6 | 6 | | relating to the regulation of dyslexia practitioners and |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 403.151, Occupations Code, is amended by |
---|
10 | 10 | | adding Subsection (a-1) to read as follows: |
---|
11 | 11 | | (a-1) Notwithstanding Subsection (a), a licensed dyslexia |
---|
12 | 12 | | practitioner may practice outside of an educational setting to the |
---|
13 | 13 | | extent necessary to provide a service that would otherwise be |
---|
14 | 14 | | provided in an educational setting that is not reasonably |
---|
15 | 15 | | accessible to the licensed dyslexia practitioner or client. |

16 | 16 | | SECTION 2. Subchapter D, Chapter 403, Occupations Code, is |
---|
17 | 17 | | amended by adding Section 403.153 to read as follows: |

18 | 18 | | Sec. 403.153. USE OF TELECOMMUNICATIONS TECHNOLOGY. |
---|
19 | 19 | | Notwithstanding any other law, a license holder may provide any |
---|
20 | 20 | | service, including conducting an initial meeting with a client, |
---|
21 | 21 | | solely through the use of an interactive audiovisual communication |
---|
22 | 22 | | system, whether real-time or two-way, including a smartphone. |
---|
23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
---|
24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
---|
25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
26 | 26 | | Act does not receive the vote necessary for immediate effect, the |
---|
27 | 27 | | Act takes effect September 1, 2021. |
