77 relating to wages and employment benefits.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. This Act shall be known as the Texas Small
1010 Business Protection Act.
1111 SECTION 2. Section 62.002, Labor Code, is amended by adding
1212 Subdivision (8) to read as follows:
1313 (8) "Wages" has the meaning assigned by Section
1414 61.001.
1515 SECTION 3. Subtitle D, Title 2, Labor Code, is amended by
1616 adding Chapter 83 to read as follows:
1717 CHAPTER 83. PROHIBITION AGAINST LOCAL REGULATION OF EMPLOYMENT
1818 BENEFITS
1919 Sec. 83.001. DEFINITIONS. In this chapter:
2020 (1) "Employee" means an individual who is employed by
2121 an employer for compensation.
2222 (2) "Employer" means a person who employs one or more
2323 employees.
2424 (3) "Employment benefit" means anything of value that
2525 an employee receives from an employer in addition to monetary
2626 compensation, including:
2727 (A) health, disability, retirement,
2828 profit-sharing, and death benefits;
2929 (B) group accidental death and dismemberment
3030 benefits; and
3131 (C) paid days off from work for holidays, sick
3232 leave, vacation, and personal necessity.
3333 Sec. 83.002. PROHIBITION AGAINST MUNICIPALITY OR COUNTY
3434 REQUIRING EMPLOYMENT BENEFITS. A municipality or county may not
3535 adopt or enforce an ordinance, order, rule, or regulation that
3636 requires an employer in the municipality or county to provide
3737 employment benefits.
3838 SECTION 4. Chapter 83, Labor Code, as added by this Act,
3939 applies to an ordinance, order, rule, or regulation adopted before,
4040 on, or after the effective date of this Act.
4141 SECTION 5. This Act takes effect September 1, 2021.
