66 AN ACT
77 relating to a seller's disclosure of the location of certain real
88 property in a floodplain.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 5, Property Code, is
1111 amended by adding Section 5.020 to read as follows:
1212 Sec. 5.020. SELLER'S DISCLOSURE OF LOCATION OF CERTAIN REAL
1313 PROPERTY IN FLOODPLAIN. (a) A seller of a tract of real property
1414 that measures less than 15 acres and that does not have a residence
1515 located or being constructed on the property at the time of the sale
1616 shall provide to the purchaser of the property a written notice
1717 disclosing whether any part of the property is located in a
1818 floodplain. If any part of the property is located in a floodplain,
1919 the notice must include a copy of a current elevation certificate,
2020 topographical survey, plat, or flood map that indicates the part of
2121 the property that is located in the floodplain.
2222 (b) The notice must be delivered by the seller on or before
2323 the effective date of an executory contract binding the purchaser
2424 to purchase the property.
2525 (c) The purchaser is entitled to recover from the seller
2626 damages caused by flooding on any part of the purchased real
2727 property that is located in a floodplain if:
2828 (1) the seller fails to provide the purchaser the
2929 notice required by this section; and
3030 (2) the flooding occurs before the fifth anniversary
3131 of the date of the purchase.
3232 SECTION 2. This Act takes effect September 1, 2021.
