66 AN ACT
77 relating to the expansion of broadband services to certain areas.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 490H.002(a), Government Code, is amended
1010 to read as follows:
1111 (a) The council is composed of one nonvoting member
1212 appointed by the broadband development office and the following 17
1313 voting members:
1414 (1) two representatives of separate Internet service
1515 provider industry associations, including at least one
1616 representative of an association that primarily represents small
1717 providers, as defined by Section 56.032, Utilities Code, appointed
1818 by the governor;
1919 (2) one representative of the health information
2020 technology industry, appointed by the governor;
2121 (3) two representatives of unaffiliated nonprofit
2222 organizations that advocate for elderly persons statewide,
2323 appointed by the governor;
2424 (4) two representatives of unaffiliated nonprofit
2525 organizations that have a demonstrated history of working with the
2626 legislature and the public to identify solutions for expanding
2727 broadband to rural, unserved areas of this state, appointed by the
2828 governor;
2929 (5) one representative of an agricultural advocacy
3030 organization in this state, appointed by the governor;
3131 (6) one representative of a hospital advocacy
3232 organization in this state, appointed by the governor;
3333 (7) one representative of a medical advocacy
3434 organization in this state, appointed by the governor;
3535 (8) one county official who serves in an elected
3636 office of a county with a population of less than 35,000, appointed
3737 by the governor;
3838 (9) one municipal official who serves in an elected
3939 office of a municipality with a population of less than 20,000
4040 located in a county with a population of less than 60,000, appointed
4141 by the governor;
4242 (10) one representative of an institution of higher
4343 education that has its main campus in a county with a population of
4444 less than 60,000, appointed by the governor;
4545 (11) one representative of a school district with a
4646 territory that includes only counties with a population of less
4747 than 60,000, appointed by the governor;
4848 (12) one representative from a library association,
4949 appointed by the governor;
5050 (13) one member of the house of representatives,
5151 appointed by the speaker of the house of representatives; and
5252 (14) one state senator, appointed by the lieutenant
5353 governor.
5454 SECTION 2. Section 490H.006(a), Government Code, is amended
5555 to read as follows:
5656 (a) The council shall:
5757 (1) research the progress of:
5858 (A) broadband development in unserved areas; and
5959 (B) deployment of broadband services statewide;
6060 (2) identify barriers to residential and commercial
6161 broadband deployment in unserved areas;
6262 (3) study:
6363 (A) technology-neutral solutions to overcome
6464 barriers identified under Subdivision (2); and
6565 (B) industry and technology trends in broadband
6666 services;
6767 (4) analyze how statewide access to broadband would
6868 benefit:
6969 (A) economic development;
7070 (B) the delivery of educational opportunities in
7171 higher education and public education;
7272 (C) state and local law enforcement;
7373 (D) state emergency preparedness; and
7474 (E) the delivery of health care services,
7575 including telemedicine and telehealth; and
7676 (5) study the outcomes of programs administered by the
7777 broadband development office.
7878 SECTION 3. Subtitle F, Title 4, Government Code, is amended
7979 by adding Chapter 490I to read as follows:
8080 CHAPTER 490I. BROADBAND DEVELOPMENT OFFICE
8181 Sec. 490I.0101. DEFINITION. In this chapter, "broadband
8282 service" means Internet service provided directly to end user
8383 retail customers and capable of providing:
8484 (1) a download speed of 25 megabits per second or
8585 faster; and
8686 (2) an upload speed of 3 megabits per second or faster.
8787 Sec. 490I.0102. OFFICE. (a) The broadband development
8888 office is an office within the comptroller's office.
8989 (b) The comptroller may employ additional employees
9090 necessary for the discharge of the duties of the broadband
9191 development office.
9292 (c) The broadband development office:
9393 (1) is under the direction and control of the
9494 comptroller;
9595 (2) shall promote the policies enumerated in this
9696 chapter; and
9797 (3) may perform any action authorized by state or
9898 federal law.
9999 Sec. 490I.0103. POWERS AND DUTIES. The broadband
100100 development office shall:
101101 (1) serve as a resource for information regarding
102102 broadband service in this state; and
103103 (2) engage in outreach to communities regarding the
104104 expansion and adoption of broadband service and the programs
105105 administered by the office.
106106 Sec. 490I.0104. BROADBAND DEVELOPMENT MAP. (a) The
107107 broadband development office shall create, update annually, and
108108 publish on the comptroller's Internet website a map designating
109109 each census block in this state as:
110110 (1) an eligible area, if fewer than 80 percent of the
111111 addresses in the block have access to broadband service; or
112112 (2) an ineligible area, if 80 percent or more of the
113113 addresses in the block have access to broadband service.
114114 (b) The map must display:
115115 (1) the number of broadband service providers that
116116 serve each census block; and
117117 (2) for each eligible area, an indication of whether
118118 the area has access to Internet service that is not broadband
119119 service, regardless of the technology used to provide the service.
120120 (c) Except as provided by Subsection (d), the office shall
121121 use information available from the Federal Communications
122122 Commission to create or update the map.
123123 (d) If information from the Federal Communications
124124 Commission is not sufficient for the office to create or update the
125125 map, the office may request the necessary information from a
126126 political subdivision or broadband service provider, and the
127127 subdivision or provider shall report the information to the office.
128128 The office may not require a subdivision or provider to report
129129 information in a format that is substantially different from the
130130 format required by the Federal Communications Commission.
