66 AN ACT
77 relating to the practice of dentistry and the provision of
88 teledentistry dental services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 111, Occupations Code, is
1111 amended to read as follows:
1212 CHAPTER 111. TELEMEDICINE, TELEDENTISTRY, AND TELEHEALTH
1313 SECTION 2. Section 111.001, Occupations Code, is amended by
1414 amending Subdivisions (1) and (3) and adding Subdivision (2-a) to
1515 read as follows:
1616 (1) "Dentist," "health [Health] professional," and
1717 "physician" have the meanings assigned by Section 1455.001,
1818 Insurance Code.
1919 (2-a) "Teledentistry dental service" means a health
2020 care service delivered by a dentist, or a health professional
2121 acting under the delegation and supervision of a dentist, acting
2222 within the scope of the dentist's or health professional's license
2323 or certification to a patient at a different physical location than
2424 the dentist or health professional using telecommunications or
2525 information technology.
2626 (3) "Telehealth service" means a health service, other
2727 than a telemedicine medical service or a teledentistry dental
2828 service, delivered by a health professional licensed, certified, or
2929 otherwise entitled to practice in this state and acting within the
3030 scope of the health professional's license, certification, or
3131 entitlement to a patient at a different physical location than the
3232 health professional using telecommunications or information
3333 technology.
3434 SECTION 3. Section 111.002, Occupations Code, is amended to
3535 read as follows:
3636 Sec. 111.002. INFORMED CONSENT. (a) A treating physician,
3737 dentist, or health professional who provides or facilitates the use
3838 of telemedicine medical services, teledentistry dental services,
3939 or telehealth services shall ensure that the informed consent of
4040 the patient, or another appropriate individual authorized to make
4141 health care treatment decisions for the patient, is obtained before
4242 telemedicine medical services, teledentistry dental services, or
4343 telehealth services are provided.
4444 (b) A dentist who delegates a teledentistry dental service
4545 shall ensure that the informed consent of the patient includes
4646 disclosure to the patient that the dentist has delegated the
4747 service.
4848 SECTION 4. Section 111.003, Occupations Code, is amended to
4949 read as follows:
5050 Sec. 111.003. CONFIDENTIALITY. A treating physician,
5151 dentist, or health professional who provides or facilitates the use
5252 of telemedicine medical services, teledentistry dental services,
5353 or telehealth services shall ensure that the confidentiality of the
5454 patient's clinical [medical] information is maintained as required
5555 by Chapter 159, by Subchapter C, Chapter 258, or by other applicable
5656 law.
5757 SECTION 5. Section 111.004, Occupations Code, is amended
5858 to read as follows:
5959 Sec. 111.004. RULES. (a) The Texas Medical Board, in
6060 consultation with the commissioner of insurance, as appropriate,
6161 may adopt rules necessary to:
6262 (1) ensure that patients using telemedicine medical
6363 services receive appropriate, quality care;
6464 (2) prevent abuse and fraud in the use of telemedicine
6565 medical services, including rules relating to the filing of claims
6666 and records required to be maintained in connection with
6767 telemedicine medical services;
6868 (3) ensure adequate supervision of health
6969 professionals who are not physicians and who provide telemedicine
7070 medical services; and
7171 (4) establish the maximum number of health
7272 professionals who are not physicians that a physician may supervise
7373 through a telemedicine medical service.
7474 (b) The State Board of Dental Examiners, in consultation
7575 with the commissioner of insurance, as appropriate, may adopt rules
7676 necessary to:
7777 (1) ensure that patients using teledentistry dental
7878 services receive appropriate, quality care;
7979 (2) prevent abuse and fraud in the use of
8080 teledentistry dental services, including rules relating to the
8181 filing of claims and records required to be maintained in
8282 connection with teledentistry dental services;
8383 (3) ensure adequate supervision of health
8484 professionals who are not dentists and who provide teledentistry
8585 dental services under the delegation and supervision of a dentist;
8686 and
8787 (4) establish the maximum number of health
8888 professionals who are not dentists that a dentist may supervise
8989 through a teledentistry dental service.
