| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. This Act shall be known as the Texas Small |
|---|
| 10 | 10 | | Business Protection Act. |
|---|
| 11 | 11 | | SECTION 2. Section 62.002, Labor Code, is amended by adding |
|---|
| 12 | 12 | | Subdivision (8) to read as follows: |
|---|
| 13 | 13 | | (8) "Wages" has the meaning assigned by Section |
|---|
| 14 | 14 | | 61.001. |
|---|
| 15 | 15 | | SECTION 3. Subtitle D, Title 2, Labor Code, is amended by |
|---|
| 16 | 16 | | adding Chapter 83 to read as follows: |
|---|
| 17 | 17 | | CHAPTER 83. PROHIBITION AGAINST LOCAL REGULATION OF EMPLOYMENT |
|---|
| 18 | 18 | | BENEFITS |
|---|
| 19 | 19 | | Sec. 83.001. DEFINITIONS. In this chapter: |
|---|
| 20 | 20 | | (1) "Employee" means an individual who is employed by |
|---|
| 21 | 21 | | an employer for compensation. |
|---|
| 22 | 22 | | (2) "Employer" means a person who employs one or more |
|---|
| 23 | 23 | | employees. |
|---|
| 24 | 24 | | (3) "Employment benefit" means anything of value that |
|---|
| 25 | 25 | | an employee receives from an employer in addition to monetary |
|---|
| 26 | 26 | | compensation, including: |
|---|
| 27 | 27 | | (A) health, disability, retirement, |
|---|
| 28 | 28 | | profit-sharing, and death benefits; |
|---|
| 29 | 29 | | (B) group accidental death and dismemberment |
|---|
| 30 | 30 | | benefits; and |
|---|
| 31 | 31 | | (C) paid days off from work for holidays, sick |
|---|
| 32 | 32 | | leave, vacation, and personal necessity. |
|---|
| 33 | 33 | | Sec. 83.002. PROHIBITION AGAINST MUNICIPALITY OR COUNTY |
|---|
| 34 | 34 | | REQUIRING EMPLOYMENT BENEFITS. A municipality or county may not |
|---|
| 35 | 35 | | adopt or enforce an ordinance, order, rule, or regulation that |
|---|
| 36 | 36 | | requires an employer in the municipality or county to provide |
|---|
| 37 | 37 | | employment benefits. |
|---|
| 38 | 38 | | SECTION 4. Chapter 83, Labor Code, as added by this Act, |
|---|
| 39 | 39 | | applies to an ordinance, order, rule, or regulation adopted before, |
|---|
| 40 | 40 | | on, or after the effective date of this Act. |
|---|
| 41 | 41 | | SECTION 5. This Act takes effect September 1, 2021. |
