8 | 8 | | certificate by the Texas Medical Board; providing an administrative |

9 | 9 | | penalty. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subtitle C, Title 3, Occupations Code, is |
---|
12 | 12 | | amended by adding Chapter 207 to read as follows: |
---|
13 | 13 | | CHAPTER 207. ANESTHESIOLOGIST ASSISTANTS |
---|
14 | 14 | | Sec. 207.001. DEFINITIONS. In this chapter: |
---|
15 | 15 | | (1) "Anesthesiologist assistant" means a person who |
---|
16 | 16 | | holds a certificate issued under this chapter. |
---|
17 | 17 | | (2) "Medical board" means the Texas Medical Board. |
---|
18 | 18 | | Sec. 207.002. GENERAL POWERS AND DUTIES. The medical board |
---|
19 | 19 | | shall administer and enforce this chapter. |
---|
20 | 20 | | Sec. 207.003. ISSUANCE OF CERTIFICATE. The medical board |
---|
21 | 21 | | shall issue a certificate to an applicant who: |
---|
22 | 22 | | (1) submits proof of completion of a graduate level |
---|
23 | 23 | | training program accredited by the Commission on Accreditation of |
---|
24 | 24 | | Allied Health Education Programs or its successor organization; |
---|
25 | 25 | | (2) passes a certifying examination administered by |
---|
26 | 26 | | the National Commission for Certification of Anesthesiologist |
---|
27 | 27 | | Assistants or its successor organization not later than 12 months |
---|
28 | 28 | | from the date of completion of the training program required under |
---|
29 | 29 | | Subdivision (1); |
---|
30 | 30 | | (3) submits proof of current certification from the |
---|
31 | 31 | | National Commission for Certification of Anesthesiologist |
---|
32 | 32 | | Assistants or its successor organization; and |
---|
33 | 33 | | (4) meets any additional qualifications adopted by the |
---|
34 | 34 | | medical board by rule. |
---|
35 | 35 | | Sec. 207.004. USE OF TITLE. (a) A person may not use the |
---|
36 | 36 | | title "anesthesiologist assistant" or represent that the person is |
---|
37 | 37 | | an anesthesiologist assistant unless the person holds a certificate |
---|
38 | 38 | | issued under this chapter. The medical board may impose an |
---|
39 | 39 | | administrative penalty in an amount to be determined by the board in |
---|
40 | 40 | | the same manner and using the same procedures as Subchapter A, |
---|
41 | 41 | | Chapter 165, on a person who violates this subsection. |
---|
42 | 42 | | (b) A student in an anesthesiologist assistant training |
---|
43 | 43 | | program shall be identified as a student anesthesiologist assistant |
---|
44 | 44 | | or an anesthesiologist assistant student. A student may not use or |
---|
45 | 45 | | permit to be used on the student's behalf the term "intern," |
---|
46 | 46 | | "resident," or "fellow," or another term that identifies the |
---|
47 | 47 | | student as a physician or surgeon. |
---|
48 | 48 | | SECTION 2. Not later than June 1, 2022, the Texas Medical |
---|
49 | 49 | | Board shall adopt the rules and procedures necessary to administer |
---|
50 | 50 | | Chapter 207, Occupations Code, as added by this Act. |
---|
51 | 51 | | SECTION 3. (a) Except as provided by Subsection (b) of this |
---|
52 | 52 | | section, this Act takes effect September 1, 2021. |
---|
53 | 53 | | (b) Section 207.004, Occupations Code, as added by this Act, |
---|
54 | 54 | | takes effect September 1, 2022. |
