57 relating to the availability of personal information of a current
68 or former federal prosecutor or public defender.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 552.117(a), Government Code, as
911 reenacted and amended by Chapters 367 (H.B. 1351), 633 (S.B. 1494),
1012 1146 (H.B. 2910), 1213 (S.B. 662), and 1245 (H.B. 2446), Acts of the
1113 86th Legislature, Regular Session, 2019, is reenacted and amended
1214 to read as follows:
1315 (a) Information is excepted from the requirements of
1416 Section 552.021 if it is information that relates to the home
1517 address, home telephone number, emergency contact information, or
1618 social security number of the following person or that reveals
1719 whether the person has family members:
1820 (1) a current or former official or employee of a
1921 governmental body, except as otherwise provided by Section 552.024;
2022 (2) a peace officer as defined by Article 2.12, Code of
2123 Criminal Procedure, or a security officer commissioned under
2224 Section 51.212, Education Code, regardless of whether the officer
2325 complies with Section 552.024 or 552.1175, as applicable;
2426 (3) a current or former employee of the Texas
2527 Department of Criminal Justice or of the predecessor in function of
2628 the department or any division of the department, regardless of
2729 whether the current or former employee complies with Section
2830 552.1175;
2931 (4) a peace officer as defined by Article 2.12, Code of
3032 Criminal Procedure, or other law, a reserve law enforcement
3133 officer, a commissioned deputy game warden, or a corrections
3234 officer in a municipal, county, or state penal institution in this
3335 state who was killed in the line of duty, regardless of whether the
3436 deceased complied with Section 552.024 or 552.1175;
3537 (5) a commissioned security officer as defined by
3638 Section 1702.002, Occupations Code, regardless of whether the
3739 officer complies with Section 552.024 or 552.1175, as applicable;
3840 (6) an officer or employee of a community supervision
3941 and corrections department established under Chapter 76 who
4042 performs a duty described by Section 76.004(b), regardless of
4143 whether the officer or employee complies with Section 552.024 or
4244 552.1175;
4345 (7) a current or former employee of the office of the
4446 attorney general who is or was assigned to a division of that office
4547 the duties of which involve law enforcement, regardless of whether
4648 the current or former employee complies with Section 552.024 or
4749 552.1175;
4850 (8) a current or former employee of the Texas Juvenile
4951 Justice Department or of the predecessors in function of the
5052 department, regardless of whether the current or former employee
5153 complies with Section 552.024 or 552.1175;
5254 (9) a current or former juvenile probation or
5355 supervision officer certified by the Texas Juvenile Justice
5456 Department, or the predecessors in function of the department,
5557 under Title 12, Human Resources Code, regardless of whether the
5658 current or former officer complies with Section 552.024 or
5759 552.1175;
5860 (10) a current or former employee of a juvenile
5961 justice program or facility, as those terms are defined by Section
6062 261.405, Family Code, regardless of whether the current or former
6163 employee complies with Section 552.024 or 552.1175;
6264 (11) a current or former member of the United States
6365 Army, Navy, Air Force, Coast Guard, or Marine Corps, an auxiliary
6466 service of one of those branches of the armed forces, or the Texas
6567 military forces, as that term is defined by Section 437.001;
6668 (12) a current or former district attorney, criminal
6769 district attorney, or county or municipal attorney whose
6870 jurisdiction includes any criminal law or child protective services
6971 matters, regardless of whether the current or former attorney
7072 complies with Section 552.024 or 552.1175;
7173 (13) a current or former employee of a district
7274 attorney, criminal district attorney, or county or municipal
7375 attorney whose jurisdiction includes any criminal law or child
7476 protective services matters, regardless of whether the current or
7577 former employee complies with Section 552.024 or 552.1175;
7678 (14) a current or former employee of the Texas Civil
7779 Commitment Office or of the predecessor in function of the office or
7880 a division of the office, regardless of whether the current or
7981 former employee complies with Section 552.024 or 552.1175; [or]
8082 (15) a current or former federal judge or state judge,
8183 as those terms are defined by Section 1.005, Election Code, or a
8284 spouse of a current or former federal judge or state judge;
8385 (16) a current or former child protective services
8486 caseworker, adult protective services caseworker, or investigator
8587 for the Department of Family and Protective Services, regardless of
8688 whether the caseworker or investigator complies with Section
8789 552.024 or 552.1175, or a current or former employee of a department
8890 contractor performing child protective services caseworker, adult
8991 protective services caseworker, or investigator functions for the
9092 contractor on behalf of the department; [or]
9193 (17) [(16)] a state officer elected statewide or a
9294 member of the legislature, regardless of whether the officer or
9395 member complies with Section 552.024 or 552.1175;
9496 (18) [(16)] a current or former United States
9597 attorney, [or] assistant United States attorney, federal public
9698 defender, deputy federal public defender, or assistant federal
9799 public defender and the spouse or child of the current or former
98100 attorney or public defender, regardless of whether the person
99101 complies with Section 552.024 or 552.1175; or
100102 (19) [(16)] a firefighter or volunteer firefighter or
101103 emergency medical services personnel as defined by Section 773.003,
102104 Health and Safety Code, regardless of whether the firefighter or
103105 volunteer firefighter or emergency medical services personnel
104106 comply with Section 552.024 or 552.1175, as applicable.
