| 10 | 10 | SECTION 1. The heading to Section 320.0455, Local | |
| 11 | 11 | Government Code, is amended to read as follows: | |
| 12 | 12 | Sec. 320.0455. RULES IN CERTAIN COUNTIES [A POPULOUS | |
| 13 | 13 | COUNTY]; PENALTY FOR VIOLATIONS. | |
| 14 | 14 | SECTION 2. Section 320.0455, Local Government Code, is | |
| 15 | 15 | amended by amending Subsections (a) and (b) and adding Subsection | |
| 16 | 16 | (b-1) to read as follows: | |
| 17 | 17 | (a) This section applies only to a county with a population | |
| 18 | 18 | of: | |
| 19 | 19 | (1) [a county with a population of] 2.8 million or | |
| 20 | 20 | more; [and] | |
| 21 | 21 | (2) 580,000 or more that is adjacent to a county with a | |
| 22 | 22 | population of 2.8 million or more; or | |
| 23 | 23 | (3) [a county with a population of] more than 410,000 | |
| 24 | 24 | and less than 455,000. | |
| 25 | 25 | (b) Except as provided by Subsection (b-1), and subject | |
| 26 | 26 | [Subject] to the approval of the commissioners court, the board may | |
| 27 | 27 | adopt reasonable rules concerning the use of any park administered | |
| 28 | 28 | by the board. | |
| 29 | 29 | (b-1) A board created for a county described by Subsection | |
| 30 | 30 | (a)(2) may not adopt rules relating to the use of fireworks. | |
| 31 | 31 | SECTION 3. This Act takes effect September 1, 2021. |
