66 AN ACT
77 relating to the use of the school safety allotment for a school
88 district's pandemic preparation and response.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.168, Education Code, as added by
1111 Chapter 464 (S.B. 11), Acts of the 86th Legislature, Regular
1212 Session, 2019, is transferred to Subchapter C, Chapter 48,
1313 Education Code, redesignated as Section 48.115, Education Code, and
1414 amended to conform to changes made by Chapter 943 (H.B. 3), Acts of
1515 the 86th Legislature, Regular Session, 2019, and is further amended
1616 to read as follows:
1717 Sec. 48.115 [42.168]. SCHOOL SAFETY ALLOTMENT. (a) From
1818 funds appropriated for that purpose, the commissioner shall provide
1919 to a school district an annual allotment in the amount provided by
2020 appropriation for each student in average daily attendance.
2121 (b) Funds allocated under this section must be used to
2222 improve school safety and security, including costs associated
2323 with:
2424 (1) securing school facilities, including:
2525 (A) improvements to school infrastructure;
2626 (B) the use or installation of physical barriers;
2727 and
2828 (C) the purchase and maintenance of:
2929 (i) security cameras or other security
3030 equipment; and
3131 (ii) technology, including communications
3232 systems or devices, that facilitates communication and information
3333 sharing between students, school personnel, and first responders in
3434 an emergency;
3535 (2) providing security for the district, including:
3636 (A) employing school district peace officers,
3737 private security officers, and school marshals; and
3838 (B) collaborating with local law enforcement
3939 agencies, such as entering into a memorandum of understanding for
4040 the assignment of school resource officers to schools in the
4141 district;
4242 (3) school safety and security training and planning,
4343 including:
4444 (A) active shooter and emergency response
4545 training;
4646 (B) prevention and treatment programs relating
4747 to addressing adverse childhood experiences; and
4848 (C) the prevention, identification, and
4949 management of emergencies and threats, including:
5050 (i) providing mental health personnel and
5151 support;
5252 (ii) providing behavioral health services;
5353 and
5454 (iii) establishing threat reporting
5555 systems; [and]
5656 (4) providing programs related to suicide prevention,
5757 intervention, and postvention; and
5858 (5) school health and safety efforts relating to
5959 pandemic preparation and response, including:
6060 (A) employing school nurses; and
6161 (B) purchasing:
6262 (i) diagnostic testing equipment; and
6363 (ii) personal protective equipment.
6464 (c) A school district may use funds allocated under this
6565 section for equipment or software that is used for a school safety
6666 and security purpose and an instructional purpose, provided that
6767 the instructional use does not compromise the safety and security
6868 purpose of the equipment or software.
6969 (d) A school district that is required to take action under
7070 Chapter 49 [41] to reduce its local revenue level [wealth per
7171 student] to the [equalized wealth] level established under Section
7272 48.257 is entitled to a credit, in the amount of the allotments to
7373 which the district is to receive as provided by appropriation,
7474 against the total amount required under Section 49.153 [41.093] for
7575 the district to purchase attendance credit [credits].
7676 (e) The commissioner may adopt rules to implement this
7777 section.
7878 SECTION 2. To the extent of any conflict, this Act prevails
7979 over another Act of the 87th Legislature, Regular Session, 2021,
8080 relating to nonsubstantive additions to and corrections in enacted
8181 codes.
8282 SECTION 3. This Act takes effect September 1, 2021.
