77 relating to liability for obtaining unemployment compensation
88 benefits paid in error.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 214, Labor Code, is amended by adding
1111 Section 214.0025 to read as follows:
1212 Sec. 214.0025. LIABILITY FOR OBTAINING BENEFITS PAID IN
1313 ERROR. A person who has received benefits to which the person was
1414 not entitled that were paid to the person solely due to commission
1515 error is not liable for the amount of those benefits. The
1616 commission may not seek to recover the amount of those benefits from
1717 the person.
1818 SECTION 2. Section 214.0025, Labor Code, as added by this
1919 Act, applies to benefits paid before, on, or after the effective
2020 date of this Act.
2121 SECTION 3. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2021.
