411 A BILL TO BE ENTITLED
512 AN ACT
613 relating to creating the criminal offense of failing to report
714 abuse, neglect, or exploitation in boarding home facilities by
815 certain persons.
916 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1017 SECTION 1. Chapter 260, Health and Safety Code, is amended
1118 by adding Section 260.0091 to read as follows:
1219 Sec. 260.0091. REQUIRED REPORTING OF ABUSE, NEGLECT, OR
1320 EXPLOITATION BY A LESSOR; CRIMINAL PENALTY. (a) A person commits
1421 an offense if the person:
1522 (1) leases to another a building owned by the person
1623 that is being operated as a boarding home facility;
1724 (2) has actual knowledge that a resident of the
1825 boarding home facility is being or has been abused, neglected, or
1926 exploited; and
2027 (3) fails to report the abuse, neglect, or
2128 exploitation to the Department of Family and Protective Services
2229 for investigation by that agency.
2330 (b) An offense under this section is a Class A misdemeanor.
2431 SECTION 2. This Act takes effect September 1, 2021.