9090 SECTION 6. The heading to Section 111.005, Occupations
9191 Code, is amended to read as follows:
9292 Sec. 111.005. PRACTITIONER-PATIENT RELATIONSHIP FOR
9393 TELEMEDICINE MEDICAL SERVICES OR TELEDENTISTRY DENTAL SERVICES.
9494 SECTION 7. Section 111.005, Occupations Code, is amended by
9595 amending Subsections (a) and (b) and adding Subsection (d) to read
9696 as follows:
9797 (a) For purposes of Section 562.056, a valid
9898 practitioner-patient relationship is present between a
9999 practitioner providing a telemedicine medical service or a
100100 teledentistry dental service and a patient receiving the
101101 [telemedicine medical] service as long as the practitioner complies
102102 with the standard of care described in Section 111.007 and the
103103 practitioner:
104104 (1) has a preexisting practitioner-patient
105105 relationship with the patient established in accordance with rules
106106 adopted under Section 111.006;
107107 (2) communicates, regardless of the method of
108108 communication, with the patient pursuant to a call coverage
109109 agreement established in accordance with:
110110 (A) Texas Medical Board rules with a physician
111111 requesting coverage of medical care for the patient; or
112112 (B) State Board of Dental Examiners rules with a
113113 dentist requesting coverage of dental care for the patient; or
114114 (3) provides the telemedicine medical services or
115115 teledentistry dental services through the use of one of the
116116 following methods, as long as the practitioner complies with the
117117 follow-up requirements in Subsection (b), and the method allows the
118118 practitioner to have access to, and the practitioner uses, the
119119 relevant clinical information that would be required in accordance
120120 with the standard of care described in Section 111.007:
121121 (A) synchronous audiovisual interaction between
122122 the practitioner and the patient in another location;
123123 (B) asynchronous store and forward technology,
124124 including asynchronous store and forward technology in conjunction
125125 with synchronous audio interaction between the practitioner and the
126126 patient in another location, as long as the practitioner uses
127127 clinical information from:
128128 (i) clinically relevant photographic or
129129 video images, including diagnostic images; or
130130 (ii) the patient's relevant clinical
131131 [medical] records, such as the relevant medical or dental history,
132132 laboratory and pathology results, and prescriptive histories; or
133133 (C) another form of audiovisual
134134 telecommunication technology that allows the practitioner to
135135 comply with the standard of care described in Section 111.007.
136136 (b) A practitioner who provides telemedicine medical
137137 services or teledentistry dental services to a patient as described
138138 in Subsection (a)(3) shall:
139139 (1) provide the patient with guidance on appropriate
140140 follow-up care; and
141141 (2) except as provided by Subsection (d), if the
142142 patient consents and the patient has a primary care physician or a
143143 regular dentist, provide to the patient's primary care physician or
144144 regular dentist, as appropriate, within 72 hours after the
145145 practitioner provides the services to the patient, a clinical
146146 [medical] record or other report containing an explanation of:
147147 (A) the treatment provided by the practitioner to
148148 the patient; and
149149 (B) as authorized by the law under which the
150150 practitioner is licensed, certified, or otherwise permitted to
151151 provide the service, the practitioner's evaluation, analysis, or
152152 diagnosis[, as appropriate,] of the patient's condition.
153153 (d) This subsection applies only to a teledentistry dental
154154 service consisting of a digital three-dimensional scan of the
155155 patient that does not affect the hard or soft tissues of the oral
156156 cavity and that is performed at a location other than the dentist's
157157 location. A practitioner providing a treatment based on a
158158 teledentistry dental service to which this subsection applies is
159159 not required to comply with Subsection (b)(2) but shall, on request
160160 of the patient, provide to the patient the record or report
161161 described by that subdivision after the patient has completed the
162162 treatment.
163163 SECTION 8. Section 111.006, Occupations Code, is amended by
164164 adding Subsection (c) to read as follows:
165165 (c) The State Board of Dental Examiners and the Texas State
166166 Board of Pharmacy shall jointly adopt rules that establish the
167167 determination of a valid prescription in accordance with Section
168168 111.005. Rules adopted under this subsection must allow for the
169169 establishment of a practitioner-patient relationship by a
170170 teledentistry dental service provided by a dentist to a patient in a
171171 manner that complies with Section 111.005(a)(3) and must be
172172 substantially similar to the rules adopted under Subsection (a) of
173173 this section. The State Board of Dental Examiners and the Texas
174174 State Board of Pharmacy shall jointly develop and publish on each
175175 respective board's Internet website responses to frequently asked
176176 questions relating to the determination of a valid prescription
177177 issued in the course of the provision of teledentistry dental
178178 services.
