66 AN ACT
77 relating to the review of a defendant's criminal history before any
88 release of the defendant on bail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 17, Code of Criminal Procedure, is
1111 amended by adding Article 17.034 to read as follows:
1212 Art. 17.034. REVIEW OF DEFENDANT'S CRIMINAL HISTORY. (a) A
1313 judge or magistrate must, before setting the amount of a
1414 defendant's bail or releasing a defendant on personal bond, enter
1515 into the record a written statement confirming that the judge or
1616 magistrate has reviewed and considered the defendant's criminal
1717 history as part of the proceedings for granting bail.
1818 (b) A statement described by Subsection (a) must be made
1919 available to the public on request.
2020 SECTION 2. The change in law made by this Act applies only
2121 to a person who is arrested on or after the effective date of this
2222 Act. A person arrested before the effective date of this Act is
2323 governed by the law in effect on the date the person was arrested,
2424 and the former law is continued in effect for that purpose.
2525 SECTION 3. This Act takes effect September 1, 2021.
