| 7 | 7 | | relating to matching private grants given to enhance additional |

| 8 | 8 | | research activities at public institutions of higher education. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 62.123(a), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) An eligible institution that receives gifts or |
|---|
| 13 | 13 | | endowments from private sources in a state fiscal year for the |
|---|
| 14 | 14 | | purpose of enhancing research activities at the institution, |
|---|
| 15 | 15 | | including a gift or endowment for endowed chairs, professorships, |
|---|
| 16 | 16 | | facilities, equipment, program costs, graduate stipends or |
|---|
| 17 | 17 | | fellowships, or undergraduate research, is entitled to receive, out |
|---|
| 18 | 18 | | of funds appropriated for the purposes of the program for that |
|---|
| 19 | 19 | | fiscal year, a matching grant in an amount determined according to |
|---|
| 20 | 20 | | the following rates: |
|---|
| 21 | 21 | | (1) 50 percent of the amount of the gifts and |
|---|
| 22 | 22 | | endowments, if the total amount of gifts and endowments is $100,000 |
|---|
| 23 | 23 | | or more but not more than $999,999; |
|---|
| 24 | 24 | | (2) 75 percent of the amount of the gifts and |
|---|
| 25 | 25 | | endowments, if the total amount of gifts and endowments is $1 |
|---|
| 26 | 26 | | million or more but not more than $1,999,999; or |
|---|
| 27 | 27 | | (3) 100 percent of the amount of the gifts and |
|---|
| 28 | 28 | | endowments, if: |
|---|
| 29 | 29 | | (A) the total amount of gifts and endowments is |
|---|
| 30 | 30 | | $2 million or more; or |
|---|
| 31 | 31 | | (B) the research activities to be enhanced |
|---|
| 32 | 32 | | include, at a level determined by coordinating board rule, research |
|---|
| 33 | 33 | | occurring in any of the following areas: |
|---|
| 34 | 34 | | (i) epidemiology; |
|---|
| 35 | 35 | | (ii) methods of diagnostic medical testing; |
|---|
| 36 | 36 | | (iii) methods of medical treatment; |
|---|
| 37 | 37 | | (iv) the development or delivery of medical |
|---|
| 38 | 38 | | assistive technology or devices; or |
|---|
| 39 | 39 | | (v) the development or delivery of |
|---|
| 40 | 40 | | pharmaceuticals or vaccines. |

| 41 | 41 | | SECTION 2. This Act takes effect September 1, 2021. |
