44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the regulation of dyslexia practitioners and
77 therapists.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 403.151, Occupations Code, is amended by
1010 adding Subsection (a-1) to read as follows:
1111 (a-1) Notwithstanding Subsection (a), a licensed dyslexia
1212 practitioner may practice outside of an educational setting to the
1313 extent necessary to provide a service that would otherwise be
1414 provided in an educational setting that is not reasonably
1515 accessible to the licensed dyslexia practitioner or client.
1616 SECTION 2. Subchapter D, Chapter 403, Occupations Code, is
1717 amended by adding Section 403.153 to read as follows:
1818 Sec. 403.153. USE OF TELECOMMUNICATIONS TECHNOLOGY.
1919 Notwithstanding any other law, a license holder may provide any
2020 service, including conducting an initial meeting with a client,
2121 solely through the use of an interactive audiovisual communication
2222 system, whether real-time or two-way, including a smartphone.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, the
2727 Act takes effect September 1, 2021.