179179 SECTION 9. Section 111.007, Occupations Code, is amended to
180180 read as follows:
181181 Sec. 111.007. STANDARD OF CARE FOR TELEMEDICINE MEDICAL
182182 SERVICES, TELEDENTISTRY DENTAL SERVICES, AND TELEHEALTH SERVICES.
183183 (a) A health professional providing a health care service or
184184 procedure as a telemedicine medical service, a teledentistry dental
185185 service, or a telehealth service is subject to the standard of care
186186 that would apply to the provision of the same health care service or
187187 procedure in an in-person setting.
188188 (b) An agency with regulatory authority over a health
189189 professional may not adopt rules pertaining to telemedicine medical
190190 services, teledentistry dental services, or telehealth services
191191 that would impose a higher standard of care than the standard
192192 described in Subsection (a).
193193 SECTION 10. Chapter 111, Occupations Code, is amended by
194194 adding Section 111.0075 to read as follows:
195195 Sec. 111.0075. LICENSING FOR TELEDENTISTRY DENTAL
196196 SERVICES. A health professional providing a health care service or
197197 procedure as a teledentistry dental service is subject to the
198198 licensing requirements that would apply to the provision of the
199199 same health care service or procedure in an in-person setting.
200200 SECTION 11. Chapter 111, Occupations Code, is amended by
201201 adding Section 111.009 to read as follows:
202202 Sec. 111.009. LIMITATION ON CERTAIN PRESCRIPTIONS. (a) In
203203 this section, "controlled substance" and "prescribe" have the
204204 meanings assigned by Section 481.002, Health and Safety Code.
205205 (b) The State Board of Dental Examiners by rule shall
206206 establish limits on the quantity of a controlled substance that a
207207 dentist may prescribe to a patient as a teledentistry dental
208208 service. The rules may not authorize a dentist to prescribe more
209209 than a five-day supply of the controlled substance.
210210 SECTION 12. Section 251.003, Occupations Code, is amended
211211 by adding Subsection (d) to read as follows:
212212 (d) For purposes of this subtitle, a person located in
213213 another state practices dentistry in this state and is required to
214214 hold a license to practice dentistry in this state if the person
215215 through the use of any medium, including an electronic medium,
216216 performs an act that constitutes the practice of dentistry on a
217217 patient in this state.
218218 SECTION 13. Chapter 254, Occupations Code, is amended by
219219 adding Section 254.0035 to read as follows:
220220 Sec. 254.0035. RULES REGARDING CALL COVERAGE AGREEMENTS.
221221 The board shall adopt rules governing a call coverage agreement
222222 between dentists.
223223 SECTION 14. Section 258.001, Occupations Code, is amended
224224 to read as follows:
225225 Sec. 258.001. IMPERMISSIBLE DELEGATIONS. A dentist may not
226226 delegate:
227227 (1) an act to an individual who, by board order, is
228228 prohibited from performing the act;
229229 (2) any of the following acts to a person not licensed
230230 as a dentist or dental hygienist:
231231 (A) the removal of calculus, deposits, or
232232 accretions from the natural and restored surfaces of exposed human
233233 teeth and restorations in the human mouth;
234234 (B) root planing or the smoothing and polishing
235235 of roughened root surfaces or exposed human teeth; or
236236 (C) any other act the delegation of which is
237237 prohibited by board rule;
238238 (3) any of the following acts to a person not licensed
239239 as a dentist:
240240 (A) comprehensive examination or diagnosis and
241241 treatment planning;
242242 (B) a surgical or cutting procedure on hard or
243243 soft tissue;
244244 (C) the prescription of a drug, medication, or
245245 work authorization;
246246 (D) the taking of an impression for a final
247247 restoration, appliance, or prosthesis;
248248 (E) the making of an intraoral occlusal
249249 adjustment;
250250 (F) direct pulp capping, pulpotomy, or any other
251251 endodontic procedure;
252252 (G) the final placement and intraoral adjustment
253253 of a fixed or removable appliance; or
254254 (H) the placement of any final restoration; or
255255 (4) the authority to an individual to administer a
256256 local anesthetic agent, inhalation sedative agent, parenteral
257257 sedative agent, or general anesthetic agent, including as a
258258 teledentistry dental service as that term is defined by Section
259259 111.001, if the individual is not licensed as:
260260 (A) a dentist with a permit issued by the board
261261 for the procedure being performed, if a permit is required;
