66 AN ACT
77 relating to energy efficiency goals for electric utilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 39.905, Utilities Code, is amended by
1010 adding Subsections (a-1) and (a-2) to read as follows:
1111 (a-1) In addition to meeting the demand goals provided by
1212 Subsection (a), each electric utility shall also meet an annual
1313 energy savings goal of:
1414 (1) one-fourth of one percent annual energy savings in
1515 the 2022 calendar year;
1616 (2) one-half of one percent annual energy savings in
1717 the 2023 calendar year;
1818 (3) three-fourths of one percent annual energy savings
1919 in the 2024 calendar year; and
2020 (4) one percent annual energy savings beginning with
2121 the 2025 calendar year.
2222 (a-2) The commission by rule shall provide a method to
2323 establish each utility's annual savings goal under Subsection
2424 (a-1). The method must be based on the existing and expected usage
2525 of electricity delivered in a utility's service area that is
2626 required to pay the annual energy efficiency cost recovery fee. In
2727 adopting rules, the commission may provide for cost caps for the
2828 implementation of Subsection (a-1) and provide good cause
2929 exceptions for a utility that is unable to meet the goal in a
3030 cost-effective manner.
3131 SECTION 2. The Public Utility Commission of Texas shall
3232 adopt rules to implement the changes made by this Act to Section
3333 39.905, Utilities Code, not later than December 31, 2021.
3434 SECTION 3. This Act takes effect September 1, 2021.
