9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 214, Labor Code, is amended by adding | |
11 | 11 | Section 214.0025 to read as follows: | |
12 | 12 | Sec. 214.0025. LIABILITY FOR OBTAINING BENEFITS PAID IN | |
13 | 13 | ERROR. A person who has received benefits to which the person was | |
14 | 14 | not entitled that were paid to the person solely due to commission | |
15 | 15 | error is not liable for the amount of those benefits. The | |
16 | 16 | commission may not seek to recover the amount of those benefits from | |
17 | 17 | the person. | |
18 | 18 | SECTION 2. Section 214.0025, Labor Code, as added by this | |
19 | 19 | Act, applies to benefits paid before, on, or after the effective | |
20 | 20 | date of this Act. | |
21 | 21 | SECTION 3. This Act takes effect immediately if it receives | |
22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
25 | 25 | Act takes effect September 1, 2021. |