262262 (B) a certified registered nurse anesthetist
263263 licensed by the Texas Board of Nursing, only if the delegating
264264 dentist holds a permit issued by the board for the procedure being
265265 performed, if a permit is required; or
266266 (C) a physician anesthesiologist licensed by the
267267 Texas Medical Board.
268268 SECTION 15. Section 262.152, Occupations Code, is amended
269269 to read as follows:
270270 Sec. 262.152. PERFORMANCE OF DELEGATED DUTIES. (a) Except
271271 as provided by Section 262.1515, a dental hygienist shall practice
272272 dental hygiene:
273273 (1) in the dental office of a supervising dentist
274274 licensed by the board; or
275275 (2) in an alternate setting, including a nursing home,
276276 the patient's home, a school, a hospital, a state institution, a
277277 public health clinic, or another institution, under the supervision
278278 of a supervising dentist.
279279 (b) For purposes of this section, a dental hygienist who
280280 practices dental hygiene as a teledentistry dental service, as
281281 defined by Section 111.001, is practicing in an alternate setting
282282 in compliance with Subsection (a)(2).
283283 SECTION 16. Section 562.056(c), Occupations Code, is
284284 amended to read as follows:
285285 (c) For purposes of this section and Section 562.112, a
286286 valid practitioner-patient relationship is present between a
287287 practitioner providing telemedicine medical services or
288288 teledentistry dental services and the patient receiving the
289289 [telemedicine medical] services if the practitioner has complied
290290 with the requirements for establishing such a relationship in
291291 accordance with Section 111.005.
292292 SECTION 17. Section 531.001, Government Code, is amended by
293293 amending Subdivision (4-d) and adding Subdivision (6-a) to read as
294294 follows:
295295 (4-d) "Platform" means the technology, system,
296296 software, application, modality, or other method through which a
297297 health professional remotely interfaces with a patient when
298298 providing a health care service or procedure as a telemedicine
299299 medical service, teledentistry dental service, or telehealth
300300 service.
301301 (6-a) "Teledentistry dental service" has the meaning
302302 assigned by Section 111.001, Occupations Code.
303303 SECTION 18. Section 531.0216, Government Code, is amended
304304 to read as follows:
305305 Sec. 531.0216. PARTICIPATION AND REIMBURSEMENT OF
306306 TELEMEDICINE MEDICAL SERVICE PROVIDERS, TELEDENTISTRY DENTAL
307307 SERVICE PROVIDERS, AND TELEHEALTH SERVICE PROVIDERS UNDER
308308 MEDICAID. (a) The executive commissioner by rule shall develop and
309309 implement a system to reimburse providers of services under
310310 Medicaid for services performed using telemedicine medical
311311 services, teledentistry dental services, or telehealth services.
312312 (c) The commission shall encourage health care providers
313313 and health care facilities to provide telemedicine medical
314314 services, teledentistry dental services, and telehealth services
315315 in the health care delivery system. The commission may not require
316316 that a service be provided to a patient through telemedicine
317317 medical services, teledentistry dental services, or telehealth
318318 services.
319319 (c-1) The commission shall explore opportunities to
320320 increase STAR Health program providers' use of telemedicine medical
321321 services in medically underserved areas of this state.
322322 (d) Subject to Sections 111.004 and [Section] 153.004,
323323 Occupations Code, the executive commissioner may adopt rules as
324324 necessary to implement this section. In the rules adopted under
325325 this section, the executive commissioner shall:
326326 (1) refer to the site where the patient is physically
327327 located as the patient site; and
328328 (2) refer to the site where the physician, dentist, or
329329 health professional providing the telemedicine medical service,
330330 teledentistry dental service, or telehealth service is physically
331331 located as the distant site.
