77 relating to the composition of districts for the election of

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 ARTICLE I
1111 SECTION 1. (a) The members of the State Board of Education
1212 are elected from the districts described by Article II of this Act.
1313 (b) One member is elected from each district established by
1414 this Act.
1515 (c) For purposes of Section 7.104, Education Code, this Act
1616 constitutes a decennial reapportionment.

20282028 Census TIGER/Line Shapefiles, prepared by the federal Bureau of the
20292029 Census for the Twenty-third Decennial Census of the United States,
20302030 enumerated as of April 1, 2010.
20312031 SECTION 2. It is the intent of the legislature that if any
20322032 county, tract, block group, block, or other geographic area has
20332033 erroneously been left out of this Act, a court reviewing this Act
20342034 should include that area in the appropriate district in accordance
20352035 with the intent of the legislature, using any available evidence of
20362036 that intent, including evidence such as that used by the Supreme
20372037 Court of Texas in Smith v. Patterson, 111 Tex. 535, 242 S.W. 749
20382038 (1922).
20392039 SECTION 3. (a) This Act supersedes all previous enactments
20402040 or orders adopting districts for the State Board of Education. All
20412041 previous acts of the legislature adopting districts for the State
20422042 Board of Education are repealed.
20432043 (b) Chapter 72 (H.B. 600), Acts of the 82nd Legislature,
20442044 Regular Session, 2011, is repealed.
20452045 SECTION 4. The districts set out in Article II of this Act
20462046 apply to the election of the members of the State Board of Education
20472047 beginning with the primary and general elections in 2022 for
20482048 members of the board in 2023. This Act does not affect the
20492049 membership or districts of the board before January 1, 2023.
20502050 SECTION 5. This Act takes effect immediately if it receives
20512051 a vote of two-thirds of all the members elected to each house, as
20522052 provided by Section 39, Article III, Texas Constitution. If this
20532053 Act does not receive the vote necessary for immediate effect, this
20542054 Act takes effect September 1, 2021.
