46 AN ACT
57 relating to the donation of juror reimbursements.
68 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
79 SECTION 1. Sections 61.003(a) and (c), Government Code, are
810 amended to read as follows:
911 (a) Each person who reports for jury service shall be
1012 personally provided a form letter that when signed by the person
1113 directs the county treasurer to donate all, or a specific amount
1214 designated by the person, of the person's daily reimbursement under
1315 this chapter to:
1416 (1) the compensation to victims of crime fund
1517 established under Subchapter J, Chapter 56B, Code of Criminal
1618 Procedure;
1719 (2) the child welfare, child protective services, or
1820 child services board of the county appointed under Section 264.005,
1921 Family Code, that serves abused and neglected children;
2022 (3) any program selected by the commissioners court
2123 that is operated by a public or private nonprofit organization and
2224 that provides shelter and services to victims of family violence;
2325 (4) any other program approved by the commissioners
2426 court of the county, including a program established under Article
2527 56A.205, Code of Criminal Procedure, that offers psychological
2628 counseling in criminal cases involving graphic evidence or
2729 testimony; [or]
2830 (5) a veterans court program established by the
2931 commissioners court as provided by Chapter 124; or
3032 (6) a veterans county service office established by
3133 the commissioners court as provided by Subchapter B, Chapter 434.
3234 (c) The county treasurer shall:
3335 (1) send all donations made under Subsection (a)(1) to
3436 the comptroller, at the time and in the manner prescribed by the
3537 attorney general, for deposit to the credit of the compensation to
3638 victims of crime fund;
3739 (2) deposit donations made to the county child welfare
3840 board under Subsection (a)(2) in a fund established by the county to
3941 be used by the child welfare board in a manner authorized by the
4042 commissioners court of the county; and
4143 (3) send all donations made under Subsection (a)(3),
4244 [or] (a)(4), or (a)(6) directly to the program or office, as
4345 applicable, specified on the form letter signed by the person who
4446 reported for jury service.
4547 SECTION 2. Section 434.032, Government Code, is amended by
4648 adding Subsection (c) to read as follows:
4749 (c) The commissioners court of a county that maintains an
4850 office:
4951 (1) may not consider a juror's donation to the office
5052 of the juror's daily reimbursement under Section 61.003 for
5153 purposes of determining the county's budget for the office; and
5254 (2) may use donations described by Subdivision (1)
5355 only to supplement, rather than supplant, amounts budgeted by the
5456 county for the office.
5557 SECTION 3. This Act takes effect September 1, 2021.
