| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 5(a), Article 11.072, Code of Criminal | |
| 11 | 11 | Procedure, is amended to read as follows: | |
| 12 | 12 | (a) Immediately on filing an application, the applicant | |
| 13 | 13 | shall serve a copy of the application on the attorney representing | |
| 14 | 14 | the state[,] by: | |
| 15 | 15 | (1) [either] certified mail, return receipt | |
| 16 | 16 | requested; | |
| 17 | 17 | (2) [, or] personal service; or | |
| 18 | 18 | (3) secure electronic mail or another form of secure | |
| 19 | 19 | electronic transmission. | |
| 20 | 20 | SECTION 2. The change in law made by this Act applies only | |
| 21 | 21 | to an application for a writ of habeas corpus filed on or after the | |
| 22 | 22 | effective date of this Act. An application filed before the | |
| 23 | 23 | effective date of this Act is governed by the law in effect when the | |
| 24 | 24 | application was filed, and the former law is continued in effect for | |
| 25 | 25 | that purpose. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2021. |