105107 SECTION 2. Section 552.1175(a), Government Code, as amended
106108 by Chapters 367 (H.B. 1351), 633 (S.B. 1494), 1146 (H.B. 2910), 1213
107109 (S.B. 662), and 1245 (H.B. 2446), Acts of the 86th Legislature,
108110 Regular Session, 2019, is reenacted and amended to read as follows:
109111 (a) This section applies only to:
110112 (1) peace officers as defined by Article 2.12, Code of
111113 Criminal Procedure, or special investigators as described by
112114 Article 2.122, Code of Criminal Procedure;
113115 (2) county jailers as defined by Section 1701.001,
114116 Occupations Code;
115117 (3) current or former employees of the Texas
116118 Department of Criminal Justice or of the predecessor in function of
117119 the department or any division of the department;
118120 (4) commissioned security officers as defined by
119121 Section 1702.002, Occupations Code;
120122 (5) a current or former district attorney, criminal
121123 district attorney, or county or municipal attorney whose
122124 jurisdiction includes any criminal law or child protective services
123125 matters;
124126 (5-a) a current or former employee of a district
125127 attorney, criminal district attorney, or county or municipal
126128 attorney whose jurisdiction includes any criminal law or child
127129 protective services matters;
128130 (6) officers and employees of a community supervision
129131 and corrections department established under Chapter 76 who perform
130132 a duty described by Section 76.004(b);
131133 (7) criminal investigators of the United States as
132134 described by Article 2.122(a), Code of Criminal Procedure;
133135 (8) police officers and inspectors of the United
134136 States Federal Protective Service;
135137 (9) current and former employees of the office of the
136138 attorney general who are or were assigned to a division of that
137139 office the duties of which involve law enforcement;
138140 (10) current or former juvenile probation and
139141 detention officers certified by the Texas Juvenile Justice
140142 Department, or the predecessors in function of the department,
141143 under Title 12, Human Resources Code;
142144 (11) current or former employees of a juvenile justice
143145 program or facility, as those terms are defined by Section 261.405,
144146 Family Code;
145147 (12) current or former employees of the Texas Juvenile
146148 Justice Department or the predecessors in function of the
147149 department;
148150 (13) federal judges and state judges as defined by
149151 Section 1.005, Election Code;
150152 (14) current or former employees of the Texas Civil
151153 Commitment Office or of the predecessor in function of the office or
152154 a division of the office; [and]
153155 (15) a current or former member of the United States
154156 Army, Navy, Air Force, Coast Guard, or Marine Corps, an auxiliary
155157 service of one of those branches of the armed forces, or the Texas
156158 military forces, as that term is defined by Section 437.001;
157159 (16) [(15)] a current or former child protective
158160 services caseworker, adult protective services caseworker, or
159161 investigator for the Department of Family and Protective Services
160162 or a current or former employee of a department contractor
161163 performing child protective services caseworker, adult protective
162164 services caseworker, or investigator functions for the contractor
163165 on behalf of the department; [and]
164166 (17) [(15)] state officers elected statewide and
165167 members of the legislature;
166168 (18) [(15)] a firefighter or volunteer firefighter or
167169 emergency medical services personnel as defined by Section 773.003,
168170 Health and Safety Code; and
169171 (19) a current or former United States attorney,
170172 assistant United States attorney, federal public defender, deputy
171173 federal public defender, or assistant federal public defender.
