| 7 | 7 | | relating to the determination of student priority in awarding TEXAS |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 56.303(d-1) and (f), Education Code, |
|---|
| 11 | 11 | | are amended to read as follows: |
|---|
| 12 | 12 | | (d-1) In allocating among eligible institutions money |
|---|
| 13 | 13 | | available for initial TEXAS grants for an academic year, the |
|---|
| 14 | 14 | | coordinating board shall ensure that each of those institutions' |
|---|
| 15 | 15 | | proportional share of the total amount of money for initial grants |
|---|
| 16 | 16 | | that is allocated to eligible institutions under this section for |
|---|
| 17 | 17 | | that year does not, as a result of the number of students who |
|---|
| 18 | 18 | | establish eligibility at the institution for an initial grant |
|---|
| 19 | 19 | | awarded under the highest priority as described by Subsection (f) |
|---|
| 20 | 20 | | [under Section 56.3041(2)(A)], change from the institution's |
|---|
| 21 | 21 | | proportional share of the total amount of money for initial grants |
|---|
| 22 | 22 | | that is allocated to those institutions under this section for the |
|---|
| 23 | 23 | | preceding academic year. |
|---|
| 24 | 24 | | (f) Beginning with TEXAS grants awarded for the 2013-2014 |
|---|
| 25 | 25 | | academic year, in determining who should receive an initial TEXAS |
|---|
| 26 | 26 | | grant, each eligible institution, in addition to giving priority as |
|---|
| 27 | 27 | | provided by Subsection (e), shall give highest priority equally to |
|---|
| 28 | 28 | | students who meet the eligibility criteria described by Sections |
|---|
| 29 | 29 | | 56.3041(a)(2)(A) and (C) [Section 56.3041(2)(A)]. If there is money |
|---|
| 30 | 30 | | available in excess of the amount required to award an initial TEXAS |
|---|
| 31 | 31 | | grant to all students meeting those criteria, an eligible |
|---|
| 32 | 32 | | institution shall make awards to other students who meet the |
|---|
| 33 | 33 | | eligibility criteria described by Section 56.304(a)(2)(A), |
|---|
| 34 | 34 | | provided that the institution continues to give priority to |
|---|
| 35 | 35 | | students as provided by Subsection (e). |
|---|
| 36 | 36 | | SECTION 2. The changes in law made by this Act apply |
|---|
| 37 | 37 | | beginning with initial TEXAS grants awarded for the 2022 fall |
|---|
| 38 | 38 | | semester. Initial TEXAS grants awarded for a semester or term |
|---|
| 39 | 39 | | before the 2022 fall semester are governed by the applicable law in |
|---|
| 40 | 40 | | effect immediately before the effective date of this Act, and the |
|---|
| 41 | 41 | | former law is continued in effect for that purpose. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2021. |
