5	7		relating to mental health services development plans as updated by
6	8		the Health and Human Services Commission and local mental health
7	9		authority groups.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Subchapter B, Chapter 531, Government Code, is
10	12		amended by adding Section 531.0222 to read as follows:
11	13		Sec. 531.0222. LOCAL MENTAL HEALTH AUTHORITY GROUP REGIONAL
12	14		PLANNING. (a) In this section, "local mental health authority
13	15		group" means a group of local mental health authorities established
14	16		by the commission under Chapter 963 (S.B. 633), Acts of the 86th
15	17		Legislature, Regular Session, 2019.
16	18		(b) The commission shall require each local mental health
17	19		authority group to meet at least quarterly to collaborate on
18	20		planning and implementing regional strategies to reduce:
19	21		(1) costs to local governments of providing services
20	22		to persons experiencing a mental health crisis;
21	23		(2) transportation to mental health facilities of
22	24		persons served by an authority that is a member of the group;
23	25		(3) incarceration of persons with mental illness in
24	26		county jails that are located in an area served by an authority that
25	27		is a member of the group; and
26	28		(4) visits by persons with mental illness at hospital
27	29		emergency rooms located in an area served by an authority that is a
28	30		member of the group.
29	31		(c) The commission shall use federal funds in accordance
30	32		with state and federal guidelines to implement this section.
31	33		(d) The commission, in coordination with each local mental
32	34		health authority group, shall annually update the mental health
33	35		services development plan that was initially developed by the
34	36		commission and each local mental health authority group under
35	37		Chapter 963 (S.B. 633), Acts of the 86th Legislature, Regular
36	38		Session, 2019. The commission and each group's updated plan must
37	39		include a description of:
38	40		(1) actions taken by the group to implement regional
39	41		strategies in the plan; and
40	42		(2) new regional strategies identified by the group to
41	43		reduce the circumstances described by Subsection (b), including the
42	44		estimated number of outpatient and inpatient beds necessary to meet
43	45		the goals of each group's regional strategy.
44	46		(e) Not later than December 1 of each year, the commission
45	47		shall produce and publish on its Internet website a report
46	48		containing the most recent version of each mental health services
47	49		development plan developed by the commission and a local mental
48	50		health authority group.
49	51		SECTION 2. Notwithstanding Section 531.0222, Government
50	52		Code, as added by this Act, a local mental health authority group
51	53		and the Health and Human Services Commission are not required to
52	54		produce or publish a report required by that section before
53	55		December 1, 2022.
54	56		SECTION 3. This Act takes effect immediately if it receives
55	57		a vote of two-thirds of all the members elected to each house, as
56	58		provided by Section 39, Article III, Texas Constitution. If this
57	59		Act does not receive the vote necessary for immediate effect, this
58	60		Act takes effect on the 91st day after the last day of the
59	61		legislative session.