332332 (f) Not later than December 1 of each even-numbered year,
333333 the commission shall report to the speaker of the house of
334334 representatives and the lieutenant governor on the effects of
335335 telemedicine medical services, teledentistry dental services,
336336 telehealth services, and home telemonitoring services on Medicaid
337337 in the state, including the number of physicians, dentists, health
338338 professionals, and licensed health care facilities using
339339 telemedicine medical services, teledentistry dental services,
340340 telehealth services, or home telemonitoring services, the
341341 geographic and demographic disposition of the physicians,
342342 dentists, and health professionals, the number of patients
343343 receiving telemedicine medical services, teledentistry dental
344344 services, telehealth services, and home telemonitoring services,
345345 the types of services being provided, the cost of utilization, and
346346 the cost savings of telemedicine medical services, teledentistry
347347 dental services, telehealth services, and home telemonitoring
348348 services to Medicaid.
349349 (g) The commission shall ensure that a Medicaid managed care
350350 organization:
351351 (1) does not deny reimbursement for a covered health
352352 care service or procedure delivered by a health care provider with
353353 whom the managed care organization contracts to a Medicaid
354354 recipient as a telemedicine medical service, a teledentistry dental
355355 service, or a telehealth service solely because the covered service
356356 or procedure is not provided through an in-person consultation;
357357 (2) does not limit, deny, or reduce reimbursement for
358358 a covered health care service or procedure delivered by a health
359359 care provider with whom the managed care organization contracts to
360360 a Medicaid recipient as a telemedicine medical service, a
361361 teledentistry dental service, or a telehealth service based on the
362362 health care provider's choice of platform for providing the health
363363 care service or procedure; and
364364 (3) ensures that the use of telemedicine medical
365365 services, teledentistry dental services, or telehealth services
366366 promotes and supports patient-centered medical homes by allowing a
367367 Medicaid recipient to receive a telemedicine medical service,
368368 teledentistry dental service, or telehealth service from a provider
369369 other than the recipient's primary care physician or provider,
370370 except as provided by Section 531.0217(c-4), only if:
371371 (A) the telemedicine medical service,
372372 teledentistry dental service, or telehealth service is provided in
373373 accordance with the law and contract requirements applicable to the
374374 provision of the same health care service in an in-person setting,
375375 including requirements regarding care coordination; and
376376 (B) the provider of the telemedicine medical
377377 service, teledentistry dental service, or telehealth service gives
378378 notice to the Medicaid recipient's primary care physician or
379379 provider regarding the [telemedicine medical service or
380380 telehealth] service, including a summary of the service, exam
381381 findings, a list of prescribed or administered medications, and
382382 patient instructions, for the purpose of sharing medical
383383 information, provided that the recipient has a primary care
384384 physician or provider and the recipient or, if appropriate, the
385385 recipient's parent or legal guardian, consents to the notice.
386386 (h) The commission shall develop, document, and implement a
387387 monitoring process to ensure that a Medicaid managed care
388388 organization ensures that the use of telemedicine medical services,
389389 teledentistry dental services, or telehealth services promotes and
390390 supports patient-centered medical homes and care coordination in
391391 accordance with Subsection (g)(3). The process must include
392392 monitoring of the rate at which a telemedicine medical service,
393393 teledentistry dental service, or telehealth service provider gives
394394 notice in accordance with Subsection (g)(3)(B).
395395 (i) The executive commissioner by rule shall ensure that a
396396 federally-qualified [federally qualified] health center as defined
397397 by 42 U.S.C. Section 1396d(l)(2)(B) may be reimbursed for the
398398 originating site facility fee or the distant site practitioner fee
399399 or both, as appropriate, for a covered telemedicine medical
400400 service, teledentistry dental service, or telehealth service
401401 delivered by a health care provider to a Medicaid recipient. The
402402 commission is required to implement this subsection only if the
403403 legislature appropriates money specifically for that purpose. If
404404 the legislature does not appropriate money specifically for that
405405 purpose, the commission may, but is not required to, implement this
406406 subsection using other money available to the commission for that
407407 purpose.
408408 (j) In complying with state and federal requirements to
409409 provide access to medically necessary services under the Medicaid
410410 managed care program, a Medicaid managed care organization
411411 determining whether reimbursement for a telemedicine medical
412412 service, teledentistry dental service, or telehealth service is
413413 appropriate shall continue to consider other factors, including
414414 whether reimbursement is cost-effective and whether the provision
415415 of the service is clinically effective.
