7 | 7 | relating to the sale, lease, or rental of goods and services through | |
8 | 8 | a post exchange established by the Texas Military Department. | |
9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 437.110(a), Government Code, as | |
11 | 11 | effective September 1, 2021, is amended to read as follows: | |
12 | 12 | (a) The department may establish and contract for the | |
13 | 13 | operation of not more than three military-type post exchanges | |
14 | 14 | similar to those operated by the armed forces of the United States | |
15 | 15 | on any real property under the management and control of the | |
16 | 16 | department. A post exchange may sell, lease, or rent all goods and | |
17 | 17 | services that may be sold by a store operated under the federal | |
18 | 18 | exchange system established in accordance with 10 U.S.C. Section | |
19 | 19 | 2481(a)[, including firearms, tobacco products, prepared foods, | |
20 | 20 | and malt beverages and wine but not distilled spirits]. The | |
21 | 21 | department may designate facilities located on state property to | |
22 | 22 | use for purposes of this section. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2021. |
