55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prohibited distribution of flavored cigarettes,
88 e-cigarettes, and tobacco products; providing a civil penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 161, Health and Safety Code, is amended
1111 by adding Subchapter I to read as follows:
1212 SUBCHAPTER I. FLAVORED CIGARETTES, E-CIGARETTES, AND
1313 TOBACCO PRODUCTS
1414 Sec. 161.095. DEFINITIONS. In this subchapter:
1515 (1) "Cigarette" has the meaning assigned by Section
1616 154.001, Tax Code.
1717 (2) "E-cigarette" has the meaning assigned by Section
1818 161.081.
1919 (3) "Hookah" means a type of water pipe with a long
2020 flexible tube for drawing aerosol through water and used to smoke
2121 shisha tobacco products or other tobacco products.
2222 (4) "Loose leaf tobacco" means cut or shredded pipe
2323 tobacco that is usually sold in a pouch. The term does not include
2424 tobacco product that, because of its appearance, type, packaging,
2525 or labeling, is suitable for use and likely to be offered to or
2626 purchased by a consumer as tobacco for making cigarettes.
2727 (5) "Premium cigar" means any cigar that:
2828 (A) is handmade;
2929 (B) is capped by hand;
3030 (C) is not mass produced by a machine;
3131 (D) has a wrapper made entirely from whole leaf
3232 tobacco;
3333 (E) has a wholesale price of not less than $12;
3434 and
3535 (F) does not have a filter, tip, or nontobacco
3636 mouthpiece.
3737 (6) "Shisha tobacco product" means a tobacco product
3838 smoked or intended to be smoked in a hookah.
3939 (7) "Tobacco product" has the meaning assigned by
4040 Section 155.001, Tax Code.
4141 Sec. 161.096. APPLICABILITY OF SUBCHAPTER. This subchapter
4242 does not apply to:
4343 (1) a shisha tobacco product that imparts a
4444 distinguishable taste or aroma other than the taste or aroma of
4545 tobacco by a person who is engaged in the retail sale of shisha
4646 tobacco products, hookahs, and hookah smoking accessories;
4747 (2) a premium cigar; or
4848 (3) loose leaf tobacco.
4949 Sec. 161.097. PROHIBITED DISTRIBUTION OF FLAVORED
5050 CIGARETTES, E-CIGARETTES, OR TOBACCO PRODUCTS. A person may not
5151 sell, give, or cause to be sold or given a cigarette, e-cigarette,
5252 or tobacco product with a distinguishable taste or aroma other than
5353 the taste or aroma of tobacco, including the aroma or taste of:
5454 (1) an alcoholic beverage;
5555 (2) candy;
5656 (3) chocolate or vanilla;
5757 (4) fruit;
5858 (5) an herb or spice;
5959 (6) honey;
6060 (7) menthol; or
6161 (8) mint or wintergreen.
6262 Sec. 161.098. CIVIL PENALTY. (a) A person who violates
6363 Section 161.097 is liable to this state for a civil penalty of $250
6464 for each violation.
6565 (b) The attorney general may sue to collect the penalty.
6666 (c) The attorney general shall file an action under this
6767 section in a district court in Travis County or the county in which
6868 the violation occurred.
6969 (d) The attorney general may recover reasonable expenses
7070 incurred in obtaining a civil penalty under this section, including
7171 court costs, reasonable attorney's fees, investigative costs,
7272 witness fees, and deposition expenses.
7373 SECTION 2. This Act takes effect September 1, 2021.
