55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the repeal of the temporary tax reduction for certain
88 high-cost gas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 81.117(d), Natural Resources Code, is
1111 amended to read as follows:
1212 (d) The exemptions and reductions set out in Sections
1313 201.053, [201.057,] 201.058, and 202.060, Tax Code, do not affect
1414 the fee imposed by this section.
1515 SECTION 2. Section 201.057, Tax Code, is repealed.
1616 SECTION 3. (a) Subject to Subsection (b) of this section,
1717 the change in law made by this Act does not affect tax liability
1818 accruing before the effective date of this Act. That liability
1919 continues in effect as if this Act had not been enacted, and the
2020 former law is continued in effect for the collection of taxes due
2121 and for civil and criminal enforcement of the liability for those
2222 taxes.
2323 (b) The tax reduction provided by Section 201.057, Tax Code,
2424 as repealed by this Act, does not apply to gas produced on or after
2525 the effective date of this Act, regardless of whether the
2626 comptroller approved a tax reduction under Section 201.057 that
2727 would have applied to the gas on or after the effective date of this
2828 Act had Section 201.057 not been repealed.
2929 SECTION 4. This Act takes effect September 1, 2021.
