77 relating to provision of a verified accounting for actions
88 involving foreclosure of a lien on residential real property or
99 recovery on a consumer credit account.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Title 6, Civil Practice and Remedies Code, is
1212 amended by adding Chapter 150B to read as follows:
1313 CHAPTER 150B. REQUIREMENTS FOR ACTIONS INVOLVING CERTAIN DEBTS
1414 Sec. 150B.0001. VERIFIED ACCOUNTING REQUIRED IN CERTAIN
1515 ACTIONS. An applicant for an expedited order allowing foreclosure
1616 of a lien on residential real property under Rule 736, Texas Rules
1717 of Civil Procedure, a petitioner in an action for judicial
1818 foreclosure of a lien on residential real property, or a claimant
1919 seeking recovery in an action on a consumer credit account must file
2020 with the application, petition, or pleading a verified accounting
2121 of:
2222 (1) the balance due on the account;
2323 (2) each payment made on the account; and
2424 (3) the total and final principal amount on the
2525 account.
2626 SECTION 2. Section 150B.0001, Civil Practice and Remedies
2727 Code, as added by this Act, applies only to an action that commences
2828 on or after the effective date of this Act.
2929 SECTION 3. This Act takes effect September 1, 2021.
