55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the determination of student priority in awarding TEXAS
88 grants.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 56.303(d-1) and (f), Education Code,
1111 are amended to read as follows:
1212 (d-1) In allocating among eligible institutions money
1313 available for initial TEXAS grants for an academic year, the
1414 coordinating board shall ensure that each of those institutions'
1515 proportional share of the total amount of money for initial grants
1616 that is allocated to eligible institutions under this section for
1717 that year does not, as a result of the number of students who
1818 establish eligibility at the institution for an initial grant
1919 awarded under the highest priority as described by Subsection (f)
2020 [under Section 56.3041(2)(A)], change from the institution's
2121 proportional share of the total amount of money for initial grants
2222 that is allocated to those institutions under this section for the
2323 preceding academic year.
2424 (f) Beginning with TEXAS grants awarded for the 2013-2014
2525 academic year, in determining who should receive an initial TEXAS
2626 grant, each eligible institution, in addition to giving priority as
2727 provided by Subsection (e), shall give highest priority equally to
2828 students who meet the eligibility criteria described by Sections
2929 56.3041(a)(2)(A) and (C) [Section 56.3041(2)(A)]. If there is money
3030 available in excess of the amount required to award an initial TEXAS
3131 grant to all students meeting those criteria, an eligible
3232 institution shall make awards to other students who meet the
3333 eligibility criteria described by Section 56.304(a)(2)(A),
3434 provided that the institution continues to give priority to
3535 students as provided by Subsection (e).
3636 SECTION 2. The changes in law made by this Act apply
3737 beginning with initial TEXAS grants awarded for the 2022 fall
3838 semester. Initial TEXAS grants awarded for a semester or term
3939 before the 2022 fall semester are governed by the applicable law in
4040 effect immediately before the effective date of this Act, and the
4141 former law is continued in effect for that purpose.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2021.
