| 9 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 17 | | SECTION 1. Chapter 260, Health and Safety Code, is amended |
|---|
| 11 | 18 | | by adding Section 260.0091 to read as follows: |
|---|
| 12 | 19 | | Sec. 260.0091. REQUIRED REPORTING OF ABUSE, NEGLECT, OR |
|---|
| 13 | 20 | | EXPLOITATION BY A LESSOR; CRIMINAL PENALTY. (a) A person commits |
|---|
| 14 | 21 | | an offense if the person: |
|---|
| 15 | 22 | | (1) leases to another a building owned by the person |
|---|
| 16 | 23 | | that is being operated as a boarding home facility; |
|---|
| 17 | 24 | | (2) has actual knowledge that a resident of the |
|---|
| 18 | 25 | | boarding home facility is being or has been abused, neglected, or |
|---|
| 19 | 26 | | exploited; and |
|---|
| 20 | 27 | | (3) fails to report the abuse, neglect, or |
|---|
| 21 | 28 | | exploitation to the Department of Family and Protective Services |
|---|
| 22 | 29 | | for investigation by that agency. |
|---|
| 23 | 30 | | (b) An offense under this section is a Class A misdemeanor. |
|---|
| 24 | 31 | | SECTION 2. This Act takes effect September 1, 2021. |