416416 SECTION 19. The heading to Section 531.02162, Government
417417 Code, is amended to read as follows:
418418 Sec. 531.02162. MEDICAID SERVICES PROVIDED THROUGH
419419 TELEMEDICINE MEDICAL SERVICES, TELEDENTISTRY DENTAL SERVICES, AND
420420 TELEHEALTH SERVICES TO CHILDREN WITH SPECIAL HEALTH CARE NEEDS.
421421 SECTION 20. Sections 531.02162(b) and (c), Government Code,
422422 are amended to read as follows:
423423 (b) The executive commissioner by rule shall establish
424424 policies that permit reimbursement under Medicaid and the child
425425 health plan program for services provided through telemedicine
426426 medical services, teledentistry dental services, and telehealth
427427 services to children with special health care needs.
428428 (c) The policies required under this section must:
429429 (1) be designed to:
430430 (A) prevent unnecessary travel and encourage
431431 efficient use of telemedicine medical services, teledentistry
432432 dental services, and telehealth services for children with special
433433 health care needs in all suitable circumstances; and
434434 (B) ensure in a cost-effective manner the
435435 availability to a child with special health care needs of services
436436 appropriately performed using telemedicine medical services,
437437 teledentistry dental services, and telehealth services that are
438438 comparable to the same types of services available to that child
439439 without the use of telemedicine medical services, teledentistry
440440 dental services, and telehealth services; and
441441 (2) provide for reimbursement of multiple providers of
442442 different services who participate in a single session of
443443 telemedicine medical services, teledentistry dental services,
444444 [and] telehealth services, or any combination of those services,
445445 [session] for a child with special health care needs, if the
446446 commission determines that reimbursing each provider for the
447447 session is cost-effective in comparison to the costs that would be
448448 involved in obtaining the services from providers without the use
449449 of telemedicine medical services, teledentistry dental services,
450450 and telehealth services, including the costs of transportation and
451451 lodging and other direct costs.
452452 SECTION 21. Subchapter B, Chapter 531, Government Code, is
453453 amended by adding Section 531.02172 to read as follows:
454454 Sec. 531.02172. REIMBURSEMENT FOR TELEDENTISTRY DENTAL
455455 SERVICES. (a) The commission by rule shall require each health and
456456 human services agency that administers a part of the Medicaid
457457 program to provide Medicaid reimbursement for teledentistry dental
458458 services provided by a dentist licensed to practice dentistry in
459459 this state.
460460 (b) The commission shall require reimbursement for a
461461 teledentistry dental service at the same rate as the Medicaid
462462 program reimburses for the same in-person dental service. A
463463 request for reimbursement may not be denied solely because an
464464 in-person dental service between a dentist and a patient did not
465465 occur. The commission may not limit a dentist's choice of platform
466466 for providing a teledentistry dental service by requiring that the
467467 dentist use a particular platform to receive reimbursement for the
468468 service.
469469 (c) The State Board of Dental Examiners, in consultation
470470 with the commission and the commission's office of inspector
471471 general, as appropriate, may adopt rules as necessary to:
472472 (1) ensure that appropriate care, including quality of
473473 care, is provided to patients who receive teledentistry dental
474474 services; and
475475 (2) prevent abuse and fraud through the use of
476476 teledentistry dental services, including rules relating to filing
477477 claims and the records required to be maintained in connection with
478478 teledentistry dental services.
479479 SECTION 22. The heading to Section 62.157, Health and
480480 Safety Code, is amended to read as follows:
481481 Sec. 62.157. TELEMEDICINE MEDICAL SERVICES, TELEDENTISTRY
482482 DENTAL SERVICES, AND TELEHEALTH SERVICES FOR CHILDREN WITH SPECIAL
483483 HEALTH CARE NEEDS.
484484 SECTION 23. Sections 62.157(a) and (b), Health and Safety
485485 Code, are amended to read as follows:
486486 (a) In providing covered benefits to a child with special
487487 health care needs, a health plan provider must permit benefits to be
488488 provided through telemedicine medical services, teledentistry
489489 dental services, and telehealth services in accordance with
490490 policies developed by the commission.
