66 AN ACT
77 relating to the licensing and regulation of dog and cat breeders;
88 expanding the applicability of an occupational license; requiring a
99 review of fee amounts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 802.002(8), Occupations Code, is amended
1212 to read as follows:
1313 (8) "Dog or cat breeder" means a person who possesses
1414 five [11] or more adult intact female animals and is engaged in the
1515 business of breeding those animals for direct or indirect sale or
1616 for exchange in return for consideration [and who sells or
1717 exchanges, or offers to sell or exchange, not fewer than 20 animals
1818 in a calendar year].
1919 SECTION 2. Not later than December 1, 2021, the Texas
2020 Commission of Licensing and Regulation shall review the fee amounts
2121 established under Section 802.052, Occupations Code, and adjust the
2222 amount of fees as necessary to ensure the fees are established in
2323 amounts sufficient to cover the costs of administering and
2424 enforcing Chapter 802, Occupations Code.
2525 SECTION 3. Notwithstanding Section 802.002(8), Occupations
2626 Code, as amended by this Act, a dog or cat breeder who possesses
2727 five or more but fewer than 11 adult intact female animals and is
2828 engaged in the business of breeding those animals for direct or
2929 indirect sale or for exchange in return for consideration is not
3030 required to hold a license under Chapter 802, Occupations Code, to
3131 act as a dog or cat breeder before January 1, 2022.
3232 SECTION 4. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2021.