172174 SECTION 3. Section 25.025(a), Tax Code, as amended by
173175 Chapters 467 (H.B. 4170), 469 (H.B. 4173), 633 (S.B. 1494), 1213
174176 (S.B. 662), and 1245 (H.B. 2446), Acts of the 86th Legislature,
175177 Regular Session, 2019, is reenacted and amended to read as follows:
176178 (a) This section applies only to:
177179 (1) a current or former peace officer as defined by
178180 Article 2.12, Code of Criminal Procedure, and the spouse or
179181 surviving spouse of the peace officer;
180182 (2) the adult child of a current peace officer as
181183 defined by Article 2.12, Code of Criminal Procedure;
182184 (3) a county jailer as defined by Section 1701.001,
183185 Occupations Code;
184186 (4) an employee of the Texas Department of Criminal
185187 Justice;
186188 (5) a commissioned security officer as defined by
187189 Section 1702.002, Occupations Code;
188190 (6) an individual who shows that the individual, the
189191 individual's child, or another person in the individual's household
190192 is a victim of family violence as defined by Section 71.004, Family
191193 Code, by providing:
192194 (A) a copy of a protective order issued under
193195 Chapter 85, Family Code, or a magistrate's order for emergency
194196 protection issued under Article 17.292, Code of Criminal Procedure;
195197 or
196198 (B) other independent documentary evidence
197199 necessary to show that the individual, the individual's child, or
198200 another person in the individual's household is a victim of family
199201 violence;
200202 (7) an individual who shows that the individual, the
201203 individual's child, or another person in the individual's household
202204 is a victim of sexual assault or abuse, stalking, or trafficking of
203205 persons by providing:
204206 (A) a copy of a protective order issued under
205207 Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a
206208 magistrate's order for emergency protection issued under Article
207209 17.292, Code of Criminal Procedure; or
208210 (B) other independent documentary evidence
209211 necessary to show that the individual, the individual's child, or
210212 another person in the individual's household is a victim of sexual
211213 assault or abuse, stalking, or trafficking of persons;
212214 (8) a participant in the address confidentiality
213215 program administered by the attorney general under Subchapter B,
214216 Chapter 58, Code of Criminal Procedure, who provides proof of
215217 certification under Article 58.059, Code of Criminal Procedure;
216218 (9) a federal judge, a state judge, or the spouse of a
217219 federal judge or state judge;
218220 (10) a current or former district attorney, criminal
219221 district attorney, or county or municipal attorney whose
220222 jurisdiction includes any criminal law or child protective services
221223 matters;
222224 (11) a current or former employee of a district
223225 attorney, criminal district attorney, or county or municipal
224226 attorney whose jurisdiction includes any criminal law or child
225227 protective services matters;
226228 (12) an officer or employee of a community supervision
227229 and corrections department established under Chapter 76,
228230 Government Code, who performs a duty described by Section 76.004(b)
229231 of that code;
230232 (13) a criminal investigator of the United States as
231233 described by Article 2.122(a), Code of Criminal Procedure;
232234 (14) a police officer or inspector of the United
233235 States Federal Protective Service;
234236 (15) a current or former United States attorney, [or]
235237 assistant United States attorney, federal public defender, deputy
236238 federal public defender, or assistant federal public defender and
237239 the spouse and child of the attorney or public defender;
238240 (16) a current or former employee of the office of the
239241 attorney general who is or was assigned to a division of that office
240242 the duties of which involve law enforcement;
241243 (17) a medical examiner or person who performs
242244 forensic analysis or testing who is employed by this state or one or
243245 more political subdivisions of this state;
244246 (18) a current or former member of the United States
245247 armed forces who has served in an area that the president of the
246248 United States by executive order designates for purposes of 26
247249 U.S.C. Section 112 as an area in which armed forces of the United
248250 States are or have engaged in combat;
249251 (19) a current or former employee of the Texas
250252 Juvenile Justice Department or of the predecessors in function of
251253 the department;
252254 (20) a current or former juvenile probation or
253255 supervision officer certified by the Texas Juvenile Justice
254256 Department, or the predecessors in function of the department,
255257 under Title 12, Human Resources Code;
256258 (21) a current or former employee of a juvenile
257259 justice program or facility, as those terms are defined by Section
258260 261.405, Family Code;
259261 (22) a current or former employee of the Texas Civil
260262 Commitment Office or the predecessor in function of the office or a
261263 division of the office; [and]
262264 (23) a current or former employee of a federal judge or
263265 state judge;
264266 (24) a current or former child protective services
265267 caseworker, adult protective services caseworker, or investigator
266268 for the Department of Family and Protective Services or a current or
267269 former employee of a department contractor performing child
268270 protective services caseworker, adult protective services
269271 caseworker, or investigator functions for the contractor on behalf
270272 of the department; [and]
271273 (25) [(24)] a state officer elected statewide or a
272274 member of the legislature; and
273275 (26) [(24)] a firefighter or volunteer firefighter or
274276 emergency medical services personnel as defined by Section 773.003,
275277 Health and Safety Code.
276278 SECTION 4. The changes in law made by this Act to Sections
277279 552.117 and 552.1175, Government Code, and Section 25.025, Tax
278280 Code, apply only to a request for information that is received by a
279281 governmental body or an officer on or after the effective date of
280282 this Act. A request for information that was received before the
281283 effective date of this Act is governed by the law in effect on the
282284 date the request was received, and the former law is continued in
283285 effect for that purpose.
284286 SECTION 5. To the extent of any conflict, this Act prevails
285287 over another Act of the 87th Legislature, Regular Session, 2021,
286288 relating to nonsubstantive additions to and corrections in enacted
287289 codes.
288290 SECTION 6. This Act takes effect immediately if it receives
289291 a vote of two-thirds of all the members elected to each house, as
290292 provided by Section 39, Article III, Texas Constitution. If this
291293 Act does not receive the vote necessary for immediate effect, this
292294 Act takes effect September 1, 2021.
