holds an election under Section
150150 7939A.0103 to confirm the district's creation.
151151 (f) An order dividing the district shall:
152152 (1) name each new district;
153153 (2) include the metes and bounds description of the
154154 territory of each new district;
155155 (3) appoint temporary directors for each new district;
156156 and
157157 (4) provide for the division of assets and liabilities
158158 between or among the new districts.
159159 (g) On or before the 30th day after the date of adoption of
160160 an order dividing the district, the district shall file the order
161161 with the commission and record the order in the real property
162162 records of each county in which the district is located.
163163 (h) Any new district created by the division of the district
164164 shall hold a confirmation and directors' election as required by
165165 Section 7939A.0103. If the voters of a new district do not confirm
166166 the creation of the new district, the assets, obligations,
167167 territory, and governance of the new district revert to the
168168 original district.
169169 (i) Municipal consent to the creation of the district and to
170170 the inclusion of land in the district granted under Section
171171 7939A.0104 acts as municipal consent to the creation of any new
172172 district created by the division of the district and to the
173173 inclusion of land in the new district.
174174 (j) Any new district created by the division of the district
175175 must hold an election as required by this chapter to obtain voter
176176 approval before the district may impose a maintenance tax or issue
177177 bonds payable wholly or partly from ad valorem taxes.
178178 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
179179 Sec. 7939A.0401. ELECTIONS REGARDING TAXES OR BONDS. (a)
180180 The district may issue, without an election, bonds and other
181181 obligations secured by:
182182 (1) revenue other than ad valorem taxes; or
183183 (2) contract payments described by Section
184184 7939A.0403.
185185 (b) The district must hold an election in the manner
186186 provided by Chapters 49 and 54, Water Code, to obtain voter approval
187187 before the district may impose an ad valorem tax or issue bonds
188188 payable from ad valorem taxes.
189189 (c) The district may not issue bonds payable from ad valorem
190190 taxes to finance a road project unless the issuance is approved by a
191191 vote of a two-thirds majority of the district voters voting at an
192192 election held for that purpose.
193193 Sec. 7939A.0402. OPERATION AND MAINTENANCE TAX. (a) If
194194 authorized at an election held under Section 7939A.0401, the
195195 district may impose an operation and maintenance tax on taxable
196196 property in the district in accordance with Section 49.107, Water
197197 Code.
198198 (b) The board shall determine the tax rate. The rate may not
199199 exceed the rate approved at the election.
200200 Sec. 7939A.0403. CONTRACT TAXES. (a) In accordance with
201201 Section 49.108, Water Code, the district may impose a tax other than
202202 an operation and maintenance tax and use the revenue derived from
203203 the tax to make payments under a contract after the provisions of
204204 the contract have been approved by a majority of the district voters
205205 voting at an election held for that purpose.
206206 (b) A contract approved by the district voters may contain a
207207 provision stating that the contract may be modified or amended by
208208 the board without further voter approval.
209209 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
210210 Sec. 7939A.0501. AUTHORITY TO ISSUE BONDS AND OTHER
211211 OBLIGATIONS. The district may issue bonds or other obligations
212212 payable wholly or partly from ad valorem taxes, impact fees,
213213 revenue, contract payments, grants, or other district money, or any
214214 combination of those sources, to pay for any authorized district
215215 purpose.
216216 Sec. 7939A.0502. TAXES FOR BONDS. At the time the district
217217 issues bonds payable wholly or partly from ad valorem taxes, the
218218 board shall provide for the annual imposition of a continuing
219219 direct ad valorem tax, without limit as to rate or amount, while all
220220 or part of the bonds are outstanding as required and in the manner
221221 provided by Sections 54.601 and 54.602, Water Code.
222222 Sec. 7939A.0503. BONDS FOR ROAD PROJECTS. At the time of
223223 issuance, the total principal amount of bonds or other obligations
224224 issued or incurred to finance road projects and payable from ad
225225 valorem taxes may not exceed one-fourth of the assessed value of the
226226 real property in the district.
227227 SECTION 2. The Montgomery County Municipal Utility District
228228 No. 208 initially includes all the territory contained in the
229229 following area:
230230 Those four (4) tracts of land described as follows:
231231 (a) CONROE TRACT ONE.
232232 Being forty-seven and nine hundred thirty-two-thousandths
233233 (47.932) acres of land in the James Edwards Survey, A-190,
234234 Montgomery County, Texas, also being a part of the J. W. Spiller
235235 tract in same and being more particularly described by metes and
236236 bounds as follows, to-wit.
237237 Beginning on the South boundary line of White Oak Manor
238238 Subdivision as shown in Volume 9, Page 46, Map Records, and being at
239239 a point S. 61° 32 50" W. 655.3 ft. and N. 76° 32' 45" W. 218.03 ft.
240240 from the most Easterly corner of said Subdivision, an iron pipe for
241241 corner in fence;
242242 Thence N. 76° 32 45" W. 1383.23 ft. along the South line of
243243 White Oak Manor Subdivision to an iron pipe for corner;
244244 Thence S. 13° 27' 15" W. 1094.77 ft. to an iron pipe for
245245 corner;
246246 Thence S. 76° 32' 45" E. 1601.26 ft. to an iron pipe for

248248 Thence N. 61° 32" 50" E. 1371.02 ft to an iron pipe for corner

259259 County, Texas being a portion of that certain tract of land conveyed
260260 to J. W. Spiller and wife by deed recorded in Volume 488, Page 309,
261261 of the deed records of Montgomery County, Texas, said tract of land
262262 being more particularly described by metes and bounds as follows:
263263 Beginning at a 3/4" iron pipe in the North line of the B. D.
264264 Griffin 424.53 acre tract and at the Southwest corner of that
265265 certain tract of land conveyed to W. S. Lampton Jr by deed recorded
266266 in Volume 665, Page 538, for the Southeast corner hereof, from which
267267 a 12" Elm marked X bears N 45° 00' W, 26.8 ft. and a 14" Ash marked X

478478 SECTION 3. (a) The legal notice of the intention to
479479 introduce this Act, setting forth the general substance of this
480480 Act, has been published as provided by law, and the notice and a
481481 copy of this Act have been furnished to all persons, agencies,
482482 officials, or entities to which they are required to be furnished
483483 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
484484 Government Code.
485485 (b) The governor, one of the required recipients, has
486486 submitted the notice and Act to the Texas Commission on
487487 Environmental Quality.
488488 (c) The Texas Commission on Environmental Quality has filed
489489 its recommendations relating to this Act with the governor, the
490490 lieutenant governor, and the speaker of the house of
491491 representatives within the required time.
492492 (d) All requirements of the constitution and laws of this
493493 state and the rules and procedures of the legislature with respect
494494 to the notice, introduction, and passage of this Act are fulfilled
495495 and accomplished.
496496 SECTION 4. (a) If this Act does not receive a two-thirds
497497 vote of all the members elected to each house, Subchapter C, Chapter
498498 7939A, Special District Local Laws Code, as added by Section 1 of
499499 this Act, is amended by adding Section 7939A.0307 to read as
500500 follows:
501501 Sec. 7939A.0307. NO EMINENT DOMAIN POWER. The district may
502502 not exercise the power of eminent domain.
503503 (b) This section is not intended to be an expression of a
504504 legislative interpretation of the requirements of Section 17(c),
505505 Article I, Texas Constitution.
506506 SECTION 5. This Act takes effect September 1, 2021.