491491 (b) The policies must provide for:
492492 (1) the availability of covered benefits
493493 appropriately provided through telemedicine medical services,
494494 teledentistry dental services, and telehealth services that are
495495 comparable to the same types of covered benefits provided without
496496 the use of telemedicine medical services, teledentistry dental
497497 services, and telehealth services; and
498498 (2) the availability of covered benefits for different
499499 services performed by multiple health care providers during a
500500 single [telemedicine medical services and telehealth services]
501501 session of telemedicine medical services, teledentistry dental
502502 services, telehealth services, or any combination of those
503503 services, if the executive commissioner determines that delivery of
504504 the covered benefits in that manner is cost-effective in comparison
505505 to the costs that would be involved in obtaining the services from
506506 providers without the use of telemedicine medical services,
507507 teledentistry dental services, and telehealth services, including
508508 the costs of transportation and lodging and other direct costs.
509509 SECTION 24. Section 62.1571, Health and Safety Code, is
510510 amended to read as follows:
511511 Sec. 62.1571. TELEMEDICINE MEDICAL SERVICES AND
512512 TELEDENTISTRY DENTAL SERVICES. (a) In providing covered benefits
513513 to a child, a health plan provider must permit benefits to be
514514 provided through telemedicine medical services and teledentistry
515515 dental services in accordance with policies developed by the
516516 commission.
517517 (b) The policies must provide for:
518518 (1) the availability of covered benefits
519519 appropriately provided through telemedicine medical services and
520520 teledentistry dental services that are comparable to the same types
521521 of covered benefits provided without the use of telemedicine
522522 medical services and teledentistry dental services; and
523523 (2) the availability of covered benefits for different
524524 services performed by multiple health care providers during a
525525 single session of telemedicine medical services, teledentistry
526526 dental services, or both services, if the executive commissioner
527527 determines that delivery of the covered benefits in that manner is
528528 cost-effective in comparison to the costs that would be involved in
529529 obtaining the services from providers without the use of
530530 telemedicine medical services or teledentistry dental services,
531531 including the costs of transportation and lodging and other direct
532532 costs.
533533 (c) [(d)] In this section, "teledentistry dental service"
534534 and "telemedicine medical service" have [has] the meanings
535535 [meaning] assigned by Section 531.001, Government Code.
536536 SECTION 25. The heading to Chapter 1455, Insurance Code, is
537537 amended to read as follows:
538538 CHAPTER 1455. TELEMEDICINE, TELEDENTISTRY, AND TELEHEALTH
539539 SECTION 26. Section 1455.001, Insurance Code, is amended by
540540 amending Subdivisions (1) and (3) and adding Subdivision (1-a) to
541541 read as follows:
542542 (1) "Dentist" means a person licensed to practice
543543 dentistry in this state under Subtitle D, Title 3, Occupations
544544 Code.
545545 (1-a) "Health professional" means:
546546 (A) a physician;
547547 (B) an individual who is:
548548 (i) licensed or certified in this state to
549549 perform health care services; and
550550 (ii) authorized to assist:
551551 (a) a physician in providing
552552 telemedicine medical services that are delegated and supervised by
553553 the physician; or
554554 (b) a dentist in providing
555555 teledentistry dental services that are delegated and supervised by
556556 the dentist;
557557 (C) a licensed or certified health professional
558558 acting within the scope of the license or certification who does not
559559 perform a telemedicine medical service or a teledentistry dental
560560 service; or
561561 (D) a dentist.
562562 (3) "Teledentistry dental service," "telehealth
563563 ["Telehealth] service," and "telemedicine medical service" have
564564 the meanings assigned by Section 111.001, Occupations Code.
