| 7 | 7 | | relating to the submission of an affordability and access report by |

| 8 | 8 | | public institutions of higher education. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 51.4031(a) and (d), Education Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) Not later than November 1 of each year, the chief |
|---|
| 13 | 13 | | executive officer of each institution of higher education, as |
|---|
| 14 | 14 | | defined by Section 61.003, shall provide to the governing board of |
|---|
| 15 | 15 | | the institution and the Texas Higher Education Coordinating Board a |
|---|
| 16 | 16 | | report for the preceding fall, spring, and summer semesters that |
|---|
| 17 | 17 | | examines the affordability and access of the institution. |
|---|
| 18 | 18 | | (d) An institution's report must be in the form prescribed |
|---|
| 19 | 19 | | by the Texas Higher Education Coordinating Board in consultation |
|---|
| 20 | 20 | | with the institution. The coordinating board shall provide a |
|---|
| 21 | 21 | | report received under this section to the governor, the lieutenant |
|---|
| 22 | 22 | | governor, the speaker of the house of representatives, and each |
|---|
| 23 | 23 | | member of the legislature. The coordinating board may provide the |
|---|
| 24 | 24 | | report electronically. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2021. |
