46 AN ACT
57 relating to the adoption of uniform general conditions for building
68 construction contracts entered into by school districts and the
79 composition of the committee that reviews uniform general
810 conditions.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subchapter B, Chapter 44, Education Code, is
1113 amended by adding Section 44.035 to read as follows:
1214 Sec. 44.035. ADOPTION OF UNIFORM GENERAL CONDITIONS FOR
1315 SCHOOL DISTRICT BUILDING CONSTRUCTION CONTRACTS. After reviewing
1416 the uniform general conditions adopted by the Texas Facilities
1517 Commission under Section 2166.302, Government Code, a school
1618 district may adopt uniform general conditions to be incorporated in
1719 all district building construction contracts.
1820 SECTION 2. Section 2166.305(b), Government Code, is amended
1921 to read as follows:
2022 (b) A committee appointed by the commission shall perform
2123 the review. The committee consists of:
2224 (1) the director of facilities construction and space
2325 management appointed under Section 2152.104, who serves as the
2426 presiding officer of the committee;
2527 (2) six individuals appointed by the commission, one
2628 each from the lists of nominees submitted respectively by the:
2729 (A) president of the Texas Society of Architects;
2830 (B) president of the Texas Society of
2931 Professional Engineers;
3032 (C) presiding officer of the Executive Council of
3133 the Texas Associated General Contractors Chapters;
3234 (D) executive secretary of the Mechanical
3335 Contractors Associations of Texas, Incorporated;
3436 (E) executive secretary of the Texas Building and
3537 Construction Trades Council; and
3638 (F) president of the Associated Builders and
3739 Contractors of Texas;
3840 (3) one individual appointed by the commission
3941 representing an institution of higher education, as defined by
4042 Section 61.003, Education Code;
4143 (4) one individual appointed by the commission
4244 representing a state agency that has a substantial ongoing
4345 construction program;
4446 (5) one individual appointed by the commission
4547 representing the attorney general's office;
4648 (6) one individual appointed by the commission
4749 representing the interests of historically underutilized
4850 businesses; [and]
4951 (7) two individuals appointed by the commission, each
5052 representing a different minority contractors association;
5153 (8) one individual appointed by the commission
5254 representing the Texas Association of School Boards; and
5355 (9) one individual appointed by the commission
5456 representing the Texas Association of School Administrators.
5557 SECTION 3. Not later than December 1, 2021, the Texas
5658 Facilities Commission shall appoint two additional members to the
5759 committee in accordance with Section 2166.305(b), Government Code,
5860 as amended by this Act.
5961 SECTION 4. This Act takes effect immediately if it receives
6062 a vote of two-thirds of all the members elected to each house, as
6163 provided by Section 39, Article III, Texas Constitution. If this
6264 Act does not receive the vote necessary for immediate effect, this
6365 Act takes effect September 1, 2021.