565565 SECTION 27. Section 1455.004, Insurance Code, is amended to
566566 read as follows:
567567 Sec. 1455.004. COVERAGE FOR TELEMEDICINE MEDICAL SERVICES,
568568 TELEDENTISTRY DENTAL SERVICES, AND TELEHEALTH SERVICES. (a) A
569569 health benefit plan:
570570 (1) must provide coverage for a covered health care
571571 service or procedure delivered by a preferred or contracted health
572572 professional to a covered patient as a telemedicine medical
573573 service, teledentistry dental service, or telehealth service on the
574574 same basis and to the same extent that the plan provides coverage
575575 for the service or procedure in an in-person setting; and
576576 (2) may not:
577577 (A) exclude from coverage a covered health care
578578 service or procedure delivered by a preferred or contracted health
579579 professional to a covered patient as a telemedicine medical
580580 service, a teledentistry dental service, or a telehealth service
581581 solely because the covered health care service or procedure is not
582582 provided through an in-person consultation; and
583583 (B) subject to Subsection (c), limit, deny, or
584584 reduce coverage for a covered health care service or procedure
585585 delivered as a telemedicine medical service, teledentistry dental
586586 service, or telehealth service based on the health professional's
587587 choice of platform for delivering the service or procedure.
588588 (b) A health benefit plan may require a deductible, a
589589 copayment, or coinsurance for a covered health care service or
590590 procedure delivered by a preferred or contracted health
591591 professional to a covered patient as a telemedicine medical
592592 service, a teledentistry dental service, or a telehealth service.
593593 The amount of the deductible, copayment, or coinsurance may not
594594 exceed the amount of the deductible, copayment, or coinsurance
595595 required for the covered health care service or procedure provided
596596 through an in-person consultation.
597597 (b-1) Subsection (b) does not authorize a health benefit
598598 plan to charge a separate deductible that applies only to a covered
599599 health care service or procedure delivered as a telemedicine
600600 medical service, teledentistry dental service, or telehealth
601601 service.
602602 (c) Notwithstanding Subsection (a), a health benefit plan
603603 is not required to provide coverage for a telemedicine medical
604604 service, a teledentistry dental service, or a telehealth service
605605 provided by only synchronous or asynchronous audio interaction,
606606 including:
607607 (1) an audio-only telephone consultation;
608608 (2) a text-only e-mail message; or
609609 (3) a facsimile transmission.
610610 (d) A health benefit plan may not impose an annual or
611611 lifetime maximum on coverage for covered health care services or
612612 procedures delivered as telemedicine medical services,
613613 teledentistry dental services, or telehealth services other than
614614 the annual or lifetime maximum, if any, that applies in the
615615 aggregate to all items and services and procedures covered under
616616 the plan.
617617 SECTION 28. Section 1455.006, Insurance Code, is amended to
618618 read as follows:
619619 Sec. 1455.006. TELEMEDICINE MEDICAL SERVICES,
620620 TELEDENTISTRY DENTAL SERVICES, AND TELEHEALTH SERVICES STATEMENT.
621621 (a) Each issuer of a health benefit plan shall adopt and display in
622622 a conspicuous manner on the health benefit plan issuer's Internet
623623 website the issuer's policies and payment practices for
624624 telemedicine medical services, teledentistry dental services, and
625625 telehealth services.
626626 (b) This section does not require an issuer of a health
627627 benefit plan to display negotiated contract payment rates for
628628 health professionals who contract with the issuer to provide
629629 telemedicine medical services, teledentistry dental services, or
630630 telehealth services.
631631 SECTION 29. Not later than March 1, 2022:
632632 (1) the State Board of Dental Examiners and the Texas
633633 State Board of Pharmacy shall jointly adopt rules as required by
634634 Section 111.006(c), Occupations Code, as added by this Act;
635635 (2) the State Board of Dental Examiners shall adopt:
636636 (A) rules necessary to implement Chapter 111,
637637 Occupations Code, as amended by this Act; and
638638 (B) rules as required by Section 254.0035,
639639 Occupations Code, as added by this Act; and
640640 (3) the Health and Human Services Commission shall
641641 adopt rules as required by Section 531.02172, Government Code, as
642642 added by this Act.
643643 SECTION 30. If before implementing any provision of this
644644 Act a state agency determines that a waiver or authorization from a
645645 federal agency is necessary for implementation of that provision,
646646 the agency affected by the provision shall request the waiver or
647647 authorization and may delay implementing that provision until the
648648 waiver or authorization is granted.
649649 SECTION 31. (a) Except as provided by Subsection (b) of
650650 this section, this Act takes effect September 1, 2021.
651651 (b) Sections 1455.004 and 1455.006, Insurance Code, as
652652 amended by this Act, take effect January 1, 2022.
