| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. This Act may be cited as the Caitlynne Rose |
|---|
| 11 | 11 | | Infinger Guajardo Act. |
|---|
| 12 | 12 | | SECTION 2. Article 17.03, Code of Criminal Procedure, is |
|---|
| 13 | 13 | | amended by amending Subsection (a) and adding Subsection (b-2) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (a) Except as provided by Subsection (b), [or] (b-1), or |
|---|
| 16 | 16 | | (b-2), a magistrate may, in the magistrate's discretion, release |
|---|
| 17 | 17 | | the defendant on personal bond without sureties or other security. |
|---|
| 18 | 18 | | (b-2) A magistrate may not release on personal bond a |
|---|
| 19 | 19 | | defendant who is charged with: |
|---|
| 20 | 20 | | (1) an offense alleged to have been committed while |
|---|
| 21 | 21 | | the defendant was released on personal bond for another offense; or |
|---|
| 22 | 22 | | (2) an offense punishable as a felony if two or more |
|---|
| 23 | 23 | | other felony charges are pending against the defendant. |

| 24 | 24 | | SECTION 3. Chapter 17, Code of Criminal Procedure, is |
|---|
| 25 | 25 | | amended by adding Article 17.1501 to read as follows: |
|---|
| 26 | 26 | | Art. 17.1501. MINIMUM AMOUNT OF BAIL FOR DEFENDANT CHARGED |
|---|
| 27 | 27 | | WITH MULTIPLE FELONIES. The amount of bail required for a defendant |
|---|
| 28 | 28 | | who is charged with three or more felony offenses, regardless of |
|---|
| 29 | 29 | | whether each charge is pending before the same court, shall be set |
|---|
| 30 | 30 | | in an amount not less than $10,000 for each felony offense charged |
|---|
| 31 | 31 | | against the defendant. |
|---|
| 32 | 32 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 33 | 33 | | to a person who is arrested on or after the effective date of this |
|---|
| 34 | 34 | | Act. A person arrested before the effective date of this Act is |
|---|
| 35 | 35 | | governed by the law in effect on the date the person was arrested, |
|---|
| 36 | 36 | | and the former law is continued in effect for that purpose. |

| 37 | 37 | | SECTION 5. This Act takes effect September 1, 2021. |
