66 AN ACT
77 relating to the issuance of an anesthesiologist assistant
88 certificate by the Texas Medical Board; providing an administrative
99 penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle C, Title 3, Occupations Code, is
1212 amended by adding Chapter 207 to read as follows:
1313 CHAPTER 207. ANESTHESIOLOGIST ASSISTANTS
1414 Sec. 207.001. DEFINITIONS. In this chapter:
1515 (1) "Anesthesiologist assistant" means a person who
1616 holds a certificate issued under this chapter.
1717 (2) "Medical board" means the Texas Medical Board.
1818 Sec. 207.002. GENERAL POWERS AND DUTIES. The medical board
1919 shall administer and enforce this chapter.
2020 Sec. 207.003. ISSUANCE OF CERTIFICATE. The medical board
2121 shall issue a certificate to an applicant who:
2222 (1) submits proof of completion of a graduate level
2323 training program accredited by the Commission on Accreditation of
2424 Allied Health Education Programs or its successor organization;
2525 (2) passes a certifying examination administered by
2626 the National Commission for Certification of Anesthesiologist
2727 Assistants or its successor organization not later than 12 months
2828 from the date of completion of the training program required under
2929 Subdivision (1);
3030 (3) submits proof of current certification from the
3131 National Commission for Certification of Anesthesiologist
3232 Assistants or its successor organization; and
3333 (4) meets any additional qualifications adopted by the
3434 medical board by rule.
3535 Sec. 207.004. USE OF TITLE. (a) A person may not use the
3636 title "anesthesiologist assistant" or represent that the person is
3737 an anesthesiologist assistant unless the person holds a certificate
3838 issued under this chapter. The medical board may impose an
3939 administrative penalty in an amount to be determined by the board in
4040 the same manner and using the same procedures as Subchapter A,
4141 Chapter 165, on a person who violates this subsection.
4242 (b) A student in an anesthesiologist assistant training
4343 program shall be identified as a student anesthesiologist assistant
4444 or an anesthesiologist assistant student. A student may not use or
4545 permit to be used on the student's behalf the term "intern,"
4646 "resident," or "fellow," or another term that identifies the
4747 student as a physician or surgeon.
4848 SECTION 2. Not later than June 1, 2022, the Texas Medical
4949 Board shall adopt the rules and procedures necessary to administer
5050 Chapter 207, Occupations Code, as added by this Act.
5151 SECTION 3. (a) Except as provided by Subsection (b) of this
5252 section, this Act takes effect September 1, 2021.
5353 (b) Section 207.004, Occupations Code, as added by this Act,
5454 takes effect September 1, 2022.
