| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 17, Code of Criminal Procedure, is | |
| 11 | 11 | amended by adding Article 17.034 to read as follows: | |
| 12 | 12 | Art. 17.034. REVIEW OF DEFENDANT'S CRIMINAL HISTORY. (a) A | |
| 13 | 13 | judge or magistrate must, before setting the amount of a | |
| 14 | 14 | defendant's bail or releasing a defendant on personal bond, enter | |
| 15 | 15 | into the record a written statement confirming that the judge or | |
| 16 | 16 | magistrate has reviewed and considered the defendant's criminal | |
| 17 | 17 | history as part of the proceedings for granting bail. | |
| 18 | 18 | (b) A statement described by Subsection (a) must be made | |
| 19 | 19 | available to the public on request. | |
| 20 | 20 | SECTION 2. The change in law made by this Act applies only | |
| 21 | 21 | to a person who is arrested on or after the effective date of this | |
| 22 | 22 | Act. A person arrested before the effective date of this Act is | |
| 23 | 23 | governed by the law in effect on the date the person was arrested, | |
| 24 | 24 | and the former law is continued in effect for that purpose. | |
| 25 | 25 | SECTION 3. This Act takes effect September 1, 2021. |
