| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 315, Local Government Code, is amended |
|---|
| 12 | 12 | | by adding Section 315.007 to read as follows: |
|---|
| 13 | 13 | | Sec. 315.007. PRESERVATION OF HISTORIC AND CULTURALLY |
|---|
| 14 | 14 | | SIGNIFICANT STRUCTURES IN CERTAIN MUNICIPALITIES. (a) A |
|---|
| 15 | 15 | | municipality to which Section 211.0165 does not apply may adopt and |
|---|
| 16 | 16 | | enforce an ordinance, order, or other regulation whose primary |
|---|
| 17 | 17 | | purpose is to protect or maintain historic or culturally |
|---|
| 18 | 18 | | significant structures. |
|---|
| 19 | 19 | | (b) A regulation under this section is not considered a |
|---|
| 20 | 20 | | zoning regulation for the purposes of Chapter 211 or other law, |
|---|
| 21 | 21 | | including a municipal charter, regardless of whether the regulation |
|---|
| 22 | 22 | | designates specific districts or other areas in the municipality. |

| 23 | 23 | | SECTION 2. Section 315.007, Local Government Code, as added |
|---|
| 24 | 24 | | by this Act, is intended only to clarify existing law with respect |
|---|
| 25 | 25 | | to the regulation of historic or culturally significant structures |
|---|
| 26 | 26 | | by certain municipalities. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2021. |
