66 AN ACT
77 relating to the pickup and delivery of alcoholic beverages for
88 off-premises consumption.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 28.1001, Alcoholic
1111 Beverage Code, is amended to read as follows:
1212 Sec. 28.1001. PICKUP AND [OFF-PREMISES] DELIVERY OF
1313 ALCOHOLIC BEVERAGES FOR OFF-PREMISES CONSUMPTION.
1414 SECTION 2. Section 28.1001, Alcoholic Beverage Code, is
1515 amended by amending Subsections (a), (c), and (d) and adding
1616 Subsections (a-1), (a-2), and (e) to read as follows:
1717 (a) In this section:
1818 (1) "Passenger area of a motor vehicle" has the
1919 meaning assigned by Section 49.031, Penal Code.
2020 (2) "Tamper-proof container" means a container that,
2121 once sealed, clearly shows whether it has been opened. The term
2222 includes a closed cup or similar container that is:
2323 (A) placed into a bag that has been sealed with a
2424 zip tie or staple;
2525 (B) sealed with shrink wrap or a similar seal; or
2626 (C) sealed by other methods approved by rule of
2727 the commission.
2828 (a-1) Notwithstanding any other provision of this code, the
2929 holder of a mixed beverage permit may deliver, or have delivered by
3030 a third party, including an independent contractor acting under
3131 Chapter 57, an alcoholic beverage from the permitted premises to an
3232 ultimate consumer located off-premises and in an area where the
3333 sale of the beverage is legal if:
3434 (1) the holder of the mixed beverage permit holds a
3535 food and beverage certificate for the permitted premises;
3636 (2) the delivery of the alcoholic beverage is made as
3737 part of the delivery of food prepared at the permitted premises;
3838 (3) the alcoholic beverage is:
3939 (A) a malt beverage [beer, ale,] or wine
4040 delivered in:
4141 (i) an original container sealed by the
4242 manufacturer; or
4343 (ii) a tamper-proof container that is
4444 sealed by the permit holder and clearly labeled with the permit
4545 holder's business name and the words "alcoholic beverage"; or
4646 (B) an alcoholic beverage other than a malt
4747 beverage [beer, ale,] or wine that:
4848 (i) is [,] delivered in an original,
4949 single-serving container sealed by the manufacturer and not larger
5050 than 375 milliliters; or
5151 (ii) the permit holder mixes with other
5252 beverages or garnishes and stores in a tamper-proof container that
5353 is clearly labeled with the permit holder's business name and the
5454 words "alcoholic beverage"; and
5555 (4) the delivery is not made to another [a] premises
5656 that is permitted or licensed under this code.
5757 (a-2) Notwithstanding any other provision of this code, the
5858 holder of a mixed beverage permit may allow an ultimate consumer to
5959 pick up an alcoholic beverage described by Subsection (a-1)(3) and
6060 remove the beverage from the permitted premises if:
6161 (1) the holder of the mixed beverage permit holds a
6262 food and beverage certificate for the permitted premises; and
6363 (2) the pickup of the alcoholic beverage is made as
6464 part of the pickup of food prepared at the permitted premises.
6565 (c) An alcoholic beverage picked up or [may be] delivered
6666 under this section may be provided only to a person who is 21 years
6767 of age or older after the person picking up the alcoholic beverage
6868 or accepting the delivery presents valid proof of identity and age
6969 and:
7070 (1) the person picking up the alcoholic beverage or
7171 accepting the delivery personally signs a receipt, which may be
7272 electronic, acknowledging the pickup or delivery; or
7373 (2) the person providing the beverage for pickup or
7474 making the delivery acknowledges the completion of the pickup or
7575 delivery through a software application.
7676 (d) This section does not authorize the holder of a brewpub
7777 license who also holds a wine and malt beverage [beer] retailer's
7878 permit to deliver alcoholic beverages directly to ultimate
7979 consumers for off-premise consumption at a location other than the
8080 licensed premises.
8181 (e) A person who picks up or delivers an alcoholic beverage
8282 described by Subsection (a-1)(3)(A)(ii) or (a-1)(3)(B)(ii) may not
8383 transport the alcoholic beverage in the passenger area of a motor
8484 vehicle.
8585 SECTION 3. This Act takes effect September 1, 2021.
