55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the Medicaid eligibility of certain persons who are
88 lawfully present in the United States.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.02472 to read as follows:
1212 Sec. 32.02472. ELIGIBILITY OF CERTAIN PERSONS LAWFULLY
1313 PRESENT IN THE UNITED STATES. (a) The commission shall provide
1414 medical assistance in accordance with 8 U.S.C. Section 1612(b) to a
1515 person who:
1616 (1) is a qualified alien, as defined by 8 U.S.C.
1717 Sections 1641(b) and (c);
1818 (2) meets the eligibility requirements of the medical
1919 assistance program;
2020 (3) entered the United States on or after August 22,
2121 1996; and
2222 (4) has resided in the United States for a period of
2323 five years after the date the person entered as a qualified alien.
2424 (b) To the extent allowed by federal law, the commission
2525 shall provide medical assistance for pregnant women to a person who
2626 is pregnant and is lawfully present, or lawfully residing in the
2727 United States as defined by the Centers for Medicare and Medicaid
2828 Services, including a battered alien under 8 U.S.C. Section
2929 1641(c), regardless of the date the person entered the United
3030 States.
3131 SECTION 2. If before implementing any provision of this Act
3232 a state agency determines that a waiver or authorization from a
3333 federal agency is necessary for implementation of that provision,
3434 the agency affected by the provision shall request the waiver or
3535 authorization and may delay implementing that provision until the
3636 waiver or authorization is granted.
3737 SECTION 3. This Act takes effect September 1, 2021.