131131 (e) Information a broadband service provider reports to the
132132 office under Subsection (d) is confidential and not subject to
133133 disclosure under Chapter 552. The office may not share information
134134 reported under Subsection (d) with a third party or contract with a
135135 third party to collect, analyze, or use information reported under
136136 Subsection (d).
137137 (f) A broadband service provider or political subdivision
138138 may petition the office to redesignate a census block on the map as
139139 an eligible area or ineligible area. The office shall provide
140140 notice of the petition to each broadband service provider that
141141 provides broadband service to the census block and post notice of
142142 the petition on the comptroller's Internet website.
143143 (g) Not later than the 45th day after the date that a
144144 broadband provider receives notice under Subsection (f), the
145145 provider shall provide information to the office showing whether
146146 the census block should or should not be redesignated.
147147 (h) Not later than the 75th day after the date that a
148148 broadband provider receives notice under Subsection (f), the office
149149 shall determine whether to redesignate the census block on the map
150150 and update the map as necessary. A determination made by the office
151151 under this subsection is not a contested case for purposes of
152152 Chapter 2001.
153153 (i) The office is not required to create, update, or publish
154154 a map under this section if the Federal Communications Commission
155155 produces a map that:
156156 (1) enables the office to identify eligible and
157157 ineligible areas, as described by Subsection (a); and
158158 (2) meets the requirements of Subsection (b).
159159 Sec. 490I.0105. BROADBAND DEVELOPMENT PROGRAM. (a) The
160160 broadband development office shall establish a program to award
161161 grants, low-interest loans, and other financial incentives to
162162 applicants for the purpose of expanding access to and adoption of
163163 broadband service in census blocks determined to be eligible areas
164164 by the office under Section 490I.0104.
165165 (b) The office shall establish and publish eligibility
166166 criteria for award recipients. The criteria must require that
167167 grants, loans, and other financial incentives awarded through the
168168 program be used only for capital expenses, purchase or lease of
169169 property, and other expenses, including backhaul and transport,
170170 that will facilitate the provision or adoption of broadband
171171 service.
172172 (c) The office may not:
173173 (1) favor a particular broadband technology in
174174 awarding grants, loans, or other financial incentives;
175175 (2) award grants, loans, or other financial incentives
176176 to a broadband provider that does not report information requested
177177 by the office under Section 490I.0104;
178178 (3) award a grant, loan, or other financial incentive
179179 to a noncommercial provider of broadband service for an eligible
180180 area if a commercial provider of broadband service has submitted an
181181 application for the eligible area; or
182182 (4) take into consideration distributions from the
183183 state universal service fund established under Chapter 56,
184184 Utilities Code, when deciding to award grants, loans, or other
185185 financial incentives.
186186 (d) An award granted under this section does not affect
187187 distributions received by a broadband provider from the state
188188 universal service fund established under Chapter 56, Utilities
189189 Code.
190190 Sec. 490I.0106. BROADBAND DEVELOPMENT ACCOUNT. (a) The
191191 broadband development account is an account in the general revenue
192192 fund.
193193 (b) The account consists of:
194194 (1) appropriations of money to the account by the
195195 legislature;
196196 (2) gifts, donations, and grants, including federal
197197 grants; and
198198 (3) interest earned on the investment of the money in
199199 the account.
200200 (c) The comptroller shall deposit to the credit of the
201201 account federal money received by the state for the purpose of
202202 broadband development, to the extent permitted by federal law.
203203 (d) Money in the account may be appropriated only to the
204204 broadband development office for purposes of:
205205 (1) administering the broadband development program;
206206 or
207207 (2) creating or updating the map described by Section
208208 490I.0104.
209209 (e) The account is exempt from the application of Section
210210 404.071.
211211 Sec. 490I.0107. RULEMAKING. The comptroller may adopt
212212 rules as necessary to implement this chapter.
213213 SECTION 4. (a) Not later than the first anniversary of the
214214 effective date of this Act, the broadband development office
215215 established by Section 490I.0102, Government Code, as added by this
216216 Act, shall prepare a state broadband plan that establishes
217217 long-term goals for greater access to and adoption of broadband
218218 service in this state.
219219 (b) In developing the state broadband plan, the office
220220 shall:
221221 (1) collaborate, to the extent possible, with state
222222 agencies, political subdivisions, broadband industry stakeholders
223223 and representatives, and community organizations that focus on
224224 broadband services;
225225 (2) incorporate the policy recommendations of the
226226 governor's broadband development council;
227227 (3) favor policies that are technology-neutral and
228228 protect all members of the public; and
229229 (4) explore state and regional approaches to broadband
230230 development.
231231 SECTION 5. (a) The broadband development office
232232 established by Section 490I.0102, Government Code, as added by this
233233 Act, shall publish the map required by Section 490I.0104,
234234 Government Code, as added by this Act, on the comptroller's
235235 Internet website not later than September 1, 2022.
236236 (b) Not later than January 1, 2022, the office shall publish
237237 on the comptroller's Internet website:
238238 (1) a map created by the Federal Communications
239239 Commission that displays the number of broadband service providers
240240 that serve each census block; or
241241 (2) a link to a map described by Subdivision (1) of
242242 this subsection.
243243 (c) For the purpose of administering the broadband
244244 development program established by Section 490I.0105, Government
245245 Code, as added by this Act, the office shall use a map described by
246246 Subsection (b) of this section to determine whether an area is
247247 eligible until the office publishes the map required by Section
248248 490I.0104, Government Code, as added by this Act.
249249 SECTION 6. This Act takes effect September 1, 2021.
